Dear Madam and Messieurs: I have a problem; I have a pr rithout the involvement of any of you good On May 22, 20011 appeared ; several major problems accomplished. On this same day I spoke with Mr. Maurice M. Shiu—Director of Public Works who would not help me. From May to June, I left several messages with Mr. Shiu and he never returned any of my calls to resolve these unnecessary problems. I own a property located at 1451 Drake Way situated in CCC hill area. Only my property in substantially being burned by the following: 1. Water from Alpine Rd. 2. Water from upper property owners 3. Rocks of asphalt from the huge pot holes in the street 4. Dirt from underneath the holes in the street 5. Weekly Garbage trucks, Waste Water trucks, and Cars sliding from the decaying street towards my property continuing to the damaged street further burdening my property, the weight pushing on my property 6. Persons sliding and fallings on the actual street from the decaying UN maintained street, because of asphalt that's turned into rocks and the exposed dirt which water has penetrated and pushing towards my properties retaining wall In May 1 had a county inspection for my property, because I pulled permits to repair the dryrot at the garage and retaining wall cracks. The inspector informed me that the street needed to be repaired so mainly the (water), and the rocks and dirt that's causing vehicles and people to slide would be prevented. Thereafter I would not be burned by dryrot from rainwater and cracks in my retaining wall, because once the street is maintained and drains installed, this would cease the water damage to my property and diverted away. There are absolutely no drains in this entire street to collect any water with a sewer outlet, to divert water away from property. I have the biggest lot on the street, and when it rains I have to use sandbags in front of my garage. The entire lower portion of the garage is completely dryroted from water and carport retaining wall badly cracked. My problem is not repairing the damage to my property it is the UN maintained street and without drains to collect alpine roads water, that is causing the water diversion and sliding towards my property and will continue after I repair my property, and if nothing is done about the major overhaul needed for the street. Drake Way in 40ty Feet wide. I spoke to Mr. Maurice M. Shiu about repairing the street and putting drains in the street to collect water. He stated this is a"Private Street." I've had the street inspected, along with—Topographic Maps, Sever& Drainage maps, Assessor's maps, EBMUD maps, and Wastewater maps, and County Recorded information including Deeds which show, not only do I not own the street, that no property owner on Drake Way owns this street. It is not disclosed on any deeds of the homeowners, that any of us might, now or have ever had to maintain the street, because we owned it. Addition the homeowners do not have the extra 20ty feet added to our lots proving ownership, and engineers have determined that Drake Way is not a"Private Street," and has always been a Public Street, even when the County Did not Except it in 1911.to maintain when offered, according to the map of Jennings East Richmond Terrace Contra Costa Co., Cal. I do not know if Drake Way is in a Special Improvement District, and engineer's have determined after inspecting adjacent streets, and maps etc. also connected to Alpine Rd; that they all are maintained by the County Public Works, because they are too "Public Streets." There is absolutely no reason for my property to continually receive water, asphalt rocks, dirt, sliding trucks weighing tons on the street because of this Public Works avoidance nuisance, that is costing me money, when I don't own the street because my property is the retaining wall for the UN maintained street. I'm writing to get results and for this Board of Directors to make Mr. Maurice M. Shiu do his job. I own several properties in CCC and Alameda County and never would have bought this property on Drake Way if the street was owned by the homeowners, which it is in fact not! The property owners on this street don't maintain their homes, let alone have extra thousands of dollars to maintain a Public Street. Enclosed is a complete copy of every property owners Deed recorded in the County Recorders office to prove, the property owners do not own the street Drake Way, and the 20 extra feet in not on any homeowners Deed. The facts are simply this, in 1911 the County was offered Drake Way as a County maintained Street, the same Public Works have not maintained Drake Way. The dedicated Map of East Jennings Terrace filed and offered in 1911 to the county shows this street to be for"Public use" the facts are, the public actually uses it, the homeowners do not have deeds which reflect any ownership in the 40`y foot wide street. My concerns are: Public safety, pedestrians and bicyclists Fire danger Erosion of native oak trees Public safety—On May 20`h a 13 year old boy was hit by a car while riding his bike The southbound lane is a total of 11 feet wide. PEOPLE RIDING THEIR BIKES MUST RIDE AGAINST CAR TRAFFIC WITHIN THE 11 FEET. The Northbound lane is 12 feet wide and total of 14 feet to the guardrail. People are walking behind the guardrail to get out of traffic. The bike riders must ride within the 11 feet with the traffic. The road is curved and graded so that pedestrians, bikers and cars do not have a clear sight. Fire—On December 30, 1999 there was a fire, response #099006497 There is continual fire danger with the dry brush. Soon the leaves from the native oak trees will add to the dry brush causing the flammable material. Erosion—Native oak trees that are 200-300 years old have exposed roots and are leaning. While this is common on the banks of a creek, these trees are on the shoulder of the road not at the creek bed. The dirt is visibly darker with more moisture content opposite the driveway. The rate of erosion has increased from runoff of rain and irrigation from homes built on lots that are approximately 65 degree angle adjacent to this road. This 1700 foot section of Green Valley Road has no improvements. These conditions will not improve unless the county takes some action. The County has a 60 foot right of way. I am asking the County to make the necessary improvements to protect the public, minimize fire danger and preserve our environment.
