SUBJECT: ADOPT Resolution No.2001/ to summarily vacate an excess portion of Siino Avenue and
determine that the activity is not subject to the California Environmental Quality Act
(CEQA) pursuant to Article 5, Section 15061 (b)(3), Bay Point area [CDD-CP# 00-104]
(Applicant, David M. King) Project No. 0676-6Q1861.
The Board of Supervisors of Contra Costa County RESOLVES THAT:
This summary vacation of an excess right of way of a street or highway no longer required for street
or highway purposes, is made pursuant to Division 9, Part 3, Chapter 4 of the Streets and Highways Code,
commencing with Section 8330, et. sect. A description of the portion to be vacated is described in Exhibit
"A" and shown as Exhibit "B" attached hereto.
This vacation request is for an excess right of way for a street or highway not required for street or
highway purposes. (S. & H. Code Section 8334).

This Board hereby FINDS that the proposed vacation will not have a significant effect on
the environment, and that it has been determined to be exempt from the California Environmental
Quality Act under State CEQA Guidelines Section 15061(b)(3) and DIRECTS the Director of
Community Development to file a Notice of Exemption with the County Clerk and DIRECTS the
Public Works Director to arrange for payment of the $25.00 handling fee to the County Clerk for
filing and $25.00 fee to Community Development for processing of the Notice of Exemption. This
Board having considered the general plan FINDS pursuant to Government Code Section 65402
that in accordance with its Resolution No. 81/522,this vacation is minor in nature and is therefore
exempt from general plan conformance review.
This Board declares that the hereinabove described proposed vacation area is HEREBY
ORDERED VACATED subject to any reservation and exception described in attached Exhibit
"A". From and after the date this Resolution is recorded,the portion vacated no longer constitutes
a public highway.
The Real Property Division is ORDERED to record a certified copy of this Resolution in the
office of the County Recorder.

A portion of the S.E. 1/4 of Sec. 11 T2N R1W Mount Diablo Meridian being a portion of "Bella
Monte Subdivision No. 2" filed April 2, 1929 in Book 21 of Maps at page 584 Contra Costa
County, California, described as follows:
Being all of Siino West Avenue (formerly Siino Avenue per 21 M 584) lying easterly of the
southerly prolongation of the easterly right of way line of Crivello Avenue as shown on said
subdivision map.
RESERVING THEREFROM: Pursuant to the provisions of Section 8340 of the Streets and
Highways Code, the easement and right at any time, or from time to time, to construct, enlarge,
maintain, operate, replace, remove, and renew those existing and in place utilities, as of the date
of recording this instrument, in, upon, over and across any highway or part thereof proposed to be
vacated, including access to protect the property from all hazards in, upon, and over the area
herein before described to be vacated.
This real property description has been prepared by me or under my direction, in conformance
with the Professional Land Surveyors Act.

This activity is not subject to the California Environmental Quality Act (CEQA)

It can be seen with certainty that there is no possibility that the activity may have a
significant adverse effect on the environment.
DESCRIPTION OF THE ACTIVITY:
The activity consists of the vacation of a portion of the existing excess right of way
(approximately 50' X 107') north of parcel number 096-013-005 and south of parcel
number 096-012-001, and quitclaim it to two adjacent property owners. The portion of
excess right of wayis`vacant. Originally, the right of way was to be used to extend Siino
West Avenue, but due to new development, the road will not be extended. Therefore,
Contra Costa County no longer needs the easement for road purposes and wishes to
terminate it.
If a lot line adjustment is requested, it will be subject to review and approval by Contra
Costa County Redevelopment to ensure future lot lines do not negatively impact property
owners adjacent to the vacated property.
LOCATION:
The activity is located at the east end of Siino West Avenue (formerly Siino Avenue) at
Crivello Avenue in east county, in the Bay Point area. (Figures 1 — 3).
