Reasons for Recommendations and Background: The original lease provided that the Tenant could not refinance its loan until after the completion of Phase 2 of its improvements. The tenant now desires to refinance prior to the completion of the Phase 2 improvements. This Second Amendment to Lease allows the tenant to refinance its loan after the completion of Phase I of the improvements, in exchange for the Tenant completing certain improvements at the Byron Airport that benefit the County. Phase I of the improvements was completed in 1998. Phase 2 will be completed in 1999. IV. Consequences of Negative Action: The Second Amendment to Lease will not be executed, and improvements benefiting the County Airport will not be completed.
