Code Sec. 25526.5 SUBJECT: Sale of Surplus Property Walnut Creek Project No. 7520-6B8379 Walnut Creek Area The Board of Supervisors as the Governing Body of Contra Costa County Flood Control and Water Conservation District RESOLVES THAT: Contra Costa County Flood Control District acquired the real property known as Walnut Creek along Bancroft Road, a portion of which is described in Exhibit "A" attached hereto. Said property is DETERMINED to be surplus and no longer required for any District purposes and its estimated value does not exceed $10,000.00. This Board hereby APPROVES and AUTHORIZES the sale of said property to the City of Walnut Creek for road widening, pursuant to Government Code Section 25526.5 and the Board Chair is hereby AUTHORIZED to execute a Grant Deed, a Right of Way Contract and Escrow Instructions on behalf of the District in consideration for the payment received in full in the amount of $7,200.00, the estimated fair market value of the property. The Real Property Division is DIRECTED to cause the Grant Deed to be delivered to the Grantee. The Board hereby FINDS that the project will not have a significant effect on the environment, and DETERMINES that the project is exempt from the requirements of the California Environmental Quality Act as a Class 12 Categorical Exemption under County Guidelines and Section 15312 of the State CEQA Guidelines, and DIRECTS the Public Works Director to file a Notice of Exemption with the County Clerk. Being a portion of "Parcel One" conveyed in the deed from San Francisco Bay Area Rapid Transit District to Contra Costa County Flood Control and Water Conservation District recorded November 4, 1969 in Book 5997 at page 247; Official Records of said County. Beginning on the southeast line of said "Parcel One" at a concrete monument with disc stamped "SFBART LS 2742" being at coordinates Y = 525,885.170 feet, and X = 1 ,554,125.674 feet, and which bears North 340 50' 50" West 141 .20 feet from a similar monument at coordinates Y = 525,769.290 feet and X = 1 ,554,206.354 feet (said monuments are approximately 40 feet westerly of the centerline of Bancroft Road, formerly County Road as shown on said map of Bancroft Orchard Tract).
