RECOMMENDATIONS
As the Board of Supervisors and as the Governing Board of the Redevelopment Agency ADOPT a
Resolution making findings regarding the use of Pleasant Hill BART Redevelopment Housing Set-Aside
funds for acquisition of the Las Juntas Swim Club property.
AUTHORIZE the Deputy Director—Redevelopment to execute an Option to Purchase Agreement with
the Las Juntas Swim Club, a California non profit corporation, David Fischer, Garson Soe, and Robert
Orminston, relative to acquisition of a 2.1 acre site in the City of Walnut Creek adjacent to the Pleasant
Hill BART Station Area;
APPROVE AND AUTHORIZE the Director of Community Development,on behalf of the County,and the
Deputy Director — Redevelopment, on behalf of the Redevelopment Agency, to execute a Lo2n
Agreement for an amount up to $2.2 million;
AUTHORIZE the Deputy Director—Redevelopment to arrange for journal transfer(s)from County Fund
No. 111300-1596, the Affordable Housing Special Revenue Fund, in payment thereof;
DETERMINE that the activity, acquiring property, is exempt from the California Environmental Quality
Act (CEQA) pursuant to Section 15061(b)(3) of the CEQA Guidelines; and
DIRECT the Deputy Director—Redevelopment to file a Notice of Exemption with the County Clerk,and
to arrange for payment of the $25 handling fee of the County Clerk for filing the Notice of Exemption.

FISCAL IMPACT
No General Fund money will be used in the acquisition. Funds to be borrowed by
the Agency from the County are restricted revenue that can only be used to facilitate
the development of housing.
BACKGROUND/REASONS FOR RECOMMENDATIONS
The Las Juntas Swim Club property is a 2.1 acre site adjacent to the Pleasant Hill BART
Station Redevelopment Project (Exhibit A). The site is in the City of Walnut Creek but
contiguous to the County's Pleasant Hill BART Station Area Redevelopment Project. The
intent of the Redevelopment Agency in entering into an Option to Purchase Agreement with
the Las Juntas Swim Club,a non profit corporation, David Fischer, Garson Soe,and Robert
Orminston (collectively the"Sellers") is to work cooperatively with the City of Walnut Creek,
area residents, and the Sellers to:
a) Identify housing development opportunities consistent with the City's General
Plan, its Housing Element,and the City's Land Use/Zoning Regulations;and
b) To initiate an application with the City of Walnut Creek for a Land Use Permit
for temporary BART patron parking on the site.
With the results of these public processes,the Agency can determine whether the exercise
of the option is prudent. The Option to Purchase Agreement provides for a$100,000 non-
refundable deposit for a six-month option.
The Option to Purchase Agreement also provides for a leaseback of the Las Juntas Swim
Club facilities to the Swim Club or its designated successor. The leaseback amount is
$50,000/year, which amount would be paid from acquisition proceeds retained in escrow.
The Swim Club or its successor would have to notice the Agency of it intent to lease by June
30, 2002. The lease would be through June 30, 2005. The intent of the parties is to
relocate the Swim Club facility to another on a portion of the property as part of a
redevelopment of the property.
The interim use of the property for BART patron parking is a piece of an overall strategy to
address concerns regarding removal of temporary BART patron parking on the Iron Horse
Corridor. The multi-faceted approach to addressing concerns is being overseen by the
Pleasant Hill BART Steering Committee, and is detailed in Exhibit B. A Land Use Permit for
temporary parking must be secured from the City of Walnut Creek. The long-term
replacement of temporary BART parking in the Iron Horse Corridor is as part of the mixed-
use development of the BART joint development property. The recently completed Pleasant
Hill BART Charrette indicates that such permanent replacement can be achieved from a
sitting standpoint.
The Redevelopment Agency will be borrowing affordable housing funds from the County to
complete any acquisition. This obligation will be repaid to the County from future Pleasant
Hill BART redevelopment housing set-aside funds. Because the subject property is located
outside the Pleasant Hill BART Station Area, and in the City of Walnut Creek the Board of
Supervisors and the Governing Board of the Redevelopment Agency must make findings
pursuant to Health and Safety Code Section 33334.2(g)(2)(A). The findings are appropriate
based on the following:
a) Project Area Benefit
The subject property is designated multi-family residential in the City of
Walnut Creek General Plan. Residential uses in the Pleasant Hill BART
Station Area have resulted in a significant fraction of residents using public
transit or walking to work. This results in a reduction in traffic congestion in
the area (see Exhibit C excerpts from Final Traffic Report for the
Amendments to the Pleasant Hill BART Station Area Specific Plan, July
1997).
b) Housing Element Compliance
Both the City of Walnut Creek and the County of Contra Costa are in
compliance with State Housing Element requirements (California
Government Code Section 65580 et seq.) by having adopted Housing
Elements which have been certified as adequate by the State Department of

