SUBJECT: Fire Facilities Fees within the Oakley Fire Protection
District
Supervisor Torlakson requested that the Board rescind its
January 25 , 1983 order which directs the Planning Department to
require a maximum of $300 per unit on all subdivision applications
within the Oakley Fire Protection District .
As recommended by Supervisor Torlakson , the Board hereby
RESCINDS its aforesaid January 25 , 1983 order, and superseding that
order, r.ereby CLARIFIES its intent in relationship to fire facility
fees as follows :
The Board believes the following approach is appro-
priate and necessary to help mitigate the need for
additional fire facilities in the Oakley area :
The Planning Department is directed to work with
applicants to reach agreement to map conditions
language as follows :
In relationship to a fire facilities "fair and
appropriate share ," this would be collectible
no later than at the building permit stage for
any permits taken out after adoption of the fire
facilities master plan—l'nr any permits taken
out prior to the adoption of a final policy and/or
fees in the master pian, the "fair and appropriate
share" would apply to those residential lots
retroactively and be payable when needed in the
Oakley Fire district .
Supervisor Torlakson noted that this is a reasonable
approach and is also fair and consistent with the conditions on
other tentative maps previously approved in the Oakley area for
fire facilities . Several maps have been approved, some before
and some after January 2.5 , 1983, with language committing those
maps to pay "up to a maximum ceiling of $300 per lot" dependent
on the outcome of the fire facilities master plan. The present
action simply clarifies a similar objective for maps to be approved
between this date and the adoption of the fire facilities master
plan.

A briefing session before the Board having been scheduled for
this time--on anticipated increases in residential telephone rates as
a result of divestiture by American Telephone and Teleoranh of its
subsidiaries, the Board.. determined not to consider the matter in view
of the absence of Supervisors Powers and McPeak.
