RECOMWNDATIONS:
After hearing the appeal, it is recommended to deny the appeal and affirm the
determinations of the County Abatement Officer and direct the County Abatement
Officer to proceed and perform the work of abatement.
FISCAL IMPACT:
$7, 500, if the County does the abatement.
BACKGROUND/REASONS FOR RECO NDATIONS:
On March 28, 1997, a complaint was received regarding the placement of a mobile
home on the above property without necessary approvals and permits, and that
junkyard conditions existed. Upon further investigation, it was found that the
mobile home was inhabited, and the property was littered with several abandoned
vehicles and a pile of discarded tires. The property was posted on December 10,
1997. A second complaint was received on January 9, 1999 regarding the same
violations. A Notice to Comply letter was sent to the owner on March 10, 1999.
A Notice of Violation was recorded against the property on April 26, 1999. The
property was again posted on July 22, 1999 with a Notice to Comply letter sent on
May 24, 1999. A site inspection on July 14, 2000 to post the property revealed
the following violations of the County ordinance:
Title 7,Chapter 74-+3. 3.01 (Permits required for construction)
Title 8, Chapter 82-2.006 (Maintaining an illegal junkyard & installation of a
mobile home)
The owner of the property has been notified of the violation(s) through written
correspondence and certified mail. As of this date, compliance has not been
gained.
On July 14, 2000, the Building Inspection Department declared the property a
public nuisance and posted a Notice Order to Abate under Title 1, Chapter 14-6.
This appeal is being made under the provisions of this title.

Dear Martinez Family.
In accordance with Contra Costa County Ordinance Code Section 14-6.410 (public
nuisance), you are hereby notified that Tuesday, September 12, 2400, at 1:00 p.m. is
the date and time set for the hearing of your appeal from the decision of the County
Abatement Officer declaring the unsecured mobile home being stored invites illegal
activities, along with a large tank,junk, tires, and a person living in the camper,
creates a nuisance, in violation of Sections U.H.C. 100 1.4, U.H.C. '1001.11, CCC
Ordinances 82-2.006, and 88-4.204 of the Contra Costa County Ordinance Code, and
declaring said violations a public nuisance on property located at 161-165 Delta Road,
Brentwood. The hearing will be held in the Board of Supervisor's Chambers, Room
107, 651 Pine Street, (the Administration Building), Martinez, CA.
The hearing will be conducted in accordance with procedures set forth in Contra Costa
County Ordinance Code Section 14-6.410. A copy of the Uniform Public Nuisance
Abatement Procedure is enclosed for your reference.
If you challenge this matter in Court, you may be limited to raising only those issues
you or someone else raised at the public hearing described in this notice, or in written
correspondence delivered to the County at, or prior to, the public hearing.
