The cost of the appeal is borne by the Applicant. BACKGROUND/REASONS. FOR RECOMMENDATIONS The application for the land use permit was filed on April 14, 1999. It was a request to relocate the Brentwood Rod and Gun Club from its existing location on Concord Avenue in Brentwood with the same.types of activities, uses, and operations. The proposed project includes the following: a) a private, all-weather (gravel) road equipped with a recessed, locked gate near Camino Diablo; b) a one-story clubhouse. (approximately 1,600 square feet) along with a parking area for 25 vehicles; c) an air pistol and air rifle. shooting area south of the clubhouse; d)sign-up shack(400 square feet),e)storage building (576 square feet), f) a caretakers residence and barn, at the approximate location of the existing buildings on the site; g) a trap.and skeet field with associated trap house and skeet house (8.5 feet x 8.5 feet, each), along with a parking area for 25 vehicles; h) pistol and rifle shooting areas in the west portion of the site; and i) fencing to.control access to the site. A public hearing was held by the East County Regional Planning Commission on March 6, 2000. After receiving testimony on the project from the representatives of the project proponent and from the neighboring property owners, the East County Regional Planning Commission approved the project on a 4-1 vote. The issues raised by the neighboring property owners fall into the following categories: a) Health and.Safety c) Land Use Compatibility, Property Value b) Noise d) Wildlife. Effects Following the Planning Commission decision on the application, the Camino Diablo Homeowners Associations filed an appeal. and subsequently retained David Trotter,. Attorney, Bowles &Verna, to be their representative. The Silver Hills Estates Homeowner Association joined the appeal. Additionally, the Brentwood Rod and Gun Club appealed the approval to request modification to the Conditions of Approval The appeal lof the Association is aimed at seeking reconsideration of the entirety of the Planning Commission's decision (appeal dated March 15, 2000), including both the adoption of the Mitigated Negative Declaration of Environmental Significance and the granting of the land use permit. The appeal letter asserts that the Initial Study was flawed and failed to address the cumulative impacts of adding a gun club to the. existing range of land uses within of the community. ANALYSIS OF APPEAL FILED BY THE HOMEOWNERS ASSOCIATIONS Based on the issues raised in the appeal letters,the Community Development Department retained specialized consultants to evaluate safety, noise and biological issues. As the first step in evaluation of the safety-related issues, staff contacted officers in charge of the Contra Costa County, City and County of San Francisco and City of Concord police ranges. They provided suggestions that led to a nationwide search for a consultant Appeal (County File LP992027) Board of Supervisors August 7, 2001 Page 3 specializing in the design of shooting ranges. Ultimately the Community Development Department contracted with Kramer One, California licensed architects that have expertise in range design and safety, and who have designed ranges throughout the United States. Their approach to the safety study was to: 1) make a site visit; 2) review the Site Development Plan; 3) review pertinent documents in the County file (including appeal points, conditionsof approval adopted by the Planning Commission, and staff report); and 4) evaluate the data gathered.and issue a report which presents their recommendations. Additional research was performed by the environmental consultants retained by Contra Costa County.. Specifically, biologic and acoustical issues identified by the Associations were analyzed by Barry Anderson, Monk & Associates (biologists) and Rich Rodkin, Illingworth and Rodkin (acoustical engineers). Monk and Associates performed field surveys during the winter rainy season and spring, using protocols of the regulatory agencies. The Community Development Department advised its biologic consultant to confer with agency biologists to ensure that the survey work met the expectations of regulatory agencies. Similarly, the acoustical consultant reviewed the appeal points, performed additional field monitoring of noise, evaluated the data and prepared a letter- report that responds to the issues raised by the appeal. On December. 22,. 2000 a revised Site. Development Plan was submitted by the project proponent.. The revised plan relocates the skeet and trap shooting further from the east property line, and the grading concept was revised to yield. increased topographic screening of the skeet and trap shooting areas from vantage points to the east and southeast of the site. These changes were. made chiefly in response to the concerns of neighboring property owners because it preceded release of the. Safety Study, but the applicant was made aware of the concerns of Kramer One regard the travel distance of the shot used on the skeet and trap fields. These changes in the site plan have caused the "shotfall line" to be redrawn by the project engineer, Bellecci & Associates. The revised plan also shows "shot traps" adjacent to culverts which convey concentrated runoff from the site to down-gradient parcels. Also shown is a typical section for the proposed "shot traps". As the name. implies these traps are intended to prevent shot from being transported off site. As a result of the. revised. Site Development Plan, grading and slope easements are required on the lands of Tom Anderson and Tom Smith, respectively (APN 003-020-036 and -039). The project also requires earthwork within the Contra Costa Water Districts (CCWD) grading easement. The CCWD easement is over approximately 12.79 acres of the 39.34-acre Brentwood Rod & Gun Club parcel. Based on recommendations of the biologic consultant and the plan revision, a revised Initial Study was prepared and a Mitigated Negative Declaration of Environmental Significance was recirculated. The Safety Study performed by Kramer One concluded that the project was feasible provided that the final design met appropriate standards. The Kramer One report went on to provide detailed design—level suggestions. Subsequently, a list of additional conditions of approval was prepared for consideration by the Board that incorporates the recommendations of Kramer One. (COA's 28-32) Appeal (County File LP992027) Board of Supervisors August 7, 2001 Page 4 Appeal Point#1: Biological Resources The surveys were performed at inappropriate time of the year--October/November--and during an abnormally dry fall. As such the study is not an adequate basis for deferred mitigation as accepted in the Initial Study. The surveyor the survey report ignores or omits several sensitive species in the region. The survey's recommended protections fall short of standard practices in the area. StaffAnalysis:In the months following the Planning Commission hearing, additional field surveys were performed. Barrett Anderson, a biologist retained by the Community Development Department, issued a report titled "Biological Resources Report for the Brentwood Rod and Gun Club Project (LP992027), Byron Area, Contra Costa County, California"(report dated December 1, 1999). This report is a preliminary assessment of potential impacts to biological resources at the proposed Brentwood Rod and Gun Club site, which has been highly disturbed by past land use practices. Subsequent to the 1999 report, the biologist issued a September 26, 2000 letter-report that summarized the results of survey work performed during the 1999-2000 winter rainy season, as well as spring and summer 2000 field survey results. Briefly summarized, no special status plants or animals were confirmed on the site. The biologist letter points out that the pre-construction biologic surveys recommended in the 1999 report are still required, as is a wetland permit from the US Army Corps of Engineers. On October 24, 2000 Contra Costa County received a letter from Karen Miller, biologist, US Fish & Wildlife Service. This letter raised several biology-related issues. The biologists evaluated the issues raised and responded with letters to Karen Miller and Sheila Larson, both of the US Fish and Wildlife Service (USFWS) (letters dated November 15 and December 1, 2000, respectively). These letters provided clarification on the status of the biologic field survey work, and it presented the results of new analyses that responded to the following issues raised in the October 24, 2000 letter from the USFWS: lead pellets or dissolved lead in surface water reaching Kellogg Creek, and the effect of noise from the discharge of firearms on wildlife. To analyze the issues raised by the USFWS, Monk & Associates contacted representatives of the County Health Services Department, and reviewed reports issued by Engeo Inc., the consultants that evaluated the potential for lead contamination for the applicant. Acoustical studies were performed for the County by Illingworth & Rodkin (I&R). (The reports issued by I&R are dated December 22, 1999 and October 11, 2000. The December 22, 1999 report evaluated the noise effects of the proposed gun club project,the October 11, 2000 report responded to the noise-related issues raised in appeals filed by project opponents. As a result of the technical studies performed during calendar year 2000, Monk and Associates have identified potential impacts and mitigation measures, which have been incorporated into the Initial Study (see Revised Initial Study, pages 10 and 16). Appeal (County File LP992027) ,Board of Supervisors August 7, 2001 Page 5 Briefly summarized, mitigation measures were proposed to protect the water quality and habitat values of Kellogg Creek, and restrictions on night shooting were proposed to mitigate a potential impact on the Kit Fox. With regard to trees, the