Diablo, issued to Knox LaRue WHEREAS, the Board of Supervisors at its September 20, 1983, hearing of the appeal by Knox La Rue of conditions of approval placed by the Planning Commission on Land Use Permit 2203-75, approved the permit requiring that the reports required by Condition 12, 17, 20(c), and 24, be submitted no later than November 1, 1983, and that on that date a report be made to the Board by the Planning Department as to the status of the required submittals; and WHEREAS, Karl Wandry, Chief, Land Development, outlined the status of the applicant's compliance with each condition based on the following information: Condition 12. Each permittee shall submit no later than November 1, 1983, site by site details of all facilities on the permittees sites including: A. Size of all buildings. B. Existing and anticipated maximum height of antennas. C. Existing and aniticpated number and size of microwave dishes. D. Size of tower base and footing. E. Exisitng and anticipated maximum width of tower face. F. Spread, location and base/footing of guys. Status: Report received by the Planning Department, September 13, 1983. The report attempts to address the requirements of Condition 12, however, it is incomplete in that it does not address the facilities on a site by site basis. Condition 17. No later than November 1, 1983, the permittee shall submit a report on the feasibility of using alternatives to microwave dishes at Site #4 and #5. The report shall address the visual impacts of microwave equip- ment, alternative designs (colors, screening, open gridwork, etc.). Mitigations/recommendation of the report, subject to the Zoning Administrator review and approval, may be incorporated into this condition. Status: Report received by the Planning Department dated August 5, 1983, supplemented by a letter dated September 15, 1983, satisfies this condition. Condition 20. The permittee(s) shall comply with the recommendations of the biotic report submitted December 7, 1983, as follows: C. Existing lewisia redeviva shall be located, staked and protected within 100 feet of the sites no later than November 1, 1983. Status: To date this condition has not been met. Condition 24. That an archaeological survey be submitted addressing the area within 100 feet of the sites no later than November 1, 1983. 219 ti. - 2 - Status: To date this condition has not been met. and; WHEREAS, Mr. Wandry reported that the applicant, Mr. La Rue, had been advised of the noted deficiencies by letter dated October 14, 1983, and that no response has been received to date; and WHEREAS, the Board discussed the matter determining that Mr. La Rue was not responding to the Board's direction to comply with the noted conditions in a timely manner and that the initiation of a revocation proceeding was in order; NOW, THEREFORE; BE IT RESOLVED, the Board orders the Planning Department in conjunction with County Counsel to prepare charges preparatory to a revocation proceeding; and further orders the Planning Department to schedule Land Use Permit 2203-75 for revocation hearings before the County Planning Commission, and further to report to the Board on November 8, 1983, the date of said scheduled hearing.
