RECOMMENDATIONS
ACCEPT report of the Community Development Director on the status of disposal fees at
the S.T.A.R. Transfer Station (a.k.a. Contra Costa Transfer & Recovery Station) near
Martinez.
FISCAL IMPACT
Acceptance of the report will have no fiscal impact on the County.
BACKGROUND/REASONS FOR RECOMMENDATIONS
On September 14, 1999 the Board of Supervisors directed staff to provide report at their
meeting on September 21, 1999 regarding the change in rates charged at the Contra
Costa Transfer & Recovery Station located at 951 Waterbird Way in the Martinez area.
This matter was raised by a concerned individual during the Public Comment portion of the
Board's meeting on September 14, 1999.
On September 1, 1999, the operator of the Contra Costa Transfer & Recovery Station
changed the rates charged from a per ton basis to a per cubic yard basis. Since November
1994, the transfer station rate had been $51 .24 per ton for the first ton and $60.00 per
ton for each ton thereafter. On September 1, 1999 the operator changed the transfer
station rate for loads less than 10 cubic yards to $12.50 per cubic yard. The attached
letter from the operator contains additional information regarding the current rates charged,
the reasons for the change as well as a copy of the notice provided to customers in the
weeks preceding the rate change (Exhibit A).

In September 1994 the Board of Supervisors approved a Franchise Agreement for the
transfer station. Section 6.1 and 6.7 of the Franchise Agreement specify the rate setting
requirements.
Section 6.1 reads:
PROPRIETARY RATE. Except as provided in Section 6.7, the Transfer
Station Proprietary Rate shall be determined and established by Operator at
its sole discretion. Notwithstanding section 4.11, it is understood that the
Operator need not charge a uniform Transfer Station Proprietary Rate to all
customers, but may vary the Transfer Station Proprietary Rate as between
different customers based on various factors determined by Operator,
including, but not limited to, the quantity and type o'f waste delivered by
each customer to the facility and whether each customers has entered into
an agreement with the Operator in which the customer agrees to deliver
some or all of the customer's future waste stream to the Transfer Station.
Section 6.7 reads:
SELF-HAUL RATES. Notwithstanding Section 6.1, the Gate Rate charged to
customers delivering less than one ton of solid waste per day shall not
exceed the average of the charges of all other transfer stations and landfills
in Contra Costa County.
The Keller Canyon Landfill and West County Transfer Station do not accept waste from
self-haul customers. These facilities therefore do not have self-haul rates. The Acme
Landfill is restricted from taking general solid waste and is only permitted to accept yard
waste and construction and demolition debris which is routinely used as cover material
rather than being disposed.
The only landfill and transfer station which are currently accepting solid waste from self-
haul customers are the West Contra Costa Sanitary Landfill and the Pittsburg Transfer
Station.
The enclosed letter from the Contra Costa Transfer & Recovery Station asserts that their
rate of $12.50 per cubic yard (whether loose or compacted) is within the "low end of the
spectrum in terms of customers delivering less than 1 ton per day to the facility".
Community Development Department staff contacted the operators of these facilities and
obtained current rate information from the facilities. The West Contra Costa Sanitary
Landfill charges $10.00/cubic yard for loose garbage, $20.00/cubic yard for construction
& demolition waste and $58.00/ton for bulk/compacted solid waste (Exhibit B). The
Pittsburg Transfer Station operated by Contra Costa Waste Service charges $12.00/cubic
yard for first cubic yard and $10.00 for each additional cubic yard for non-compacted
material; they charge $48-00/ton for compacted materials (e.g. dirt, rock, concrete and
roofing materials) (Exhibit Q. According to state regulations, the conversion factor for
compacted waste. For comparison purposes staff converted the charges for compacted
material from per ton to per cubic yard. Staff used the conversion factor for compacted
waste included in state regulations which is is 4 cubic yards per ton. Staff calculated that
the West Contra Costa Sanitary Landfill charge would be $14.50/cubic yard for
bulk/compacted waste and the Pittsburg Transfer Station charge would be $12.00/cubic
yard for compacted materials (e.g. dirt, rock, concrete and roofing materials).
Based on the information gathered by staff and our calculations we have concluded that the
Contra Costa Transfer and Recovery Station rate does not exceed the average of the
charges of all other transfer stations and landfills in Contra Costa County that accept solid
waste from self-haul customers.

Dear piedra:
Per our discussion today I am forwarding information regarding the revised pricing schedule for tile
Contra CostaTranstlerand recovery Facility. As you are aware, on September 1, 1999 the facility
began charging self haul customers by the cubic yard versus a per ton basis. The purpose of this
adjustment was to bring the facility in line with standard industry practices and to ultimately reduce
cycle tinics in and out of the Facility. Prior to the change, self haul vehicles Nvere required to stop
at the scale house on the way in and out of the facility, While the transition to this tyle Of fee
assessment will require sore adjustment time, we believe it will ultimately provide an accurate and
efficient means ot'cliarging fees to the customers utilizing the facility.
A copy of the notice provided to customers regarding the adjustment in fee assessnicilt is attached.
This notice was provided to all non-internal customers utilizing the facility in the weeks prior to
September 1. A copy of the revised pricing schedule is also attached,
Section 6.7 of the Franchise Agreement with Contra Costa County for the transfer station requires
that the Gate Rate charged to customers delivering less than one ton of solid waste per day sliall not
exceed the average of the charges of all other transfer stations and lwidtills in Contra Costa County.
While it is difficult to determine the average charge per ton of solid waste received at all other
transfer stations and land ills in the County due to variations in pricing schedules, our review of'
prices charged to self'haul customers in the County indicates that our revised fee schedule places us
within an acceptable range. Self haul customers are generally thought of as those delivering less
than one ton per day in pick ups and small trailers.

indicates that the new pricing schedule is in line with the requirements of the Franchise Agreement.
`l"hc Pittsburg Trans f'er Station assesses a fee of$12 for the first cubic yard and $10 for each cubic
yard thereafter. This fee had formerly been a flat $12 per cubic yard prior to our change in 11ce
assessment. The West Contra Costa Landfill assesses a fee of$20 1br the first cubic yard And $10
per cubic yard thereafter. Our flat rate of$12.50 per cubic yard would place us at the low end of
the spectrum in t MIS of customers delivering less than 1 ton per day to the facility.

Dear Valued Customer,
Effective September 1, 1999 the Contra Costa Transfer and Recovery Station will begin
charging disposal fees by the cubic yard for passenger vehicles, pickups, two axle trucks
and passenger vehicles/pickup trucks with trailers. Vehicles with dirt or wastes
containing primarily concrete will continue to be weighed and charged by the ton.
The Weighmaster will determine the cubic yards contained In the load and disposal fees
will be collected prior to proceeding to the transfer station unloading area, You will be
given your receipt at this time. You will not need to stop at the scales on your way out.
We will also be installing a computer terminal and utilizing a second incoming scale
booth to serve our customers in a more expeditious fashion.
The rate per cubic yard is $12.50. The minimum rate is $12.50.
Measured loads will be rounded up to the half-yard.
(Example, F150 pickup truck 8 ' bed filled to the bed level)

The disposal fee will be computed as follows:
