RECOMMENDATION APPROVE the first amendment to the License for parking spaces with Luis Mario Preciado and Beatriz Preciado, dba Margarita's Restaurant, to extend the term for continued occupancy of 535 Ward Street, Martinez, by the Clerk-Recorder, and to add additional parking spaces, under the terms and conditions more particularly set forth in said License amendment, and AUTHORIZE the Director of General Services to EXECUTE said License amendment on behalf of the County. II. FINANCIAL IMPACT Payments required are to come from the budget of the Clerk-Recorder Department. III. REASONS FOR RECOMMENDATION / BACKGROUND To provide for additional parking spaces and to extend the term for continued use of parking spaces, as requested by the Clerk-Recorder Department. PARTIES: Effective on I $ 2= ,CONTRA COSTA COUNTY, a political subdivision of the State of California, hereinafter called "COUNTY," and LUIS MARIO PRECIADO AND $EATRIZ PRECIADO, doing business as Margarita's Restaurant, hereinafter called "LICENSOR," mutually agree and promise as follows: 2. PURPOSE: The parties desire to amend that agreement dated June 17, 1997, between LICENSOR and COUNTY, consisting of an exclusive License to use eight (8) parking spaces, in what is commonly known as 535 Ward Street, Martinez, California. Said License is to be amended commencing February 16, 2000 as described below: • To add five (5) parking spaces, increasing the total to thirteen (13) spaces. • To exercise the final option to extend this License until May 31, 2001. • To adjust the fee to $375.00 per month to pay for additional maintenance and additional parking spaces. • To allow the use of water from the adjacent County Leased building at 524 Main Street for maintaining the landscaping. 3. AMENDMENTS: Said License is hereby amended as follows: A. Amend Section 1. Grant of License: to add the following: Commencing February 16, 2000, LICENSOR hereby grants to COUNTY an exclusive License to post and use thirteen (13) parking spaces together with rights of ingress and egress in said parking lot, as shown on Exhibit "B", attached hereto and made a part hereof. B. Delete Sections 2. Term: and 3. Extensions: in their entirety and replace them with the following: 2. Term. The term of this Agreement shall commence June 1, 1997 and end May 31, 2001. C. Amend Section 4. Fee: to add the following: Commencing March 1, 2000, COUNTY agrees to pay a monthly fee of THREE HUNDRED SEVENTY" FINE AND NO/100 DOLLARS ($375.00). It is understood and agreed that the fee for the period of February 1, 2000 to February 29, 2000 is TWO 11UNDRED EIGHTY SEVEN AND 501100 DOLLARS (287.50). G+. D. Amend Section 6. Maintenance: to add the following: Commencing February 16, 2000, LICENSOR shall perform bi-monthly maintenance and litter cleanup. E. Add Section 12. Shared Water Usage: as follows: 12. Snared ''Water Usage: LICENSOR is permitted to use the water from 524 Main Street, without charge, during the term of the COUNTY lease for said building, to maintain the landscaping of 535 Ward Street during this License. 4. EFFECT: Except for the amendments agreed to herein, the License of June 17, 1997 remains in full force and effect.
