AUTHORIZE the Chief Engineer to arrange for payment of a $25 fee to Community Development for
processing, and a$25 fee to the County Clerk for filing the Notice of Exemption.
II. FINANCIAL IMPACT:
The estimated project cost is $45,000, funded by 100%Zone 3b
III. REASONS FOR RECOMMENDATION/BACKGROUND:
The project includes the repair of an eroded streambank area with vegetated riprap.
It is needed in order to stabilize the streambank.
The project is exempt from CEQA because it consists of repairing an existing flood control facility. The
project was found to be in conformance with the General Plan of the Town of Danville. The repair will not
result in any expansion of use beyond that previously existing. The project will not result in the removal
of any scenic resource.
IV. CONSEQUENCES OF NEGATIVE ACTION:
Delay in approving the project will result in a delay of design and construction and may jeopardize funding.

Is based on the following: The proposed project consists of repairing an existing flood control
facility. The repair will not result in any expansion of use beyond that previously existing. The
project will not result in the removal of any scenic resource.

GENERAL CONSIDERATIONS:
1. Location: The project site is located on the south bank of Green Valley Creek near
Bueno Court in the Danville area. (Figures 1-3)
2. Project Description: The project consists of repairing an area of bank erosion by excavating
and removing unstable soil and replacing it with vegetated riprap (Figure 4). The area to be stabilized
is approximately 50' x 30' x 3'. A pool ranging in depth from two to twelve feet is located at the toe of
the failing bank. Green Valley Creek is perennial and flows will need to be diverted around the project
site. A water diversion system reviewed by the County and approved by the California Department of
Fish and Game will be implemented to dewater the construction site. A sediment filter dam will be
installed downstream of the project site to minimize sedimentation within the creek as a result of the
project. The repair activity will be kept to the minimum necessary to accomplish the repair, and the work
site will be kept clear of construction debris. The contractor will determine site access. Any alterations
to channel grade will be returned to pre-construction conditions at the completion of the project.
One cottonwood (Populus sp.) and one alder(Alnus sp.) may require removal as a result of the project.
If removal is required, the trees will be replaced at up to a 3:1 ratio in the vicinity of the project site
(depending on the outcome of negotiations with Fish and Game representatives). In addition,
approximately four cottonwood stumps at the slide area will require removal. Three of the stumps are
dead, however, one of the stumps is sprouting. These sprouts, along with plant material from the
cottonwood to be removed, will be used as cuttings for the vegetated riprap. The vegetated riprap will
be covered with soil and seeded above the ordinary high water mark. As a component of the project,
the three non-native invasive pampas grasses adjacent to the project site will be removed.
Best Management Practices (BMPs) will be utilized throughout the course of the project. BMPs will
include installation of Environmentally Sensitive Area (ESA)fencing as the first order of work to clearly
define the project limits and area of impact, as well as dewatering of the work site and installation of
sediment filter barriers prior to initiation of construction. All stockpiles will be located outside of the
streamzone. In addition, fueling and maintenance of equipment will occur at designated staging areas.
The work site will be maintained in a clean condition on a daily basis. All bare slopes and vegetated
riprap above the ordinary high water mark will be seeded with a native seed mix at the completion of the
project.
Red-legged frogs have been identified within the Green Valley Creek watershed. Based on the habitat
conditions at the project site, including the presence of riparian cover both up and downstream of the
project site, the essentially natural condition of the creek, and the presence of a deep pool at the project
site, Public Works staff have contacted USFWS for input on the project. However, the project area is
highly urbanized and previous correspondence with USFWS representatives for the general project area
has indicated that red-legged frog are unlikely to use this stretch of Green Valley Creek. A
preconstruction survey conducted last summer on Green Valley Creek for a construction project
approximately 0.5 mile upstream of the Bueno Court project site had negative results for red-legged frog.
In order to avoid potential impacts to red-legged frog, the County will conduct a preconstruction survey
for red-legged frog within one week of the start date. In addition, construction will occur during the dry
season (July through September) and the project site will be dewatered.
The habitat conditions that are potentially suitable for red-legged frog at the project site also suggest
the possible presence of Western pond turtle (Clemmys marmorata marmorata) in the area. A pre-
construction survey for the presence of this species will be conducted within one week of the project
start date. BMPs incorporated into the project description such as dewatering of the construction
site, working during the dry season (July-September), and relocating any turtles found to an
appropriate downstream location, will minimize any impacts to this species as a result of construction
activities.
Based on the low-flow condition of the creek during late summer months, the presence of a silt-clay
substrate which is poor spawning and rearing habitat, and the presence of drop-structures and
culverted sections downstream of the project site, Coho salmon (Oncorhynchus kisutch), Chinook
salmon (Oncorhynchus tshawytscha), and California steelhead (Oncorhynchus mykiss irideus) are
not expected to utilize this section of the creek.