project includes removal of 14 trees with diameters of 6 inches. or greater (measured 4.5 feet above ground level). They include 12 cottonwood, along with one elm and one pepper tree. The largest tree in diameter is an 18-inch elm. The Tree Protection and Preservation Ordinance (Chapter 816-6) contains provisions for replacement of trees, as well as containing provisions for bonding. In the case of the Brentwood Rod and Gun Club project, the sum total of the diameter of trees to be removed is 172 inches, which translated to the planting of 29 replacement trees. The project proponent has agreed to submit a landscape plan that provides for planting a minimum of 30 trees of the 15-gallon size, which is consistent with the provisions of the Ordinance Code. Appeal Point #2: Hazards and Hazardous Materials The Initial Study uncritically accepts the "guarantee" of the.Gun Club that there will be no bullets or shot exiting the. site. . This is in conflict with the experiences of several professionally operated ranges in the area. Even the "supporting" documentation is questionable. For example, the proposed "shot fall line"was established with an irrelevant criteria and conflicts with the recommendations of national shooting organizations. Even the "typical" baffle design submitted by the Gun Club carries the note that "This baffle design is not adequate for high power rifles and some pistols." The possible consequences are so severe that mitigation must be sure and unambiguous. Documents submitted by the Gun Club identify the lead contamination in the soil as creating Hazardous Waste. Indeed,there are barrels of Hazardous Waste on their current property. This contradicts the "Less Than Significant Impact" finding. Staff Analysis: The Kramer One report evaluated safety-related issues, and provides specific standards and criteria for design of the range. Those standards and criteria have been translated into recommended conditions of approval. The primary conclusion of the Kramer One report is that if the design of the project incorporates their recommendations, the proposed project would be in compliance with all applicable safety standards and guidelines. In addition, staff is proposing a Range Master be present on the site during its use. This recommendation which goes beyond the recommendations of Kramer One, is designed to ensure that use of firearms and the types of loads and club rules are enforced. With respect to the barrels of hazardous waste on the former gun club site, those barrels contain petroleum contaminated soils that were brought to the site by the Public Works Department for temporary storage during grading of the Delta By-Pass Road. Appeal (County File LP992027) .Board of Supervisors August 7, 2001 Page 6 Appeal Point#3: Hydrology and Water Quality The Initial Study misinterprets its own documents and incorrectly downplays the risks associated with lead contamination and the potential consequences. The summary points out the runoff from the project site, potentially contaminated with hazardous waste, drains to Kellogg Creek (without noting that Kellogg Creek drains to the Delta and the San Francisco Bay). Even the EPA reference indicates that lead can be mobilized under some soil conditions. Since there has been no geotechnical report for the Project site,the actual risk is unknown. These conditions are completely inconsistent with a finding of Less than Significant Impact. Staff Analysis:In response to this issue, the County retained Monk and Associates to review the environmental geology study prepared by Engeo Inc. They also contacted the County Health Services Department and USFWS. Briefly summarized, Monk&Associates determined that there is an unknown(but possibly significant) potential for surface waters exiting the site to carry either lead shot or lead in solution to the channel of Kellogg Creek and thereby degrade wildlife habitat. The letter of Monk & Associates (dated November 15, 2000) provides recommendations to ensure that impacts to special status species or sensitive habitats are eliminated or reduced to less-than-significant levels. These recommendations have been incorporated in the revised conditions of approval. Where runoff exits the site, install traps that will prevent lead shot from being transported off-site. At least twice during the winter rainy season, collect surface water samples from the two locations where concentrated surface water exits the site. The sampling protocols and chain-of-custody procedures shall ensure that the water quality samples are representative of surface water discharged from the site. Those samples shall be tested for lead by a certified laboratory. The water quality monitoring shall continue for five years. If after five years the tests do not show an increase in lead over the original background samples, the Zoning Administrator may determine that the testing can be ended or it can be extended for another five-year period. If at any