SUBJECT- Approving Quitclaim Deed.
Can the recommendation of the Public Works Director, IT IS BY THE BOARD ORDERED
that the Chairperson is AUTHORIZED to execute the following "Quitclaim Deed" of the
development rights to Tamara Covert. The document was prepared by the Contra Costa County
Public Works Department,
Being Parcel "AS4 as shown on the map of Subdivision MS 38-88,recorded in Book 164 of
Parcel Maps at page 45, Contra Costa County records.
I hereby certify that this is a true and correct copy of an
action taken and entered on the minutes of the Board of
Supervisors on the date shown.

SUBJECT: Quit Claim Deed for Minor Subdivision 38-88
FILE: SIS 38-88
Item C5 on the September 28, 1999, Board Agenda authorized the County to quit clam development
rights back to Tamara Covert for MS 38-88. As I explained to you., the Board required the
development rights to be granted to the County as part of the Subdivision Agreement until the
developer installed required improvements. Now that the requirements have',beenn satisfied, the
development rights can be quit claimed back to the developer. This action requires,Board approval.
Furthermore, at the time that the Subdivision Agreement and the Grant Deed of Development Rights
were approved by the Board, the Tithe Company failed to record said deed. Therefore, it is not
necessary to record the quit claim for a deed that was never recorded, Board action should be
sufficient.

For valuable consideration, receipt of which is hereby acknowledged,the County of Contra Costa,
a political subdivision of the State of California.,hereby remises,releases and forever quitclaims to
Tamara.Covert all of its right,title and interest in the real property, specifically"development rights"
over:.hose certain parcels of land, situated in Contra. Costa.County, being Parcel A, of MS 38-88
fled June 10, 1994,in Book 164 of Parcel Maps,page 45, Contra Costa County Records, State of
California, described more particularly in Exhibit"A," attached hereto and made a part hereof:
No transfer tax clue. This is a quitclaim of development rights only.