Housing and Community Development (Exhibit D).
C) Displacement
The site contains no existing residential uses therefore no displacement from
the site will occur.
d) Minority and Low Income Population
The Pleasant Hill BART Station Area does not have concentrations of
minority or lower income populations in excess of 50%. Based on the 1990
and the 2000 census the concentrations of such populations are well below
50% of the total population as shown below:

e) Proximity to Pleasant Hill BART Station Area
The subject property is immediately contiguous to the Pleasant Hill BART
Station Redevelopment project area, therefore it meets the test of being
closer to the Station Area than other locations in the unincorporated County.
The subject property is less than 300 feet from the Pleasant Hill BART
Station property of the Bay Area Rapid Transit District(BART). (See Exhibit
A).

This memo reports on the status of the projects and initiatives to manage the closure of the current
temporary park & ride lot at the Pleasant Hill BART Station.
On December 12, 2000, the Steering Committee requested staff to proceed with implementation of the
Greenspace Project and to implement the measures identified by staff to manage the closure of the
parking currently occupying the site. These measures are estimated, in the near term, to create or save
over 600 parking spaces for BART patrons and include the following:

'Staff has used very conservative estimating procedures to generate these counts so as not to overstate(lie number of
spaces likely to be accrued.
The only change in the above table from the December 12 meeting is for the Las Juntas Swim Club site.
The amount of parking is down from 250 spaces to 200 spaces. This change reflects the concern of
representatives from the City of Walnut Creek, who believe it is unlikely that the City would approve
any project to construct temporary parking at this location if it did not retain the swim club use. During
the planning charrette underway for the BART development, alternatives were prepared for the Las
Juntas Swim Club site that retain the swim club and provide up to 200 parking spaces.
Exhibit A to this memo is an updated version of the Timeline for Implementation of the Steering
Committee's action. For planning purposes, this timeline still assumes closure of the temporary park
ride lot in November 2401.
Exhibit B to this memo is a chart that describes the status of implementing the projects in Exhibit A.
Exhibit C to this memo is an updated version of the more detailed table of strategies for managing the
closure of the temporary park & ride lot, which the Steering Committee has been discussing since
November of 1999. This information should be consistent with the information covered in Exhibit B, as
well as providing background on some of the other strategies that were considered, but not pursued or
needed for closure of the temporary park & ride lot.

(b) Long-term Year 2010 Conditions. This represents overall projected traffic conditions
in the year 2010 for the buildout of the Specific Plan proposals. The methodologies of the
CCTA CentraVCMP Model are used to established background regional and subregional
cumulative traffic growth and distribution patterns, The trip generation and distribution
within the Specific Plan area developed for the short term Project Conditions is then
superimposed on the background traffic condition. This scenario is analyzed to evaluate
overall infrastructure needs for the area at the buildout of the Specific Plan and to evaluate
the effectiveness of the proposed major transportation system improvement alternatives.
Residential Trip Generation
The residential trip rates have been reduced to reflect proximity to BART. A 1993 sWdy conducted by the
University of California at Berkeley 6 included data collected near BART stationsim'tfie East Bay. The data
indicated that commute ridership ranged between 28 and 40 percent for residences within one third mile of
the BART station. A survey of Treat Commons residences indicated that 40.5 percent used BART on a
regular basis for their commutes. Given limited parking at BART and the typical walk distances of less than
a quarter mile, it is likely that virtually all BART patrons, expected-to live in housing developed within the
Specific Plan area,will walk to the station. Using county-wide estimates of modal choice provided in Table
D-12A in Attachment D and the high percentage of walk-transit commute trips in the Specific Plan Area,
it is estimated that the ITE trip generation rates over-estimate peak hour vehicle trip making by about 40
percent. Therefore,the ITE rates were reduced by 40 percent for all new residential development anticipated
within the Specific Plan Area.

serious and continuing efforts of State and local governments to effectively address California's housing needs.