time during the testing evidence of increased concentrations of lead are found to exist in the water quality samples, the Zoning Administrator may require: a) more intensive water quality sampling; and b) environmental engineering studies to evaluate the water quality data and advise the County and project proponent on the significance of the data gathered, determine if shot is adversely effecting water quality, and provide recommendations to protect water quality. Based on the findings of the environmental engineer, the Zoning Administrator may require preparation of a water quality management plan. The scope/approach of the plan would be based on input from the Flood Appeal (County File LP992027) .Board of Supervisors August 7, 2001 Page 7 Control District (Clean Water Program). The Water Quality Management Plan would be subject to technical review by the Clean Water Program staff prior to its approval by the Zoning Administrator. Appeal Point#4: Land Use and Planning: The Initial Study stretches the general reference to"public and private outdoor recreational facilities" as an umbrella to justify the defining the Gun Club as a consistent A-3 land use. However, recreational facilities usually do not pose significant physical threats off property. Consistent recreation uses might include things like a campground, water slides, a rock climbing facility, etc. and there would be no community objection. But this is a gun club with a real threat to life and safety for those near it. The Gun Club is not a compatible use with many existing and future planned uses in the immediate area. A local real estate. agent selling lots in the Camino Diablo area commented that: "I doubt you would want a gun club for a neighbor. The motor cycle race track on lot 39 is one thing, but it is usually a weekend place and not year- round..The Gun Club in Brentwood, however, operates daily,training police, hunter safety, and allowing recreational shooting and.competitive shooting matches..." The. presence of the Gun Club detracts from the saleability of area properties. Staff Anal: The Gun Club use is allowed by the existing Zoning District upon issuance of a land use permit. The primary issue is safety, and the Board of Supervisors must make the necessary findings to approve the project. The appellant provides their opinions on the compatibility of the proposed project with their 10+ acre lots, which like the site are zoned"Heavy Agriculture"(A-3). In response to the safety issue, the County retained a safety consultant, Kramer One. According to this study, a well-designed facility will not present a threat to life and safety. The Kramer One recommendations which are by intention conservative on the side of safety, hare been incorporated into a revised set of permit conditions. The Safety Report provides a recommended setback of the skeet and trap fields from the property line. These setbacks are designed to assure that shot will fall on the site. The pistol and rifle ranges are oriented such that the line of fire is not directed toward the appellant's properties, and the Safety Report provides design recommendation to prevent bullets or ricochets from exiting the site. The land that was sold to the Brentwood Rod and Gun Club is the site of the hillside portion of the Sand Hill Ranch Motor-Cross Park, and the area was approved for a quarry by LP962046. (Previous to the acquisition of the property by the Gun Club, the site was being used for Motor-Cross trails, and quarrying continues to proceed from west to east toward the lands now owned by the Gun Club.) Those approved uses generate noise, have a visual effect, etc. It should also be noted that the A-3 District is defined as "Heavy Appeal (County File LP992027) .Board of Supervisors August 7, 2001 Page 8 Agriculture,"not residential. Acceptable noise levels for example are more constrained in a residential district than in an agricultural use area (i.e., residential uses are considered more sensitive to noise by the Noise Element of the County General Plan). In this case the County General Plan and Zoning District designate the site and the adjacent lands to the east (and southeast) for agricultural uses. Appeal Point #5: Noise The acoustical study contains errors and has some questionable omissions. The East and West Residence test sites are likely to be the most relevant sites. For true impact assessment, measurements would be required at site boundaries and other existing and potential home sites. Even if the results of the Illingworth and Rodkin acoustical study were accepted at face value, equally valid interpretations of the measurements would result in very. different conclusions. The acoustical study does not address the proposed nighttime shooting events. The acoustical study does not address potential impacts on wildlife, domestic animals, and livestock. Staff Analysis. Illingworth and Rodkin were authorized to perform additional noise monitoring and engineering