SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
L Recommended Action:
AUTHORIZE the General Manager to AWARD a contract for furnishing labor and materials for the repair
of a landslide on the sixth fairway of Blackhawk Country Club's Lakes Course to Environmental Golf,Inc.,
Calabasas, California in the amount of$745,321.56; and REQUIRE the contractor to present surety bonds for
Payment and Faithful Performance in the amounts of$745,321.56 and$745,321.56 respectively.
DIRECT the General Manager of the Blackhawk Geologic Hazard Abatement District(GHAD)to prepare
the contract for the project.
AUTHORIZE the General Manager to sign the contract on behalf of the Board subject to the General
Manager having reviewed and found sufficient all required documents, including the contract signed by the
contractor,the aforementioned surety bonds, and a certificate of insurance.
AUTHORIZE the General Manager to issue one or more contract change orders, as may be required and
without further Board action,up to a cumulative total equal to ten percent(10%)of the final contract or
$74,532.16.
AUTHORIZE the General Manager to execute License Agreements with the

the Blackhawk Homeowners Association.

II Financial Impact:
No impact on the County General Fund.The Blackhawk GHAD is funded through revenues generated by
County Service Area M-23. The proposed contract is consistent with the anticipated FY 99/00-program
budget.
III. Reasons for Recommendation and Background:
A landslide occurred in the slope adjacent to the sixth fairway on Blackhawk County Club's Lakes
Course during the winter on 1998/99. The landslide is within the boundaries of the Blackhawk GHAD.
The adopted Plan of Control authorizes repair of the landslide. Funds for the repair were included in the
GHAD's approved FY 1998/99 Program Budget. Repair was deferred because of a relatively low
priority in comparison with other landslides within the GHAD and due to a planned renovation of the
golf course. Renovation of the golf course is now underway.
The GHAD completed an analysis of the landslide and identified a repair strategy. Because the selected
strategy requires the placement of fill on the fairway of the golf course, the General Manager has been
coordinating with the Blackhawk County Club and their contractor, Environmental Golf,Calabasas,
California. A project that both economically repairs the landslide (to the satisfaction of the GHAD) and
provides a betterment to the golf course has been identified. The GHAD will be responsible for repair
the landslide and the Country Club will be responsible for all final grading as well as repair of the golf
course irrigation system and replacement of turf damaged during repair of the landslide. The GHAD's
Civil Engineering consultant,David Evan Associates of San Ramon, California,has prepared plans for
the repair project. DMC Engineering of San Ramon, a consultant to the GHAD,prepared the contract
specifications and developed a detailed engineers estimate of the cost.
Can June 27, 2000,the Board of Directors waived contract procedures of the Blackhawk GHAD and
authorized the General Manager to negotiate a contract for the repair with the Country Club's contractor,
Environmental Golf,Inc. of Calabasas,California. The General Manager has successfully negotiated a
proposed contract with Environmental Golf and is recommending that the Board of Directors authorize
him to award a contract in the amount of$745,321.56 for the work. In addition,the General Manager is
recommending that he be authorized to issue contract change orders up to 10%of the proposed contract,
as may be required,without further action by the Board.
License Agreements providing the CHAD with sufficient rights to enter upon and repair the landslide as
well as necessary indemnification are being negotiated and will be executed with the Blackhawk Country
Club and the Blackhawk Homeowners Association before work begins on the project.
Consequences of Negative Action:
The landslide could not be repaired this season and the GHAD, and the cost of repairing the landslide
would likely increase significantly because of the need to repair anticipated damage to the golf course
which would otherwise be the responsibility of the Blackhawk Country Club.
