SPECIFIC REQUESTS OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. RE O ATION
APPROVE Change Orders No. 22 and No. 23 to the Contract dated June 15, 1999 for construction of
Tenant Improvements at Los Medanos Health Center, 2311 Loveridge Road, Pittsburg, with Lem
Construction, Inc., Burlingame, California, and AUTHORIZE the Director of General Services to
execute the Change Orders, which provide for installation of new mechanical controls for the central
mechanical plant; schedule extension to the tenant improvements contractor due to replacement of the
cast iron soil and vent piping system; and patching of floor, wall, and ceiling finishes on floors 2
through 5 demolished for the purpose of removing and replacing the existing cast iron soil and vent
pipes. Change Order No. 22 increases the Contract Price by $199,050.00 and Change Order No. 23
increases the Contract Price by$401,657.00.
II. FINANCIAL IMPAC
The additional cost of these change orders is within the budget authorized by the Board on November
16, 1999.
III. QVE�RVIEW
On November 16, 1999, the County Administrator and the consultants to the project, RGM and
Associates,made a presentation to the Board of Supervisors regarding the many building system
problems that had been uncovered during construction at Los Medanos Hospital. The majority of the
problems uncovered by RGM and Associates related to the building's central mechanical plant(CMP)
and cast iron soil pipe(LISP) systems. While acknowledging that resolving these building systems
would result in significant time delays and increased project costs,the Board nevertheless directed staff
to take the steps necessary to make the additional repairs to the building. Over the seven months, the
Board has approved nine change orders that have addressed various aspects of this additional repair
process.

Change Order No. 22, Item 22-1, provides for installation of a new mechanical control system for the
new CMP equipment that will allow it to tie into the other building monitoring systems. Change Order
No. 22, Item 22-2, reimburses the contractor for the schedule delays related to the replacement of the
CISP on floors two through five. Change Order No. 23 provides for the replacement of the ceiling and
wall finishes on floors two through five upon completion of the LISP replacement project.
These change orders could not have been issued until now because their overall cost and time impacts
could not be determined until the work on other separate aspects of the additional repairs was near
completion.
IV. REASONS FQR RFCOMMFNI)A1It7NS/5A KLROUND
A. Before construction began, much of the existing central mechanical plant equipment was found to be
corroded, leaking, and not in working order. In addition, the existing mechanical control system
components had deteriorated to the point that the system could no longer function. These existing
conditions required the replacement of the central mechanical plant equipment and the installation of
a new mechanical control system throughout the entire building. The main bid package for the tenant
improvements included a new mechanical controls system for the entire building with the exception
of the central mechanical plant equipment.
B. The consulting architect and engineers assembled bid documents for new central plant equipment,
which is being replaced under a separate formally bid project, as approved by the Board on February
15, 2000.
C. The mechanical engineer, in the interest of having one controls subcontractor furnish and install the
entire new control system, excluded the controls for the new central plant equipment from this
separate bid package. He assembled design documents issued as Proposal Request No. 6 for adding
these controls to the system under the tenant improvements contract.
D. Change Order No. 22, Item 22-1 provides for installation of a new mechanical control system for the
new equipment in the central mechanical plant.
E. On November 16, 1999 the Board of Supervisors accepted a report on the condition of the corroded
existing cast iron soil and vent piping system, and directed the County Administrator and the
Director of General Services to initiate the process to replace the entire above-ground cast iron soil
and vent piping system.
F. Previous change orders have been approved for demolition of ceiling, wall, and floor finishes,
demolition of the existing piping systems replacement of the cast iron soil and vent piping system on
the first floor, and patching of finishes on the first floor.
G. As directed by the County Administrator's Office, a separate bid package was assembled for
replacement of the corroded cast iron soil and vent piping system for floors 2 through 5. Every effort
was made by the consulting architect and engineers to issue this package in a timely manner so as to
reduce or eliminate any delay to the tenant improvements work. However, even though this separate
contract is being completed ahead of schedule, there is a delay of 50 calendar days to the
construction schedule of the tenant improvements contractor.
H. Change Order No. 22, Item 22-2 provides for an extension of the contract completion time and
increases the contract price to reimburse the tenant improvements contractor for the accompanying
site overhead costs due to the work of the separate contract for replacement of the corroded cast iron
soil and vent piping system for floors 2 through 5.