analysis to respond to the noise-related concerns raised by the appeal. This firm has performed acoustical research for many previous projects in Contra Costa County and elsewhere in the San Francisco Bay Region. They are well qualified to serve as acoustical consultants to Contra Costa County, and their analysis took into account the concerns of the property owners to the east- southeast of the Gun Club parcel. The substantive issues raised in the appeal (noise at site boundary and nighttime noise) were addressed by Illingworth&Rodkin (letter-report dated October 11, 2000). The following is intended to highlight and summarize (not supercede) information in the report of Illingworth & Rodkin. * In response to the concern about the selection of noise monitoring sites, additional noise testing was conducted at the southeast boundary of the project site. This location was selected for supplementary study because it represents the likeliest location for a possible future residence. Measurements were made on May 6, 2000. During this additional field study, motorcycles were operating at the motor-cross park. During the supplementary field testing, shotguns were fired near the proposed trap shooting area in the southeast portion of the project site and a 30-carbine rifle was tired in the proposed rifle area along the south boundary of the project site. Highest noise levels were generated by the shotguns, rifles generated noise levels 10 to 15 dBA lower than the shotgun, with maximum noise levels from about 57 to 68 dBA. These data are believed to represent the maximum worst case noise levels at a potentially sensitive property boundary. Noise levels at existing residences are lower as reported in the original Illingworth & Rodkin report (dated December 12, 1999). Appeal (County File LP992027) Board of Supervisors August 7, 2001 Page 9 Criteria for the noise assessment were discussed on pages 1 and 2 of the December report. Policy 11-2 of the County's General Plan states: `The standard for outdoor noise levels in residential areas is a DNL of 60 dB." A review of the data in Table 1 of the December 22, 1999 report shows that noise levels are projected to be below a DNL of 60 dB on the property boundary. It should be recognized that the parcels are in an agricultural district (not a residentially zoned area) and the General Plan indicates that noise levels of 70 dB are normally acceptable (see Noise Element Figure 11-6). It should also be recognized that Goal 11-C in the General Plan identifies the following measure to minimize noise impacts of proposed development projects. (1) Site Planning. Proper site planning is the first mitigation measure that should be investigated to reduce noise impacts. By taking advantage of the natural shape and terrain of a site, it often is possible to arrange the buildings and other uses in a manner that will reduce and possibly eliminate noise impact. The Gun Club has taken advantage of its site to minimize noise effects to existing/future rural residential neighbors by providing a vertical separation of its facility from parcels located to the east and southeast and by proposing construction of a berm. Future home sites are also encouraged to utilize this guideline in planning to minimize their exposure to noise from this facility and other sources. In response to the concern about nighttime shooting, the Planning Commission approval limits evening shooting to no more than 6 times per year and not more than once in a calendar month. The shoot can only extend to 9:00 PM. As such, for the purposes of the Illingworth and Rodkin noise assessment, this is considered the daytime (7:00 AM to 10:00 PM) time period. In response to the concern about the effect of noise on wildlife and domestic animals, Illingworth and Rodkin reviewed published literature. The U.S. Department of the Interior evaluated the effects of some booms on domestic animals and wildlife, which concluded that there was little known definitively about the subject. Animal species different greatly in their response to noise of various characteristics and duration. The individual animal response to a given noise event or series of events also can vary widely due to a variety of factors, including time of day and year, physical condition of the animal, physical environment (such as whether the animal is unrestrained), the experience of the individual animal, and whether or not other physical Appeal (County File LP992027) .Board of Supervisors August 7, 2001 Page 10. stressors (e.g., drought) are present. The effects of noise on the physiology on laboratory animals have been studied more thoroughly than the effects on farm animals or wildlife. These data provide some Information on the potential effects that may possibly occur. Such a correlation leads the researchers to conclude that sound levels about 90 dB are likely to affect mammals and are associated with a number of behaviors, such as retreat from the sound