On August 17, 1999, this Board RESOLVED that the improvements in Subdivision MS 71-89 had been completed as provided in the Subdivision Agreement with J.S. Holt heretofore approved by this Board; On October 19, 1999, this Board RESOLVED that the warranty bond originally established to be $70,900.00 BE REDUCED pursuant to Section 94-4.406 of the Ordinance Code to an amount equal to 15% of the estimated cost of the construction of the public improvements, and BE RETAINED for the one-year guarantee period; IT WAS BY THE BOARD ORDERED that the Public Works Director BE AUTHORIZED TO REFUND $65,000.00 of the cash security for performance (Auditor's Deposit Permit No. 320474 dated September 28, 1998) plus interest in accordance with Government Code Section 53079 to John S. Holt; the remainder ($5,900.00) TO BE HELD FOR THE GUARANTEE PERIOD and until released by this Board; AND NOW, on the recommendation of the Public Works Director, this Board hereby FINDS that the improvements have satisfactorily met the guaranteed performance standards for the period following completion and acceptance. Therefore, IT IS BY THE BOARD ORDERED that the Public Works Director is AUTHORIZED TO REFUND the $5,900.00 cash deposit plus interest to John S. Holt in accordance with Government Code Section 53079 and Ordinance Code Section 94-4.406. NOW THEREFORE BE IT RESOLVED that the warranty period has been completed and the Subdivision Agreement is exonerated.