The Contra Costa County Redevelopment Agency RESOLVES THAT:
WHEREAS, the Board of Supervisors (the "Board") of the County of Contra Costa (the
"County") has adopted the Pleasant Hill BART Station Redevelopment Plan by Ordinance No.
84-30 on July 10, 1984, and subsequent amendments thereto (the "Redevelopment Plan"). The
Redevelopment Plan sets forth a plan for redevelopment of the Pleasant Hill BART Station
Redevelopment Project Area (the "Project Area").
WHEREAS, Health and Safety Code Section 33334.2(g)(2)(A) allows the
Redevelopment Agency of the County of Contra Costa ("Agency") to use low and moderate
income housing funds maintained pursuant to Health and Safety Code Sections 33334.2 and
33334.3 ("Housing Funds") on projects within the incorporated limits of the City of Walnut
Creek, on-site, and contiguous to the Project Area if the Agency and the Board determine that the
use will benefit the Project Area and the Agency and the Board make certain findings.
WHEREAS, the Agency seeks to acquire the Las Juntas Swim Club (the "Property")
(Assessor's Parcel Numbers 148-180-050, 051 & 052), consisting of a 2.1 acre site situated
within the incorporated limits of the City of Walnut Creek and adjacent and contiguous to the
Project Area and, to that end, the Agency's Board concurrently with adoption of this resolution,
is authorizing Agency acquisition of the Property from the current owners, Las Juntas Swim
Club, David Fischer, Garson Soe and Robert Ormiston, and making the findings required
pursuant to Health and Safety Code Section 33334.(g)(2)(A).
WHEREAS, pursuant to Health and Safety Code Section 33334.2(g)(2)(B)(i), the
Agency desires to acquire the Property for the development of housing containing units
affordable to low- and moderate-income persons, to further the affordable housing and
community revitalization goals of the Agency.
WHEREAS, development of affordable housing on the Property would provide
affordable housing contiguous to the Project Area within walking distance of the BART Station,
which will be of benefit to the Project Area.
WHEREAS, by staff report accompanying this Resolution and incorporated into this
Resolution by this reference (the "Staff Report"), the Agency has been provided with additional
information upon which the findings and actions set forth in this Resolution are based.
NOW, THEREFORE, BE IT RESOLVED, that pursuant to Health and Safety Code
Sections 33334.2(g)(1) and (g)(2)(A), the Agency hereby finds that acquisition and development
of the Property with Housing Funds will be of benefit to the Project Area by providing affordable

housing adjacent to the Project Area and the BART Station, thereby reducing traffic congestion
in the Project Area by allowing persons to live within walking distance of the BART station or
workplaces in the Project Area. These findings are based on the facts and analysis set forth in
the Staff Report accompanying this Resolution.
BE IT FURTHER RESOLVED, that, pursuant to Health and Safety Code Section
33334.2(g)(2)(A)(i), the Agency finds, based on the information in the Staff Report, that both the
County of Contra Costa and the City of Walnut Creek have adopted and are implementing
complete and current housing elements of their general plans that the Department of Housing and
Community Development has determined to be in compliance with the requirements of Article
10.6 (commencing with Section 65580) of Chapter 3 of Division 1 of Title 7 of the Government
Code.
BE IT FURTHER RESOLVED, that, pursuant to Health and Safety Code Section
33334.2(g)(2)(A)(ii), the Agency finds that the acquisition and development of the Property
through the use of Housing Funds will not result in any residential displacement from the site
where the development is to be built, in that, as set forth in the Staff Report, there are no
residents or residential units on the Property.
BE IT FURTHER RESOLVED, that, pursuant to Health and Safety Code Section
33334.2(g)(2)(A)(iii), the Agency finds, based on the information in the Staff Report, that the
area where the Property is located is not one in which more than 50 percent of the population is
comprised of racial minorities or low-income families.
BE IT FURTHER RESOLVED, that, pursuant to Health and Safety Code Section
33334.2(g)(2)(A)(iv), the Agency finds that development of the Property will allow construction
of affordable housing at a location closer to a rapid transit station than any other location in the
unincorporated territory of the County outside the Project Area, in that the Property is closer to
the BART Station than any other incorporated area outside the Project Area.
BE IT FURTHER RESOLVED, that the Agency shall use the Housing Funds within the
incorporated limits of the City of Walnut Creek in compliance with the requirements set forth in
Health and Safety Code Section 33334.2(g)(2)(B).