source, freezing (as in standing still), or a strong startle response. Sound levels below about 90 dB usually cause much less aversive behavior. Various studies were cited on the effects of noise on milk production in cows and goats. Only very high sound levels, in excess of 90-100 dB, appeared to have any effect. Several studies were conducted on the hearing ability of wild rodents. Very high jet aircraft noise levels were found to have some effect on the rodents (noise levels in excess of 105 dB). Responses of birds to high noise level events, such as some booms or low-level aircraft overflights, include flight response, startle responses, and other"noticeably alarmed" responses. Song birds were silenced 4-8 seconds prior to the arrival of an audible sonic boom but returned to normal songs with 10 seconds after the audible boom. The effects of low-level jets and some booms on nesting falcons and other raptors were gathered at aeries in Arizona. Responses to extremely frequent and nearby jet aircraft were often minimal and never associated with reproductive failure. Nesting success and site re-occupancy rates were high for all aeries. The birds observed were noticeably alarmed by the noise stimuli (92-114 dBA), but the negative responses were brief and apparently not productivity-limiting. Appeal Point#6: Public Services Contrary to the conclusions of the Initial Study, we believe the Gun Club.does represent a significant increase in fire danger to the area. This in turn would lead to an.increased Fire Protection requirement. Staff Response: The site is lacking in topsoil and has bare rock exposed overbroad areas. A letter from the East Diablo Fire Protection District (dated May 8,2000) states that during the history of the Brentwood Rod& Gun Club at its 731 Concord Avenue site there were no reported fire incidents. It is also pertinent to note that COA #25 adopted by the East County Regional Planning Commission requires a Management Plan that addresses (among other items),tire prevention measures. Furthermore, the Safety Report provides measures intended to assure that projectiles do not exit the site. Appeal (County File LP992027) Board'of Supervisors August 7, 2001 Page 11 Appeal Point#7: Recreation For Item B, note that the Gun Club itself is a recreational facility that creates a negative impact on the environment. Even the Community Development Department is requiring mitigation and yet it rates it as Less-Than-Significant instead of Less-Than-Significant with Mitigation Incorporation. Staff Response: This section of the Initial Study checklist raises the question of the effect of a proposed project on existing recreational facilities. In the case of the Brentwood Rod and Gun Club project, its approval is not expected to have an adverse impact on existing recreational facilities in the East County area. Appeal Point #8: Transportation/Traffic The description of minimal impact is at odds with the Gun Club=s representations about the number of classes, law enforcement training, and other activities at the Club. The description of the sight conditions at the entrance to the property was obviously written by someone who has never driven Camino Diablo and has no conception of the situation. Staff Response: The activities at the site are not expected to conflict with peak hour traffic. Traffic policy in the County requires a traffic study when a project generates 50 peak hour trips or more through an intersection. This threshold was not met by the project, so a traffic study was not required. With regard to traffic safety and sight distance at the entrance to the project, the conditions of approval require the applicant to document safe access to the satisfaction of the Public Works Department (see COA #56). In summary, the details of the design of the intersection are not a land use or planning issue;it is an engineering design issue. Appeal Point#9: Mandatory Findings of Significance The project clearly has the potential to impact endangered and protected species in the area and poses risks to the environment. The studies done to date are inconclusive. The studies are not complete. The Initial Study proposes deferred mitigation. This situation must be viewed as still having a potentially significant impact. Cumulative impacts occur in multiple ways and are ignored. Part of what the Initial Study argues is: There is an existing permitted quarry with one set of negative environmental impacts. Appeal (County File LP992027) Board'of Supervisors August 7, 2001 Page 12 There is an existing permitted motorcycle track with another set of negative environmental impacts. The proposal will add a gun club with a third set of negative environmental impacts. There is no cumulative impact. What the Initial Study proposes is by definition cumulative impacts. Staff Response: The biological studies performed during 1999 and 2000 followed protocols of the USFWS and CDFG, and the biologists retained by Contra Costa