Westman, County Counsel County DATE: September 12, 2000 SUBJECT: AUTHORIZE ADDITIONAL PURCHASING AGENT DISCRETION TO ASSIST COUNTY DEPARTMENTS WITH PURCHASING SERVICES. 1. Recommended Action: Introduce an Ordinance providing the purchasing agent (at his discretion) with specified services authority to engage or assist with the obtaining of services when requested by an involved county office or department. II. Reasons for Recommendations and Background: The County Ordinance Code (§ 1108- 2.214) currently provides pursuant to various state laws, statutes, or regulations that various county offices or departments may purchase certain specified services without involving or utilizing the purchasing agent's services. Presently, some of the purchasing agent exempt services are acquired by utilizing the services of the purchasing agent. This ordinance would clarify that the purchasing agent, at his discretion, may, when requested by the involved office or department, engage or assist with the provision of any of the specified exempt services. Section 1108-2.214 of the County Ordinance Code is amended to read: 1108-2.214 independent Contractors. (a) General. He shall engage contractors to perform services for the county and its offices, with or without the furnishing of material, where the aggregate cost does not exceed the amount authorized in Government Code Section 25502.5 from time to time. (b) Exceptions. This section does not apply to: (1)Printing legal briefs or legal notices; (2)Phonographic reporters services or transcripts; (3) Special expert services for the county counsel's, district attorney's,public defender's, or sheriff's offices; (4) Election supplies; (5) Consultants and other experts employed directly by the board; (6) Other services which by law some other officer or body is specifically charged with obtaining; (7) Road equipment rent pursuant to Section 1108-2.208; and (8) Contracts he lets pursuant to Public Contract Code Section 20394. (c) Discretion. The purchasing agent, at his discretion, may engage or assist with obtaining the services listed in subsection(b) when requested by the involved county office or department. Westman, County Counsel County DATE: September 12, 2000 SUBJECT: AUTHORIZING ADDITIONAL MERIT BOARD MEETINGS TO FULLY EXERCISE CONSENT DECREE JURISDICTION. 1. Recommended Action: Introduce Ordinance authorizing additional Merit Board Meetings, waive reading and fix September 19, 2000 for adoption so that the Merit Board will have the ability in a timely matter to address, review and take action on matters referred to it under the Consent Decree pursuant to the jurisdiction provided the Merit Board by Resolution No. 2000/385. II. Financial Impact: If this authorization is fully executed and all twelve additional special meetings held, it could result in nine hundred dollars of additional cost. Ill. Reasons for Recommendations and Background: Recently the Board of Supervisors adopted Resolution No. 2000/385 giving jurisdiction to the Merit Board to hear and make determinations under the Consent Decree in Croskey v. County of Contra Costa, USDC NO. C-73-0906SAW, on all matters previously referable under that decree to the former County Civil Service Commission. At this time it appears that the Merit Board maybe required to schedule additional special meetings (in addition to the regular meetings already required to address its existing Merit System duties) in order to comply with the various fixed time limits required by the Consent Decree for hearings and determinations by it. IV. Consequences of Negative Action: Without the ability to schedule additional special meetings, the Merit Board may not be able in a timely manner to hear, review and make determinations concerning matters as required by the Consent Decree. Should this occur, the County could be subject to judicial review and sanction. Section 33-7.503 of the County Ordinance Code is amended to read: 33-7.503 Merit board compensation. (a)Regular Meeting Stipends. Each merit board member shall be paid for such services seventy-five dollars per regular meeting, but not more than twenty-four regular meetings (eighteen hundred dollars)per calendar year. (b) Special Meeting Stipends. In addition, each merit board member shall be paid for such services seventy-five dollars per special meeting called and conducted,but not more than twelve such special meetings(nine hundred dollars)per calendar year to hear and make determinations under the Consent Decree (Croskey v. Co=of Contra Costa,USDC No. 0-73- 1967 SAW)pursuant to Resolution No. 2000-385 or other matters within its jurisdiction. (c)Expenses. Each merit board member shall also be reimbursed for mileage and other expenses actually, reasonably and necessarily incurred in the discharge of such duties, as provided by resolution of the board of supervisors.
