BARRY, AICD Costa COMMUNITY DEVELOPMENT DIRECTOR County DATE: September 14, 1999 SUBJECT: REPORT ON CONTINUEDPUBLIC HEARING FOR THE SAN FRANCISCO TO STOCKTON MAINTENANCE ASSESSMENT DISTRICT 1999-1 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) BACKGROUND AND JUSTIFICATION REQDMY1 E ,N =0S ONTi UE the Public Hearing for the San Fran isco to Stockton, California (Suisun Bay Channel and New York Slough Channel) Maintenance Assessment District 1999-1, to November 16, 1999, 11:00 PM, to allow refinement of data relative to parcels and vessel use, and subsequently, to modify benefit assessments. As part of the process of formation of the assessment district, the County Water Agency held three informal public meetings for interested parties, including industries that are charnel beneficiaries which would be assessed for maintenance costs as part of thi's process. These meetings provided an opportunity to learn more about specific costs assodated with dredging andisposal and how the benefit assessment allocations were accomplished. The Engineer's deport details information on costs associated with maintenance dredging and provides several options for disposal, as well. as detail on bow costs were to be allocated among industry users. The benefit assessment allocation considers a, variety of factors, such: as parcel acreage, channel fret footage, vessel trips, vessel tonnage, and a channel usage (distance) factor. The variety and weighting of factors considered reflects the complexity of a formula determined to be necessary to be fair among the variety of users. A -. ..,. n-------- DEPUTY Report on Continued Public Hearing for the San Francisco to Stockton Maintenance Assessment District 1999.1 Sepfernber 14, 1999 Page 2 Several of the industries provided updated parcel data and detail on parcels which are not related to marine use in any way (baseball fields, a credit union, wetlands, etc.), and which, in their opinion, should not be included in assessment calculations. Vessel use information . which may require some minor modification in the Engineer's Report was also provided. The engineer of record, the consulting attorney on this project, and staff reviewed this information, have confirmed its validity and determined that the Engineer's Report and consequently, the Assessment District would be more accurate and consistent if this information were included. There are several instances where removal of parcels not related to marine use may be significant enough; to affect benefit apportionnient and require re-noticing.
