RECOMMENDATIONS
AUTHORIZE the Director of Building Inspection to execute a Joint Exercise of Powers
Agreement with the City of San Pablo to provide building inspection related services to the
City of San Pablo.
FISCAL IMPACT
None. All costs will be reimbursed by the City of San Pablo.
BACKGROUND/REASONS FOR RECOMMENDATIONS
The City of San Pablo has requested the County's assistance to perform Building Official
services until the City can hire a new Building Official. The County may also be called
upon to provide assistance in the areas of plan review, inspections, and zoning/building
violation investigations. These additional tasks will be performed on an as needed basis.
Being the largest building department in the County, the Department has the technical
ability and experience to perform all essential tasks associated with the function.
The City Council of San Pablo at its September 4, 2001 meeting authorized the City
Manager to execute an agreement with the Contra Costa County Building Inspection
Department. The agreement and the resolution are attached to this report. The
agreement is the standard agreement that the Board approved for building services for the
City of EI Cerrito, and it has been approved as to form by County Counsel's office.

Contra Costa County Building Inspection Department will provide the services consistent
with the guideline and procedures of the City of San Pablo and applicable codes. The
Department will work closely with the City's Community Development Department in the
implementation of the building inspection services.
This will require temporary reassignment of one employee, but the Department does not
anticipate the need to augment Department staffing level.

AGREEMENT
FOR BUILDING INSPECTION SERVICTS
This Agreement is entered into between the City of .1-,an Pablo ("City"), and
Contra Costa County ("County") for building inspection services to be provided by Clic
County and the City.
RECITALS:
A. The City desires to hire a County Building Inspection Department staff liersoll to
be the City's Building Official to be in charge of the Building Division of the
C'ity's Community Development Department. In addition, the City desires, from
time to time, to hire other County Building inspection Department stiffto provide
inspection, plan checking, responses to citizen complaint and investipilion
services to the Building Division of" the City's Community l.)cv001MIc111.

13. The purpose of this Agreement is to set forth the terms and fees fir providing
building inspection services to the Building Division of the (:'ity's ('rnllrnunity
Development Department.

Section 1. SERVICES TO BE, R..FNDERED
The City agrees to hire County Building Inspection Department stall' to provide
services to the Building Division of the City's Community Development Dehartrnew as
set forth in Exhibit A, which is incorporated by reference herein. Tlic City will furnish
direction to County Building inspection Department staff as needed through its
Community Development Director, who is the department head of its ('011111n111ity
i)evelopment Department, in order to accomplish the services listed in this Agreement.
The County will provide vehicles and communication equipment as deemed necess..u•y by
the County. County state shall remain employees of the County. City shall nut tie
responsible fur worker's compensation or any employee benefits, other than provided in
this Agreement and attached .Exhibits A & B.
Section 2. 'TERM
This Agreement is effective from September 5, 2001 throtl�,h March 4, 2002, and
will be automatically renewed for additional six month terms unless terminated us sot

Section 3. PAYMENTOF FEES AND REIMBURSEMENTOF (..'OSIS
E:x.cept. as expressly provided in Exhibit B, attached hereto and incorporated
herein, the City shall hay the following fees to the County for the scrvices perlOrmed

a. The fee for the county staff person who will serve as the City's Building t.lfiicial
shall be $65.00 per hour. Inspection, code enforcement and other services
provided to the City by County Building; Inspection Department staff not
involving plan checking or review Or otherwise covered in Fxhibit 13. shall he as
follows: for a1 County Senior Building Inspector, the fox sh;lll ho $65.00 per hour;
for it C`.ounty Building Inspector 1I, the fee shall be $60.00 per hour; fora Counly
Building Inspector 1, the fee shall be$50.00 per hour.
b. The County, through staff of the Building Inspection Department, will submit to
the City, it monthly report detailing expenditures and charges. This report Shall
include reasonable documentation of expenses incurred, including but not limited
to invoices and time sheets.

Section 4. HOLD HARMLESS AND INDEMNITY
County agrees to indemnify and hold harmless the City from the: County's skarc

least 30 days written notice thereof to the other party.

Duties to he performed by County Building Inspection Department staff flor
the City of San Pablo's Ruilding Division of the Community Development
Delrnrtment
Scope of Duties: Under general direction by the Manager of the ('ity's Community
i evelo(►tncni Department ("Manager'), a County Building inspcchon Department staff
person will serve as the City's Building Official. In addition, and as requested by the
City, through the Manager, other County Building Inspection stal'f persons will provide
inspection services in connection with the enforcement of City building, zoning,
mechanical, plumbing, electrical, housing and related codes and rCgUlaliorts, including
unilbyrn codes as adopted by the City, goveming the construction, alteration, repair ;ind
use of buildings and structures. The City, through the Manager, may also request County
Building Inspection Department staff, from time to time, to assist in the review of'
submitted building plans in connection with applicable building, .uid 70ninp eo des Wid
laws and to perform code enforcement services as described below:
1. Building Uffielal Services:
The appointed Building Official will have overall responsibility for supervising
the work of building inspection staff. The appointed Building Official will plan,
organize, coordinate and review the work of all inspectors assigned to all phases
of the construction of single and multi-family structures. including public
110usin6, will review "Stop Work" and "Notice to Comply- orders prior 11i their
issuance when so requested by the Manager, will provide technical direction and
training to building inspectors, will perform over-the-counter plan review of n ott-
engineered structures and will perform inspections, including field insficctiun , as
described in Section 11, below, when requested to do so by the Managcr. 1 he
appointed Building Official will serves as a liaison between the City and bulldkn-s
of major development projects. The appointed Building Official will maintain
records and prepare reports as required.
Il. Inspection Services
Inspection services to he provided to the City include the 6611(1wing:

and N.F.C'.) as adopted by the City of Sari Pablo Municipal Codcs, issuance of'

Interpretation of applicable codes and regulations; ;:xplanation ol' rcgklircd
inspections and construction requirements to owner~, architects, euginccrs,

III. Plan Review Services
1. At the request of, and as directed by the City, through the Manager. t.:'minty
Building inspection staff shall check plans and specifications for compliauice
thereol' with the requirements of the current adopted building, codes and with the
City's Municipal Code.
2. Alter the Plans and specifications are delivered to County Building Inspection
stag for review, the County Building Inspection staff shall furnish to City ;►
written report indicating, whether such plans and specifications are in compliance
with applicable codes or not and if not, identifying each h ilurc to comply with
such codex. When necessary, County Building inspection staff will meet will►
involved architects or engineers to make a determination of compliance.
3. All Plans and specifications to be reviewed will be picked up by County Building
Inspection staff from City's offices and returned thereto, at. County's own
expense, or will be transmitted to County in mailing bags provided by the: C.ucmty
to City at County's expense.
IV. Code Enforcemen__t
I. At the request of, and as directed by the City, through the Manager. County
Building Inspection staff will investigate complaints regarding zoning; violations
and/or building code violations.
2. Inspections and investigations will follow the requirements ol'the current building
codes, as adopted by the City, and applicable provisions of the City's Municipal
Code.
3. Crude enforcement will be performed by County Building; inspection daft at the
level of Building Inspector 1.

Payment Provisions for Plan Checking and Review
Invoices shall be paid promptly, upon the timely approval of authorized City staff. in
accordance with the following:
Compensation. City hereby Agrees to pay County:
1. As total compensation for the regular plan check services it) be rendered by
County pursuant to F..xhibit A of this Agreement, County shall he paid a minimum
fee, or a percentage of the plan check fee collected by the City Iona the
applicants, based upon the following schedule:
1.1 All plan cheeks services shall include the original elleck and, i I'necessary,
up to two follow-up checks.
1.2 I l.ourly rata for subject services for third or additional 1ia11ow-up check or
design change check after the issuance of permits is $65.00 per hour.

1.3.1 Structural only is 40% of plan check Ice collected by Elie City.
1.3.2 Structural plus energy Title 24 State Administrative: Codc Emcrgy
Check is 45%of the plan check fee collected by the City.
1.3.3 Structural fire/life safety, handicapped accessibility. energy, and
building code regulations are 70% of the plan check fee collected
by the City.

Accessibility is 10%of the plan check fee.
2. In the event County staff is requested by City to review clrunges on plans or
specifications previously checked and follow-up check by County, or to peribrnt
any other additional services beyond those described in Iixhibit A of this
Agreement, County shall be compensated for such services basod tipon C;ountys'
standard hourly rate of$65.00 per hour.
3. 'rhe County entitlement to compensation for regular and/or additional plain check
service~ shall be deemed complete upon the City's approval of the services or
within 60 days of plan submittal to City, without City objection whichever is I irst.
County Building Inspection staff shall submit to City two sets of checked plums
.signed by County as plan checked and one set ofcalculations and specification i.
Itemised billing services shall be attached as set forth n Nection 5b above.
Compensation to County, shall be paid by City within one month of receipt of
County's invoice.

evaluated to be less than $1,500,000.
5.2 "Three weeks for Sections 1, 1.1, 1.2, 1.3.1, 1.3.2, 1.3.3, and 1.3.4 For projects
evaluated to he from $1,500,000 to 5,000,000.
5.3 Four weeks for Sections 1, 1.1, 1.2, 1.3.1, 1.3.2, 1.3.3 and 1.3.34 for projects
evaluated to be more than $5,000,000.
5.4 Five working days for each tollow-up check..
The first day of review is the firs working day after receipt ol'plans from City. At
the completion of every review, a list of plan review coir1rncnts will he sent to
the applicant (or designated party) in addition to the City Building official.
Modifications to Sections 1, 1.1, 1.2, 1.3.1, 1.3.2, 1.3:3, and 1.3.4 ahove may he.
necessary due to workload and/or quantity of plan submission by City. Cot.mty
will notify City at the earliest possible time as to the possibility of a delay on
meeting the established deadlines.
