SUBJECT: LICENSE AGREEMENT FOR THE COMMUNITY SERVICES-HEAD START PROGRAM
4951 MAIN STREET, OAKLEY
SPECIFIC REQUESTS OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. RECOMMENDATION
APPROVE a License Agreement, commencing September 1, 2001, with Oakley Union
Elementary School District for the premises at 4951 Main Street, Oakley, for continued
occupancy by the Community Services-Gehringer Head Start Program, under the terms and
conditions more particularly set forth in said License Agreement, and AUTHORIZE the Director
of General Services to EXECUTE said License on behalf of the County.
II. FINANCIAL IMPACT
Payments required are to come from the budget of the Community Services Department.
III. REASONS FOR RECOMMENDATION / BACKGROUND
Contra Costa County has been using 4951 Main Street, Oakley as a Head Start facility since
December 1995. The facility and program provides for childcare development, day care
programs, classroom and play area, as requested by the Community Services Department.
IV. CONSEQUENCES OF NEGATIVE ACTION
Should the Board of Supervisors elect not to authorize the Director of General Services to enter
into a one year License Agreement, the on-going program would no longer function and this
would be a detriment to the community of Oakley.

License Agreement
Gehringer Elementary School, 4951 Main Street, Oakley
This agreement is effective �� , by and between., OAKLEY UNION ELEMENTARY SCHOOL
DISTRICT, hereinafter called "LICENSOR" and the COUN'T'Y OF CONTRA COSTA hereinafter called
"COUNTY". LICENSOR is the owner of the Gehringer Elementary School, 4951 Main Street, Oakley, California.
COUNTY desires to obtain LICENSOR'S permission for operation of a Head Start program in a modular building
owned by the County and situated on land provided by the LICENSOR, and LICENSOR is willing to permit such
use upon the terms and conditions contained herein. This License is granted pursuant to the provision of the Civic
Center Act at Title 2, Division 3, Part 23, Chapter 4, Article 2 Q38130 et seq) of the Education Code regarding.the
operation of a child care program. Now, therefore the parties agree as follows:
1. Grant of License. Subject to the terms and conditions of this Agreement, LICENSOR hereby grants to
COUNTY an exclusive License to use a portion of land of approximately 4,000 square feet, located on the
Gelu-inger Elementary School, 4951 Main Street, Oakley, California, together with rights of ingress and egress.
2. Term. The term of this-lease shall be for twelve (12) months, beginning on the first day of September, 2001
and ending on the last day of August, 2002.
3. Renewal. The Lease will be automatically renewed on a yearly basis for a period of five (5) years,
commencing on September 1, 2002, and each September first thereafter unless terminated by either party, as
provided in paragraph seven (7) below.
4. Fee. As consideration for this Agreement, COUNTY agrees to pay, commencing September 1, 2001, a monthly
fee of One Hundred and NO/100 Dollars ($100.00), payable in advance on the tenth of each month during the term
of this License. Payments shall be mailed to:

5. Hold Harmless. COUNTY shall defend, indemnify, save, and keep harmless LICENSOR against all liabilities,
judgements, costs, and expenses which may in any way accrue against LICENSOR in consequence of granting of
this License, save and except claims or litigation arising from the sole negligence or sole willful misconduct of
LICENSOR.
6. Maintenance. All maintenance of the modular building will be the responsibility of the COUNTY. COUNTY
shall not suffer any waste on or to the premises subject to this License.
7. Termination. Either party may terminate this Agreement by giving the other party thirty-(30) day's advance
written notice.
8. Entire Agreement. This instrument contains the entire agreement between the parties relating to the rights
herein granted and the obligations herein assumed. No alteration or variation of this Agreement shall be valid or
binding unless made in writing and signed by the parties hereto.
