APPROVE the reallocation of$40,000 in FY 96/97 Community Development Block Grant(CDBG)funds

Council)to project#97-32 OP Knightsen Avenue Frontage Improvements(Contra Costa County Public,

FISCAL IMPACT
No General Fund impact. All funds are from prior year CDBG allocations from the U.S. Department of
Housing and Urban Development
BACKGROUND/REASONS FOR RECOMMENDATIONS
In FY 1996/97 the Board of Supervisors approved the allocation of $40,000 in CDBG funds to the
Knightsen Town Advisory Council for the new construction of a segment of sidewalk on Knightsen
Avenue between Delta Road and"A° Street. in consultation with the Public Works Department it was
agreed that it would be more cost effective, and in the public interest to also replace existing sidewalk
that posed a hazard to pedestrians. In FY 97/98 the County Public Works Department in collaboration
with the Knightsen Town Advisory Council applied for, and the Board approved, the allocation of
$20,000 in CDBG funds for the additional segments of the sidewalk.

In order to streamline the bid process and meet federal requirements Public Works agreed to be the
lead agency for both projects. Attached is letter from the Knightsen Town Advisory Council
requesting the transfer of funds to the county Public Works Department. The combined FY 96/97
and 97/98 funds in the amount of$60,000 were sufficient to complete the project.

In FY 1996/97 the Knightsen T'o xm Advisory Council was granted$40,000 in
Community Development Block Grant funds to install sidewalks on a portion of
Knightsen Avenue. In FY 97198 the County Public Works Department was granted
$20,000 in CDBG funds to complete the Knightsen Avenue sidewalk.
The County Public Works Department agreed to take the lead on these projects and has
carried out the design and installation of the sidewalk projects on our behalf. Please
transfer the$40,000 granted to the Knightsen Town Advisory Council to the Public
Works Department.

Re: Merit Board Jurisdiction
The Merit System Ordinance establishes the jurisdiction of the Merit Board to hear
appeals from orders of dismissal, suspension, or reduction in rank or compensation; and to
oversee the Merit System. It also authorizes the Board of Supervisors to give jurisdiction to the
Merit Board to decide discrimination complaints and other matters. (Ordinance Code section 33-
3.909(a).) By Resolution 81/994,the Board of Supervisors gave the Merit Board power to hear
and decide discrimination complaints.
The Consent Decree in Croskrey v. County of Contra Costa, USDC No. C-73-0906
SAW, entered in 1975,provides for referral of disputes between the plaintiffs and county staff
over operation of the Consent Decree's Affirmative Action Program to the Civil Service
Commission. Issues concerning the Affirmative Action Program have recently been brought to
the Merit Board because the Civil Service Commission no longer exists. Since the Board of
Supervisors has not expressly conferred jurisdiction on the Merit Board to decide matters arising
under the Consent Decree, uncertainty exists as to how it should proceed. To resolve this
uncertainty, the County Counsel and County Administrator recommend that the Board of
Supervisors adopt the attached Resolution giving the Merit Board authority to determine matters
referred under the Consent Decree to the Civil Service Commission.

SUBJECT. Appointment of Interim Fire Chief - East Diablo Fire District
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1. AUTHORIZE the appointment of the Contra Costa Fire District Fire Chief, or
designee, to serve as Interim Fire Chief of the East Diablo Fire Protection
District, effective September 1, 2000, and until a permanent chief is
appointed.
2. REVIEW AND RATIFY a designee's interim appointment at the first meeting
of the Board of Supervisors on September 12, 2000.
BACKGROUND:
The retirement of Paul Hein, Fire Chief of the East Diablo Fire Protection District,
August 31, 2000 necessitates the appointment of an interim fire chief. In order to
ensure a smooth transition and provide for the daily management of the Fire District
we believe the appointment of the Fire Chief, or designee, of the larger and
adjacent Contra Costa Fire District to be the most effective interim measure to
ensure qualified and capable leadership for the East Diablo Fire Protection District.
Currently the District is in midst of negotiating a new labor agreement; participating
with the Bethel Island and Oakley Fire Districts in an ad hoc committee to review
alternative fire service structure; cooperating with the City of Brentwood in
constructing a new fire station; and evaluating the feasibility of adding paramedic
service. All of these efforts, in addition to the daily operational issues, will need a
competent and capable manager. Q

AUTHORIZE the Director of the Building Inspection Department to refund to Mr. and
Mrs. Lewis or Residential Homes, Inc. interest accrued on an abatement loan forthe
sum of $2,370.55, which is interest collected on an abatement lien.
FISCAL IMPACT
None
BACKGROUND/REASONS FOR RECOMMENDATIONS
On June 12, 1995 a lien to cover demolition costs was placed on a property located
at 1621 Sixth Street, Richmond, CA 94801. Based on Board policy the interest
charged to the property was based on the interest rate of 7% per annum. The
original cost of the abatement was $6,051.45, and the total amount paid by
Residential Homes, Inc. (including interest accrued) on behalf of Mr, and Mrs. Lewis
was $8,422.00
On March 15, 1999 Mr. James R. Lewis and Cathy V. Maynor-Lewis purchased the
property at a County auction. The property was purchased as tax-default property.
This adjustment is necessitated in order to assist in the sale of the Lewis' property to
a low-income family. This will further the objective of the County's First Time Home
Buyers Program.

APPROVE and Authorize the Deputy Director — Redevelopment to execute a contract
amendment in an amount not to exceed $233,902.00 with Balloffet & Associates, Inc. for
Environmental Impact Report preparation services relative to the proposed Pittsburg/Bay Point
BART Specific Plan.
FISCAL IMPACT
No General Funds are involved. Bay Area Rapid Transit District (BART), City of Pittsburg,
and Redevelopment Agency funds will cover costs.
BACKGROUND/REASONS FOR RECOMMENDATIONS
On April 23, 1996 the Board of Supervisors authorized staff to pursue the preparation of the
Pittsburg/Bay Point BART Specific Plan. In November 1997 a Public Review Draft of the
Pittsburg/Bay Point BART Specific Plan was issued. Staff has prepared a draft Initial Study
that indicates an Environmental Impact Report (EIR) should be prepared.

On May 12, 1998 The Board of Supervisors authorized the Deputy Director �-
Redevelopment to execute a contract with Ballofet&Associates, Inc. in an amount not to
exceed $150,000. A contract amendment in the amount not to exceed $142,592.00 was
approved by the Board of Supervisors on August 17, 1999.
During the public review period for the draft EIR, one of the major property owners
requested the county & city evaluate another, more intensive development scenario for
one of the development zones. The county & city agreed to evaluate the new proposed
alternative, as well as another alternative, with more intensive uses throughout the Specific
Plan area.
The increase in the contract amount is an amount not to exceed $91,310.00 and will cover
the cost of traffic modeling, review of alternatives and a redraft of the Environmental
Impact Report. The actual costs could be less, but cannot be accurately determined until
the initial modeling work is completed (early September).
