SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: APPROVE and AUTHORIZE the Employment and Human Services Director, or designee, to Contract (#40-071-02) with Ms. Ruth Goodin, in the amount of$77,280, for Long Term Care consultation and technical assistance services for the period from July 1, 2000 through June 30, 2001. FINANCIAL IMPACT: Funding is $50,000 from the State Department of Health Services Office of Long Term Care grant and a cash or in-kind services match from the Health Services Department ($13,640) and Employment and Human Services Department ($13,640) as specified in the grant application. BACKGROUND: On May 16, 2000 the Board authorized the Employment and Human Services and Health Service Department(s) to continue planning efforts for Long Term Care Integration. The efforts will result in an integrated model for long term care and an appropriate implementation strategy for Contra Costa County. The Board approval to accept the second year grant funding in the amount of$50,000 from the California Department of Health Services, Office of Long Term Care, will contribute to assisting those continued efforts by continuing an administrative position. The administrative position is for a facilitator, consultant and technical assistant to the Long Term Care Planning Task Force to facilitate meetings to include, but not limited to, County Departments, non-profits, for profits, HMO's, cities and unincorporated areas of the county, and the community at large. The position will assist the Long Term Care Task Force in the development of an integrated model of long term care in Contra Costa County for seniors and adults with disabilities. Ms. Goodin has held the position for 2 years and has the expertise necessary for the planning and implementation of the Long Term Care Integration project. BACKGROUND Currently, the Human Resources Department utilizes the services of Cooperative Personnel Services to provide a wide range of consulting and support services in the areas of classification studies, compensation analysis and general personnel activities. The approval of this agreement would simplify and streamline the process and expedite our ability to provide personnel services to our customers. FISCAL IMPACT The cost of this contract through June 30, 2001 is within departmental budget. The Antioch Friends of the Arts would pay for the cost of the mural, and have asked that the County maintain the mural. The County Library recommends approval and requests authorization to enter into an agreement with the Antioch Friends of the Arts to produce and maintain the mural. FINANCIAL IMPACT: The County Library would incur a cost, not to exceed $1,000 per year, plus inflation to maintain the mural, and the cost of clear-coating the mural every five years at a cost estimated at $1,500. These costs would be budgeted by the County Library on an annual basis. The first budget year affected by this agreement would be 2001-02. The County Library currently spends approximately$600 annually to remove or paint over graffiti on this building. BACKGROUND: The Antioch Friends of the Library and Friends of the Arts are proposing this project as part of the Friends of the Arts Millenium mural project. Antioch now has two murals, located in downtown Antioch. They believe that a display of art is generally seen as enhancing neighborhoods and communities.A mural on the library wall would improve the appearance of the building and the surrounding area. It would provide the library with greater visibility, and is expected to reduce the on-going graffiti problem experienced by the library. The proposed mural would reflect the general concept of the library and its activities including: children's programs, local history, authors and literary characters. The Friends groups have agreed that the final renderings will be reviewed by the County Arts Commission and the County Administrator, with approval by the County Administrator,or his designee. It is anticipated that the mural would be completed by November,2000. The Friends of the Antioch Arts have secured funding from local Family Trusts, Foundations and individual contributors to pay for the approximate$15,000 cost of the mural including the artists fee, preparation of the wall surface, anti-graffiti coating, rental of cyclone fencing and scaffolding,and misc. administrative costs. This proposal was reviewed and endorsed by the Public Art Committee of the Arts and Culture Commission at its meeting of June 27, 2000. With approval by the board of supervisors,the County Library will enter into an agreement with the Friends of the Antioch Arts, which specifies the responsibilities on the development and on-going maintenance of the mural. The agreement would commit the County to maintaining the mural as described above for a period of 20 years unless the building is sold. The COUNTY is the owner of the library located at 501 W. 18th Street, Antioch. The parties agree that a mural will be of benefit to library patrons and the Antioch community by attracting interest in the library, reducing or eliminating the on-going graffiti, and providing public enjoyment. It is the purpose and intent of this Agreement to set forth the various rights, duties and obligations of each party with regard to the application and maintenance of the Antioch Library mural. TERM: Agreement shall commence July 26, 2000, and shall terminate July 25, 2020, or until the County no longer owns the Antioch Library building, which ever occurs first. COUNTY