THE SUBJECT PROPERTY IS ADDRESSED #3212 DANVILLE BLVD., IN THE ALAMO AREA. SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Staff recommends the Board of Supervisors continue this item to October 17, 2000 to allow sufficient time to process the use permit for the proposed Christmas tree sales. FISCAL IMPACT Staff estimates the cost for processing the revocation proceedings to be $1000.00. The applicant is responsible for all costs associated with processing the use permit application. The Conditions of Approval expressly prohibited the sale of Christmas trees without approval of a new land use permit. The applicant sold Christmas trees from the premises in November and December of 1999 without obtaining a land use permit. On April 18, 2000, the Board of Supervisors held a revocation hearing for non-compliance with the Conditions of Approval. On April 17, 2000, Mr. Bridges filed a land use permit application to sell Christmas trees from the premises. Since an application was received, staff modified their recommendation at the meeting and recommended continuance of the item to August 8, 2000. The Board directed staff to return with a report on the Zoning Administrator's findings of compliance under Condition of Approval #14 and the Commission's decision on the land use permit request to sell Christmas trees from the premises. REASONS FOR RECOMMENDATION The Board continued this item to August 8, 2000 to allow sufficient time for processing the use permit application. The use permit was scheduled before the San Ramon Valley Regional Planning Commission with a recommendation for denial. At the July 19, 2000 San Ramon Valley Regional Planning Commission the applicant indicated to staff and the Commission that he was going to submit revised pians for the lot with off-street parking spaces. The Commission continued this item to September 20, 2000 to allow sufficient time for the applicant to submit the additional information. The applicant's attorney's letter addressed to Chair Donna Gerber requesting the continuance is attached. F`01 .'