County(Barrett Anderson, Monk&Associates)provided copies of reports to agency biologists. The biologic studies identified some significant impacts and mitigation measures were identified to reduce the impacts to a less-than-significant level. The applicant agreed to the mitigation, and the mitigation measures were translated into the Conditions of Approval. With regard to the cumulative impacts of the project, the appellant cites the mix of land uses in the area, which include quarry operations and a motor-cross park. However, the comment does not provide evidence to establish the existence of significant cumulative impacts. Appeal Point #10: Planning Commission Hearing There was an unseemly rush to judgment throughout the proceeding. It was clear that the Commissioners and staff had not read or were not familiar with the contents of the letters that were filed against the Negative Declaration and the Land Use Permit. It was pointed out that the documents provided to the Commission contained significant errors and omissions. It was pointed out that other relevant government agencies had not been notified. However, instead of postponing action until correct and complete information was incorporated into the basis for decision and appropriate agencies notified,the Commission proceeded to approve everything. During the discussions prior to the vote, some Commissioners and the Applicant made prejudicial statements that contained factual errors and/or indicated a misunderstanding of the information in the application file and responses. Since there was no mechanism to correct this situation with the Commission, an appeal is required. Staff Response: The Planning Commission reviewed the Initial Study, Staff Report and received public testimony. Moreover, copies of all correspondence was included in the staff report supplement. Based on the data before it, the East County Regional Planning Commission approved the project with revised conditions, which responded to the testimony. Appeal (County File LP992027) Board'of Supervisors August 7, 2001 Page 13 APPEAL OF BRENTWOOD ROD & GUN CLUB Following the Planning Commission decision on the application of the Brentwood Rod & Gun Club, an appeal was filed by the Club dated March 16, 2000. This appeal requested modification/clarification of two conditions of approval. Appeal Point#1: COA #6 The. reclamation plan is subject to several interpretations as drafted. It provides that the applicant shall restore the.property"to a condition suitable for its long term land use." The Club requests that this condition be clarified to provide that the Club shall restore the site to its existing condition, since the previous owners and land uses have resulted in loss of topsoil. The importation of topsoil to meet this condition is unreasonable. Staff Response: The property is degraded and at present has no potential use for agriculture or wildlife habitat. However, it is zoned A-3 (Heavy Agriculture). The intent of the conditions that the site not be left as an eroding, highly disturbed site. The Conditions of Approval adopted by the East County Regional Planning Commission called for a landscaping plan. Upon closure of the site, staff anticipates that the landscaped areas will be preserved, that backstops, targets, asphalt, baffles and other shooting-related facilities would be removed,and that vegetation would be established on the nearly level areas of the property; and all eroding areas stabilized with vegetation. The condition of approval does not require the importation of topsoil, but bare rock tends to be rather sterile and will not support dense plant growth. The Club will likely require soil amendments to provide the proper conditions for plant growth. One suggestion for the Club is that topsoil and overburden material be salvaged during grading to establish the Gun Club use, and the material used in final reclamation. For example, the berm shown by the Gun Club between the caretaker residence and the skeet and trap field could be made up of soil and overburden. During final reclamation that material could be spread across the level, barren areas of the site (e.g., skeet and trap shooting areas, parking areas, rifle range, etc.) to facilitate revegetation. Appeal Point #2: COA #25 The staff recommendation called for fire a sprinkler system of both the new club house and the existing caretaker residence. Since the County codes do not require the retrofitting of a pre-existing structure, the.Club.requests that the sprinkler system requirement with respect to the caretaker residence be deleted. Staff Response: The Condition of Approval was based on a recommendation from the Fire Protection District. The intent of this condition was to bring the existing dwelling on the site up to the standards of the current provision of the codes and other regulations enforced by the Fire Protection District. The existing dwelling on Appeal (County File LP992027) Board'of Supervisors