RESPONSIBILITIES: A. COUNTY shall provide for and fund periodic removal of any graffiti on the mural, provided the cost does not exceed $1,000 per year, plus an annual inflation rate based on the consumer price index. The cost shall be budgeted annually by the County Library. Maintenance shall be provided by the County Office of General Services, unless otherwise specified in writing. k LIBRARY USE AND MAINTENANCE AGREEMENT BETWEEN THE ANTIOCH FRIENDS OF THE ARTS AND THE COUNTY OF CONTRA COSTA B. COUNTY shall provide for and fund cleaning and the application of a clear, graffiti-preventative coating to the mural every five years at a cost not to exceed $1,500 per application of coating plus an annual inflation rate based on the consumer price index. The cost shall be budgeted by the County Library. Cleaning and clear coating shall be provided by the County Office of General Services, unless otherwise specified in writing. C. COUNTY shall grant access to the exterior of the library during agreed-upon dates and times for the construction of the mural. D. COUNTY retains the right to review the mural designs, and approval of the mural designs and artist's final renderings submitted by the FRIENDS is required before work on the mural is begun. FRIEND's RESPONSIBILITIES: The FRIENDS shall: A. Review and approve the subject matter of the mural, time period depicted, general mural design for height and width and other details prior to submittal of the final artists renderings to the COUNTY. B. Implement, manage, and oversee the general call to artists and the artist selection process. FRIENDS shall be responsible for the artists' contracts and all payments to the artists. C. Have sole responsibility for monitoring progress of the work and for accepting the final product from the artists. o:wautMUDOC 2 LIBRARY USE ANIS MAINTENANCE AGREEMENT BETWEEN THE ANTIOCH FRIENDS OF THE ARTS AND THE COUNTY OF CONTRA COSTA D. Hold harmless, defend and indemnify COUNTY from any and all claims, costs, loss or damage arising from the artist's services rendered in connection with the mural including but not limited to, issues regarding payment for the artist's services. E. Require that the artist hold the COUNTY and FRIENDS harmless for any injury, mishap, loss of materials or damage to "in progress" works that occurs on site, or in any other way associated with the installation of the murals. This clause shall not pertain to any claim resulting from any other public property. F. Ensure that the mural will include a plaque giving the history of the mural, the name of the painting, the name of the artist, and such other information deemed appropriate by the FRIENDS. A ENDMENT. This agreement may be amended by written mutual consent of both parties. OWNERSHIP: Upon completion, the mural shall be considered to be the property of the County. However, FRIENDS shall retain all rights to reproductions or likenesses of the murals. Any funds derived therefrom shall be the property of FRIENDS. If FRIENDS disband, the right to garner revenue from such activities shall be transferred to the Civic Arts Commission of the City of Antioch. In the absence of an arts "commission"' the transfer may be to another arts based non- profit corporation. However, nothing herein shall prevent the City of Antioch, caWURAL2,DOC 3 } LIBRARY USE AND MAINTENANCE AGREEMENT BETWEEN THE ANTIOCH FRIENDS OF THE ARTS AND THE COUNTY OF CONTRA. COSTA COUNTY, or a civic organization from using reproductions, photographs or other likenesses of the murals, for noncommercial purposes, in materials, disseminated for the general promotion of the community. SOLICITATION: FRIENDS is the sole organization authorized to solicit funds or contributions from the public for the production of this mural, unless express written consent is granted from FRIENDS' board of directors. PAYMENTS FOR DAMAGE: If COUNTY receives any insurance payment for damage to murals, COUNTY shall transfer any such payment to FRIENDS for their use in repairing the mural, or for creating a substitute mural or art project within the Library Region. BREACH: Breach of contract by the artist will void this agreement. TERMINATION OF AGREEMENT: At any time that the County wishes to divest itself of the building, and thereby the mural, the new owner of the building, governmental or private, shall be encouraged to assume the County's responsibility for maintenance of the mural for the remaining years of this contract. Upon the completion of the mural, (i.e. delivery to the County), this agreement may not be cancelled, as long as the County is the owner of the building except under the following conditions. In the event that the mural is damaged beyond repair, (between 30% and 50%), as determined by the Contra Costa County Art and Culture Commission., or if the COUNTY determines that more than 50% of the mural is damaged beyond repair, OAMURaLIDOC 4 LIBRARY USE AND MAINTENANCE AGREEMENT BETWEEN THE ANTIOCH FRIENDS OF THE ARTS AND THE COUNTY OF CONTRA COSTA the County may adopt a resolution, with a 30-day prior written notice to the Friends, and abandon this agreement and any obligation to repair, maintain or replace the mural. The County shall not be required to repair or maintain the mural if payment of costs necessitated are beyond the County's limited liability for maintenance of the mural as set forth in paragraph A. of this agreement. TIME: FRIENDS shall require completion of the mural by the artist within 6 months after the commencement of this agreement.
