Bautista, County Probation Officer DATE: August 24,2000 County SUBJECT: Inter-County Placement Agreement- Shasta County SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION That the County Probation Officer be authorized to enter into an agreement with Shasta County for placement of Contra Costa County delinquent wards of the Juvenile Court at the Crystal Creek Camp on a space available basis at a rate of$76.00 per day ($2,280 per 30-day month). BAC&GROUND Contra Costa County has had a contract with Shasta County since March, 1998 for placement of Court Wards at Crystal Creek Camp near Redding, Shasta County now wishes to update all of their contracts with no increase in cost. Crystal Creek Camp has a capacity of 60 wards, ages 14 through 18. The camp has a very strong educational and work component and has added many new programs, including expanded mental health services, Victim Awareness,and Anger Management, Their focus is personal responsibility with emphasis on education, life skills,and community service. Wards work at various job sites throughout Shasta County, omen under the supervision of the California Conservation Corps. The camp staff work with older wards towards emancipation. Contra Costa Probation has placed several wards at Crystal Creek Camp who do not require long term placements,but do need a period of time to deal with their delinquency and other issues, There are currently three youth in placement there and the camp has proven to be a valuable resource. This is approximately half the cost of the average group home placement, and in many cases this type of program is preferable for a youngster whose problems center around delinquency. This resource has expanded the Probation Department's options for difficult to place youth. Our staff have placed boys at the facility,visit the camp regularly and find it is an ideal resource for certain wards of the Court. We have an agreement with the facility for space available beds at the rate of$76.00 per day ($2,280 per 30-day month). This is a bargain compared to group homes averaging $4,300 per month. We currently have three boys in placement. Shasta County now wishes to update all of their contracts with no increase in cost. Attached is a Board Order authorizing the County Probation Officer to enter into a contract with Shasta County for space available placements. Please have this contract placed on the September 12, 2000 Board of Supervisors' agenda. SB:ds Attachments Ucrystalcr.$OQ CONTRACT FOR PLACEMENT OF JUVENILE COURT WARDS AT CRYSTAL CREEK JUVENILE DETENTION FACILITY (SPACE AVAILABLE BASIS) This agreement is entered into by and between the County of Shasta ("Shasta") and the County of Contra Costa ("Placing County"), for the purpose of allowing Placing County to place wards of the juvenile court in Shasta's Crystal Creek Juvenile Detention Facility on a space available basis. RECITALS WHEREAS, Shasta maintains and operates the Crystal Creek Juvenile Detention Facility pursuant to Division 2 of Part I of Chapter 2 of Article 15 of the Welfare and Institutions Code; and WHEREAS,the Crystal Creek facility often has accommodations in excess of Shasta's needs; and WHEREAS, Placing County is desirous of using Crystal Creek facility for housing certain of its juvenile court wards. NOW, THEREFORE, the parties agree as follows: 1. Placing County, in consideration of Shasta providing accommodations for its juvenile court wards, agrees to pay Shasta the sum of $76.00 per day, or portion of day, for each juvenile ward placed at the Crystal Creek Juvenile Detention Facility. 2. That payment provided in paragraph 1 shall cover all costs with respect to the care and maintenance of the wards of the Placing County, except for the following: 1. Costs of any hospital, medical or surgical care and treatment of the wards; 2. Costs of dental care for the wards; and 3. Costs of transportation and maintenance between Placing County and the Crystal Creek facility. These enumerated expenses will be in addition to the other charges mentioned in paragraph 1. Payment shall be due within 20 days of billing. 3. Shasta County shall defend, release, hold harmless, and indemnify Placing County, its officers and employees, from any and all claims for injuries or damages to persons to persons and/or property which arise out of injuries or damages resulting from the negligent acts or omissions of Shasta County, its officers and/or employees. It is further agreed that Plating County shall defend, hold harmless, and indemnify Shasta County, its officers and/or employees, from any and all claims for injuries and/or damages to persons and/or property which arise out of the negligent acts/or omissions of Placing County, its officer and/or employees. In the event of concurrent negligence of Shasta County, its officer and employees, and Placing County, its officer and employees, the liability for any and all claims for injuries or damages to persons and/or property shall be apportioned under the California theory of comparative negligence as presently established or as may hereafter be modified. 4. Shasta have developed and may, from time to time,modify its criteria for the acceptance of juvenile court wards. Shasta reserves-the right to reject or return any ward of Plating County who Shasta determines is unfit for placement or continued placement at the Crystal Creek facility. Placing County shall bear all costs of transportation for the return of any such ward to Placing County. 5. This agreement shall become effective upon execution and maybe terminated at any time by either party hereto, upon a 30 day written notice to the other party. 6. Shasta agrees to comply with all local,state and federal laws and regulations, including but not limited to the American's with Disabilities Act. Dr. Bachman has been and will continue developing and implementing a veterinary medical program for County Animal Shelters, assisting in the veterinary medical aspects of designing a new County animal shelter(s), diagnosing and treating impounded animals at the County Animal Shelter, developing and implementing standard operating procedures and guidelines for veterinary medical care of County's impounded animals, and providing training to County's staff on the care of impounded animals. Dr. Bachman may also perform other veterinary medical work as directed by the Animal Services Director. The combination of these two agreements provided for a monetary contribution on the part of the property owners for childcare mitigation, and for the Contra Costa Centre Association to undertake a Child Care Subsidy Program with the interest earnings on said funds. Funds could also be used for capital contributions to childcare projects that would increase the amount of available childcare space that serves the Pleasant Hill BART Station Area. Contra Costa Centre Association has prepared a Child Care Subsidy Program. The program provides for a subsidy payment to the qualified employees to offset a portion of their childcare costs. The Contra Costa Centre Association anticipates subsidizing only those families whose incomes fall below$45,000 annually. Childcare costs would be reimbursed on a sliding scale. Twenty-five families currently participate in the program. On average, the families pay $150.00 per week for childcare expenses. Prescription costs are increasing at three times the inflation rate compared to other medical costs. tither factors include increased utilization of expensive medical services, higher reimbursement costs for providers, an aging population, mandated legislative changes and changes in Medicare reimbursements. CENTAL PLANS: The major factor for the increase of Delta Dental results from increasing costs for 2001 claims including maximum annual benefit payment increases from $1,200 to $1,400 per member in 2000 and to $1,500 per member in 2001. FISCAL IMPACT: Premiums for active members are funded by employee contributions and budgeted funds charged to County Departments and Special Districts. These outcomes are achieved by offering comprehensive services, including high quality early childhood education, nutrition, and health to low-income children throughout Contra Costa County. III. REASONS FOR RECONEWENDATIONSIRACKGROUND: Effective February 10, 2000, the County executed a Short Form Service Contract #38-465, subsequently amended by Short Form Contract extension#38-465-1, for the provision of contracted temporary teaching staff services through June 30, 2000. Due to an on-going shortage of qualified teaching staff available for hire and the increased need for teaching staff to maintain a full-day, full-year child care and development program, the level of contractor services requested and received by the Community Services Department, Family and Children's Services Division exceeded original expectations. Approval of this request will allow for the County to reimburse the contractor for temporary teaching staff services provided to the Community Services Department.
