(County Children and Families
Commission - Proposition 10)
The Contra Costa County Board of Supervisors ordains as follows (omitting the
parenthetical footnotes from the official text from the enacted or amended provisions of
the County {ordinance Code).
SEUMON-L Section 26-14.0361 is added to the County Ordinance Code to read as
follows:
26-14.001 e-. In this chapter 2 -14 wherever reference is made to the county or
local Children and Families First Commission or trust fund, they shall hereafter be
called the county or local children and families commission or trust fund.

T1 N_t-a Section 26-14.022 of the County Ordinance Code is amended to provide
for county commission appointment of its staff, as follows:

(a) Executive Director and staff. Commission staff shall consist of an executive
director employed by the commission, to serve at its pleasure, and such other
staff or consultants as deemed necessary or appropriate by the commission, All
employed staff of the commission shall be exempt and excluded from the
county's merit system and shall not be county employees for any purpose except
county employees may be utilized as hereinafter provided. Subject to the
provisions of subsection (a) of section 26-14,026, commission staff may be
employed as commission employees or contract consultants. The executive
director may utilize county employees as permitted by their appointing authorities
to assist in carrying out the purposes of this chapter.
(b) County Support Services. Support services usually provided to county
departments will be available as necessary to the commission including financial
services by the auditor-controller and the treasurer and any legal services
rewired shall be available from the county counsel's office.
(c) All county costs to provide the staff services authorized by subsections (a) and
(b) to implement this chapter shall be reimbursed and paid by the auditor-
controller from funds in the local Children and Families"gust Fund. The

executive director shall, at least monthly, direct the auditor-controller to
reimburse the county for any and all staffing costs. Such reimbursement shall be
accomplished by direct transfers from the Trust Fund.

Effective Data. This ordinance shall become effective!39 days after
Passage, and within 15 days of passage shall be published once withthe names of the

The Contra Costa County Board of Supervisors ordains as follows (omitting the

the County Ordinance Code).
SECTION f, Section 26-14.042 is added to the County Ordinance Cole, to recognize
theCommission's autonomous staters, to read as follows:

Commission shall be a public entity separate from the County of Contra Costa and shall
file the statements required by Government Code section 53051.

whether statutory, contractual, or otherwise, shall be the obligation solely of the
commission and shall not be the obligation of the County of Contra Crista.
(b)Any and all contracts, leases= or other agreements of any nature between the
commission arra third parties other than the county shall contain an express provision
advising the third party that the commission is a separate public entity and that such
agreement does not bind Contra Costa County.
(c)The commission shall require any and all third parties contracting with the
commission to indemnify and hold harmless the commission, to provide the commission
with written acknowledgment of such indemnification, and to maintain adequate levels
of insurance, as determined by the County's risk manager, naming the commission as
an additional insured. For any particular contract, the commission may approve a
variance to and from some or all of the requirements of this subsection but only where
the variance and reason for its granting by the commission are set forth in the
commission's official meeting records and minutes.

SECTIQNJL1 Section 26414.046 is added to the Ordinance Code to read as follows:
2—44 t34f UabWtv Insurance.. Without limiting its indemnification of the county as set
forth below, the commission:
(a) Shall be covered by the county's self-insurance program subject to whatever
terms, conditions and charges are recommended by the risk manager and required by

the board of supervisors.
(b) May, in lieu of the county's self-insurance program, acquire and maintain
appropriate- private insurance in amounts and coverage types to be determined by the
county's risk manager to be adequate, and shall name the county and the members of
the board of supervisors as additional insureds on any policies of private insurance
maintained by the commission. Evidence of such insurance coverage shall be provided
to the county's rids manager within thirty days of procurement.

gZ tV. Section 26-14.048 is added to the Ordinance Code to read as follows:

harmless the county and its authorities, elected and appointed officers, employees and
agents from and against any and all liability, including defense casts and legal fees, and
claims for damages of any nature whatsoever, including but not limited to personal
injury or property damages, arising from or connected with any act or omission of the
commission and any officer or employee of the commission.
