The Board of Supervisors of Contra Costa County Resolves that:
The Public Works Director (the County Surveyor) has filed with this Board a report specifying
that sidewalk and related curb repairs have beery made adjoining the real property (APN 354••133-001)
located at 611 Second Avenue, (Crockett area), costing $6,502.62, (including property tax roll collection
fee) proposing that this surer be assessed and levied against the said parcel of real property, and indicating
that timely notice of a hearing on this date (at 9 a.m.) before this Board was provided to the real property
owner Jeffrey Hicks et al in the manner required by la v.
At the time fixed for hearing or, this date, this board heard the report of the Public Works Director and
any objections or protests by the involved property owners and other interested personas and closed the
hearing.
This Board_1hereby finds, determines, confirms and orders that:

3. If the above specified assessed su-n is not paid within five (5) days of this date to the County,
it shall constitute a special assessment against said parcel of property, and shall be a lien thereof
(together with administrative fees, interest, and penalties due) until it is paid, or until= it is discharged of
record.
4. The Public Works Director shall cause a notice of lien for the above specified and unpaid
assessment lien to be prepared and completed pursuant to Streets and Highways Code section 5626 and;
a. Delivered to and filed for recordation in the County recorder's office a completed and
executed original copy of said notice of lien., and
b. urn over completed copies of the said notice of lien to the County Assessor, Auditor
and tax Collector for tax roll collection pursuant to Street and highways Code Section 5628 and 5629.
5, Upon completed payment of the assessrn_ent (including any administrative fees, penalties and
interest die thereon), the Public Works Director is authorized on bel alf of the County to execute any
necessary and appropriate release or satisfaction of lien proposed by the involved iandowners.

SUBJECT: Report on Sidewalk Hazard Abatement at 61 1 Second Averrae, Crockett area.
This report is in reference to the September 14, 1999 Hearing on the confirmation of the sidewalk
repair cost for the hazard abatement at 611 Second Avenge, Crockett area.
1n October of 1997, we became mare through field survey of sidewalk hazards in the Crockett area.
Our Department notified numerous property owners in the area that the sidewalks in front of their
property were in disrepair and rewired. replacement. In many cases, the sidewalks dere badly
cracked and broken, were a hazard to the public and presented the County with a liability problem
if left unrepaired. Araou the residents notified were JeFfrey Hicks and Darren Kinyon, owning
property at 611 Second Street in Crockett. In accordance with the Streets and Highways Code of
the State of California, it is the responsibility of the property owner to maintain the sidewalk frontin8
their property in a safe condition.
Since our initial notifications in 1997, all of the property owners we contacted coinphed with our
requests to replace the hazardous sidewalks, with the exceptiorn of Mr. Hicks and Mr. inyon. We
give property owners ample opportunity to replace their sidewalks since it's usually less expensive
for their.to arrange for the work. We have sent numerous notices to these property owners with the
Dope of eventual compliance. When it appeared that Mr, Hicks and lir. kinyon were not going to
repair their sidewalk, we requested bids from licensed contractors to make the repairs. The lowest
qualified bidder was selected to complete the repairs aft-ter proper notification and posting of the
property.
We have billed Mr, Hicks and Mrs. Kirayon for $6,251.46, which represents the total cost of the
repairs, including administrative costs, as allowed by the Streets and Highways Code. Since Mr.
wicks and fir. pinyon, have not pa€d their bill after many attempts of callection, we commend that
the east ofrepair together with a property tax roll collection fee of$250.76 be assessed against their
property as a hien.