August 7, 2001 Page 14 the property has old wiring and other construction materials that may not comply with the fire code. The sprinklers are intended to suppress a structural fire before it gets out of control. In the case of the Gun Club property, there are no hydrants and no fire station in the vicinity of the site. Given these circumstances the requirement for a sprinkler system is warranted. Resolution No. 15- 2001 LAND USE PERMIT LP992027 BRENTWOOD ROD & GUN CLUB (Applicant and Owner) BYRON AREA WHEREAS, a request was filed by the Brentwood Rod and Gun club (applicant and owner) for approval of a land use permit to allow gun club, caretakers residence and including removal of 14 trees; and WHEREAS, a Notice of Intent to Adopt a Negative Declaration of Environmental Significance was posted on February 2, 2000 with the comment period extending to 5PM on March 6, 2000: and WHEREAS, after notice was lawfully given; a public hearing was scheduled before the East County Regional Planning Commission on March 6, 2000 where all persons interested might appear and be heard; and WHEREAS, the Contra Costa County Community Development staff recommended on March 6, 2000 that the East County Regional Planning Commission: • Adopt a motion certifying that the Planning Commission reviewed and accepted the contents of the Initial Study and Mitigated Negative Declaration in rendering its decision as it relates to the Brentwood Rod and Gun club project. • Adopt the Mitigation Monitoring Program. • Approve the land use permit subject to Conditions of Approval. WHEREAS, the East County Regional Planning Commission having fully reviewed, considered and evaluated all the testimony and evidence submitted in this matter; and NOW, THEREFORE, BE IT RESOLVED, that the East county regional Planning Commission approves the land use permit with minor modifications to the recommended conditions of approval. Silvano Marchesi, County Counsel was also present. After discussion by the Board, the Chair then invited the attorney's for both appellants to present testimony. David Trotter spoke on behalf of the Silver Hills and Camino Diablo Homeowners Association. Mr. Alan Wilhemy, Attorney for the Brentwood Rod and Gun Club advised that after receiving the staff report, based on the information on that report, the Brentwood Rod and Gun Club has withdrawn their appeal. While I was able to take a small amount of time off from my job as a software engineer to speak to the board on this issue,the rescheduling of the hearing increased the burden of time to the point where I was forced to instead submit written comments in support of their application. I have learned from those who attended that my comments were erroneously construed as being in opposition to the gun club relocation. This letter serves to correct that misinterpretation. I am currently a certified instructor in rifle marksmanship,pistol marksmanship,personal protection,and home firearms safety. I have also completed training for service as a reserve police officer in this state (PC 832 and POST Level III). Over the years 1 have spent between$10,000 and$15,000 on my firearms safety education,as well as hundreds of hours obtaining that training and passing those skills on to others. I say this not to brag,but to point out that I take firearms safety very seriously and have committed significant personal resources in its pursuit. It would be interesting to discover how many of those who oppose the relocation of the Brentwood firing range could claim a comparable personal commitment on the issue. Rifle and pistol ranges are,to put it simply,where firearms safety happens. They are the places where classes are held to instruct people in the safe ownership,use,and storage of firearms,and where those lessons are put to practical use and any problems corrected in a safe environment. They are where firearms and ammunition are tested to insure their operation and accuracy. They are where skills are honed through repetition and competition. This system of voluntary training and practice has served our national community well—while gun ownership rates are increasing,firearm accident rates today are at their lowest point ever recorded,and all without the expenditure of a penny of taxpayers' funding. Yesterday morning was not the first time I had attended a session of the Board of Supervisors. In previous sessions I had heard supervisors express their deep concern for firearm safety and the adequate training of gun owners. But actions speak louder than words. A decision to deny the Brentwood Gun Club their permit to relocate would remove safety training facilities from this county and would be incompatible with the Board's professed interest in firearm safety. From the Board's vote,the residents of Contra Costa will know the supervisors'true priorities. 1 request that the misreading of my previous comments be removed from the record and this letter read into the record in its place.
