Resolution of Termination of Offer of Dedication
(S. & H. Code § 8330 et. Seq.)
SUBJECT: ADOPT Resolution No. 2001/ 355to terminate a portion of an Offer of
Dedication of a Roadway Easement at the corner of Arbol Via and La Casa
Via, Parcel "A" of Minor Subdivision 97- 69, 16 PM 5 in the unincorporated
area of Walnut Creek and determine that the activity is not subject to the
California Environmental Quality Act, pursuant to Article 5, Section 15061
(b)(3), Walnut Creek area [CDD-CP# 01-26] (Applicant, John & Pam
Wilkinson) Project No. 0676-6Q1862.
The Board of Supervisors of Contra Costa County RESOLVES THAT:
This Termination of a portion of an Offer of Dedication of Parcel "A" of Minor
Subdivision 97-69, 16 PM 5 of a certain excess right of way not required for road purposes,
is made pursuant to Government Code Section 66477.2 (c) and to Division 9, Part 3,
Chapter 4 of the Streets and Highways Code, commencing with Section 8330, et. seq. A
description of the offered area to be terminated is attached hereto as Exhibit"A"and
incorporated herein by reference located in the unincorporated are of Walnut Creek.
This termination of a portion of an offer of dedication is for an excess right-of-way of
a street or highway not required for street or highway purposes. (S. & H. Code Section
8334).

Subject: Terminate a portion of an Offer of Dedication.

Considering all facts before it, this Board FINDS there is no reasonable probability
that the County will accept the offered roadway into the County road system,that no public
money has been expended for maintenance of the offered roadway, and that it is in the
best interests of the County and the public that the offered area be privately owned and
maintained.
This Board hereby FINDS that the proposed termination will not have a significant
effect on the environment, and that it has been determined to be exempt from the
California Environmental Quality Act under State CEQA guidelines Section 15061 (b)(3).
This Board DIRECTS the Director of Community Development to file a Notice of Exemption
with the County Clerk, and DIRECTS the Public Works Director to arrange for payment of
the $25.00 fee to the County Clerk for filing and a $25.00 fee to Community Development
for processing of the Notice of Exemption. This Board having considered the general plan
FINDS that in accordance with its Resolution No. 81/522,this termination is minor in nature
and is therefore exempt from general plan conformance review.
This Board hereby TERMINATES the hereinabove described portion of the offer of
dedication and ABANDONS the right of the County to accept said offer. The Board is not
aware of any existing in place utilities in the subject area.
The Real Property Division is ORDERED to.,record a certified copy of this Resolution
in the office of the County Recorder.
From and after the date this resolution is recorded, the offer of dedication is
terminated and the County's right to accept offer is abandoned.

Being a portion of the Rancho San Miguel, Contra Costa County, California described as
follows:
Commencing at the most easterly corner of Parcel A as shown on subdivision MS 97-69
filed March 30, 1971 in Book 16 of Parcel Maps at page 5 records of said County; thence
along the southeasterly property line of said Parcel A south 420 58' 31" west 166.00 feet
to a point on the "50' R/W(790 OR 148)" as shown on said map (16 PM 5) being the Point
of Beginning; thence from said Point of Beginning northwesterly along a non-target curve,
concave to the northeast, having a radius of 1775.00 feet, a radial to said point on curve
bears north 420 58' 31" east, through a central angle of 4° 14' 56" an arc distance of
131.63 feet; thence north 510 16' 25' west 119.78 feet; thence northeasterly along a
tangent curve, concave to the east, having a radius of 30.00 feet through a central angle
of 1430 30' 45", an arc distance of 75.14 feet to a point on a reverse curve; thence
northeasterly along said curve, concave to the north, having a radius of 535.00 feet
through a central angle of 23° 57' 45", an arc distance of 223.75 feet; thence leaving said
" 50' R/W (790 O.R.148)" non-tangent to said curve south 271 16' 17" east 3.02 feet;
thence southwesterly along a non-tangent curve, concave to the north, having a radius of
538.00 feet, a radial to said point on curve bears south 210 45' 16" east, through a central
angle of 16° 18' 34" an arc distance of 153.14 feet to a point on a reverse curve; thence
southwesterly along said curve, concave to the south, having a radius of 172.00 feet,
through a central angle of 2611 37' 26", an arc distance of 79.92 feet to a point on a
compound curve; thence southerly along said curve, concave to be east, having a radius
of 20.00 feet, through a central angle of 109° 12' 17" an arc distance of 38.12 feet; thence
south 511 16' 25" east 104.56 feet to a tangent curve; thence southeasterly along said
curve, concave to the south, having a radius of 1780.00 feet, through a central angle of 40
14' 56" an arc distance of 132.00 feet; thence south 420 58' 31" west 5.00 feet to the Point

(approximately 28 feet wide by 233 feet long), south of Arbol Via; and along the southwest
side of APN#140-210-010 (approximately 30 feet wide by 237 feet long), northeast of La
Casa Via.
Contra Costa County (County) has determined that the portions of the offer of dedication
are no longer needed for road purposed and can be terminated.
LOCATION:
The subject property is located in the unincorporated portion of Walnut Creek, in the central county
area (Figures 1 — 3).
