Gray and Company, as General Manager of the Canyon Lakes Geologic Hazard Abatement District (CHAD), to execute a contract amendment between Canyon Lakes GHAD and Sands Construction Company, Inc. increasing the contract payment limit by $2,000 to a new payment limit of $42,000 for construction and maintenance supervision duties for the contract effective July 1, 1999 through June 30, 2001, Danville Area. (WO #5148) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION I. Recommended Action: APPROVE and AUTHORIZE William R. Gray and Company, as General Manager of the Canyon Lakes Geologic Hazard Abatement District (GHAD), to execute an amendment to the Consulting Services Agreement between the Canyon Lakes GHAD and Sands Construction Company, Inc. for additional work relating to contract administration services for the Canyon Lakes GHAD. (WO #5148) DATE: July 24, 2001 PAGE: 2 II. Financiallmpact: There is no impact on the County General Fund. The Canyon Lakes GHAD.is funded through special . assessments on properties within the boundaries of the Canyon Lakes CHAD. The Canyon Lakes GHAD will fund 100% of this contract. III. Reasons for Recommendation.and Background: The Canyon Lakes GHAD was formed in 1985 and is located in the San Ramon area. Mike Sands, President of Sands Construction Company, Inc., has been serving as the Construction and Maintenance Superintendent for the Canyon Lakes GHAD for approximately ten years. Sands Construction Company has extensive experience in responding to and assisting the GHAD with the repair of landslides and landslide related work in.Canyon Lakes and the surrounding area. On August 17, 1999, the Board of Directors of-the GHAD approved a contract for Sands Construction Company, Inc. to provide on-call Construction and Maintenance Supervision during Fiscal year 1999/00. At the end of June 2000 (the end of the 1999/00 Fiscal Year), over half of Sands' Construction Company budget remained unspent. In lieu of terminating Sands Construction Company's contract at the end of the 1999/00 Fiscal Year and renegotiating a new contract for the 2000/01 Fiscal Year, with the Board's approval the General Manager amended the FY 1999/00 contract and extended it's term through the end of the 2000/01 Fiscal Year. It was understood at the time that subsequent contract amendments might be required to increase the contract payment limit. The contract was ultimately amended to its current limit of$40,000.00, which was approved by the Board of Directors of the GHAD on April 24, 2001. Most recently, Sands Construction Company has been overseeing the GHAD's preventative maintenance program and has been negotiating with the contractor hired to complete this program. Due to unforeseen circumstances, Sands Construction Company has exceeded their current budget by $2,000.00. William R. Gray and Company, as General Manager of the GHAD, is recommending that the contract payment limit be raised from $40,000.00 to $42,000.00 to cover these unanticipated expenses. IV. Consequences of Negative Action: Without Board approval, the GHAD will not be able to effectively oversee the preventative maintenance program during the remainder of this fiscal year. AMENDMENT TO CONTRACT This Contract amendment is effective July 24, 2001,between the Canyon Lakes Geologic Hazard Abatement District(Public Agency), an agency fonned under Section 26500 of the Public Resource Code and Sands Construction Company, Inc..(Contractor), a company doing business at P.O. Box 1125,Lafayette, California 94549. WHEREAS,Public Agency and Contractor previously entered into a contract dated July 1, 1999,which Contract was authorized by the General Manager; WHEREAS,said contract was previously amended on May 23, 2000 to extend the contract . expiration date to June 30, 2001 and increase the contract payment limits from$25,000.00 to $30,000.00; WHEREAS,said contract was also amended on April 24,2001 to increase the contract payment limits from$30,000.00 to$40,000.00; THEREFORE,Public Agency and Contractor mutually agree to amend said contract to extend the contract payment limits from$40,00.00 to $42,000.00. In all other respects,the contract dated July 1, 1999 shall remain in full force and effect.