I. Demolition of the existing wall and ceiling finishes was required before demolition and replacement
of the existing failed cast iron soil and vent piping system could be undertaken as directed by the
Board on November 16, 1999. Change Order 9, Item 9-2 provided for the demolition of these finish
materials; Change Order 10 provided for the demolition of the existing cast iron soil and vent piping
system; Change Order 11 provided for installation of new cast iron soil and vent piping on the first
floor; installation of new cast iron soil and vent piping on floors two through five is being
accomplished under a separate construction contract approved by the Board on April 4, 2000;
Change Order 18 provided for patching of first floor finishes.
J. Change Order No. 23 provides for patching of floor, wall, and ceiling finishes on floors 2 through 5
that were removed under Change Order 9, Item 9-2.
K. The work authorized in Change Orders No. 22 and 23 is in accordance with the direction given by
the Board on November 16, 1999.

Furnish and install all labor and materials required to patch all finishes on floors 2 through 5 demolished
under a separate change order for the purpose of removing and replacing the original cast iron soil and
vent piping system.Patching of finishes shall match existing adjacent finishes in material,construction,
finish,and color. The work of this change order includes re-installation of casework and plumbing
fixtures removed during the demolition of finishes.Repair work on existing plumbing fixtures and wall
stops is not included.Any work required on these excluded items will be covered in future change orders.

RECOMMENDATIONS:
DETERMINE there is a need to continue with the emergency action continued by the Board on July 11, 2000
on the Emergency Upgrade of County Telecommunications Infrastructure.
FISLAIL IMPACT:
The financial impact remains as stated to the Board on 10/26/99.
REASONS FOR RECOMMENDATION/BACKGROUND:
On 10/26/99 the Board acknowledged that an emergency exists related to the seismic safety of the County
telecommunications infrastructure and that the emergency will not permit a delay resulting from competitive
solicitation of bids, and delegated to the County Administrator, or designee, authority to immediately proceed
with implementation of the "high priority actions" recommended by C.S.I. Telecommunications, Inc. The
County Administrator's Office in conjunction with the County Telecommunications Division is currently
proceeding with the delineation of specifications for the required work, as well as the identification of
appropriate vendors to complete the work. This item was last noticed 7/11/00.

RECOMMENDATIONS
ADOPT the attached resolution which determines the tax exchange for the proposed Oak Knoll
Estates Annexation to the City of Concord (LAFC 00-32).
BACKGROUND
Section 99 of the Revenue and Taxation Code provides that a city and county shall agree by resolution
to exchange property tax revenues among themselves and any affected agencies in the event of a
jurisdictional change.
The subject annexation is planned for LAFCO action on August 9, 2000. The City of Concord requests
the annexation of an uninhabited +/- 85 acres located south of Y'gnacio Valley Road, immediately west
of the Cal State Hayward Contra Costa Campus. The project proposes development of 183 single family
detached residential units with recreational facilities.
The tax exchange agreement stipulates that the master tax transfer agreement will apply, subject to the
condition that the property tax transfer to the City shall be off-set by the sum of sales and transient
occupancy tax in excess of$5,000.

for the Oak Knoll Estates Annexation }

WHEREAS,Section 99 of the Revenue Taxation Code provides that a City and County shall
agree by resolution to exchange property tax revenues among themselves and any affected agencies
in the event of a jurisdiction changes and
WHEREAS, the Oak Knoll Estates Annexation to the City of Concord (LAFC 00-32)
involving annexation of territory to the City of Concord is excluded from the application of the
master property tax transfer agreement between the City and the County because the assessed value
of the affected territory exceeds $10,000,000; and
WHEREAS, the City of Concord and the County have agreed that, notwithstanding the
amount of the assessed value of the territory of the subject annexation, the master property tax
transfer agreement shall apply to the annexation subject to the condition that the total amount of
property tax revenues the City is to receive from the County in any tax year pursuant to the
provisions of the master agreement from the territory of the subject annexation shall be reduced by
an amount equal to the sum of the sales tax revenue and transient occupancy tax revenue in excess
of$5,000 received by the City during the preceding tax year from the area annexed. Any such
reduction,however, shall not result in a"negative transfer", i.e., a net transfer from City to County.
The total amount of transient occupancy tax and sales tax revenue received by the City from the
territory of the subject annexation during the preceding tax year,as specified above,shall be reported
to the County Auditor-Controller by August 1 of each year, and the Auditor-Controller shall have
the right to audit the City's books to verify such amount.
NOW THEREFORE BE IT BY THE BOARD OF SUPERVISORS OF CONTRA
COSTA COUNTY RESOLVED,that in accordance with Section 99 of the Revenue and Taxation
Code the property tax transfer for the affected agencies in the area of the Oak Knoll Estates
Annexation to the City of Concord(LAFC 00-32) shall be in accordance with the master property
tax agreement subject to the sales and transient occupancy tax offset condition specified above. Said
property tax transfer agreement applies to the affected territory as submitted or revised by the Local
Agency Formation Commission. This resolution does not change the property tax revenues accruing
to other agencies serving the subject territory or the affected districts' rights to collect taxes for
existing bonded indebtedness.
