NCIE Subject: Confirmation of } Resolution No: 99 1 442 Sidewalk Repair (S, &H.C.§ § 5618, 5626 & 5628) Costs, APN 035-422-007) The Board of Supervisors of Contra Costa County Resolves that: `I`he ."llublic Works Director (the County Surveyor) has filed with this Board a report specifying that sidewalk and related curb repairs have been made adjoining the real property (AR?NT 035-422-007) located at 1503 Camelia Court, (Oakley area), costing $1,402.46 (including property tax roll collection fee) proposing that this sum be assessed and levied against the said parcel of real property, and indicating that timely notice of hearing on this date spat 9 a.m.) before this Board was provided to the real property owner Aristides and ,stella lielgado in the manner required by law. At the time fixed for hearing on this date, this board heard the report of the Public Works Director and any objections or protests by the involved property owners and other interested persons and closed the hearing. Our Department notified a number of property owners in the area that the sidewalks in front of their homes were in disrepair and required replacement. In zany-cases, the sidewalks were badly cracked and broken, were a hazard to the public and presented the County with a liability problem if lei unrepaired. Among the property owners notified were Aristides and Estela Delgado. In accordance th the Streets and Highways Code of the State of Calibornia, it is the responsibility of the property owner to maintain the sidewalk fronting their property in a safe condition. Since our initial notifications in 1997, all of the residents we contacted :have complied with our request to replace their hazardous sidewalks with the exception of the I7elgados and one other property owner. We give the property owners ample opportunity to replace their sidewalks since it's usually less expensive for them to arrange for the work. We sena numerous notices to these property owners with the hope of eventual compliance, When it finally appeared that the sidewalk was not going to be repaired, we requested bids r'rom licensed contractors to make the repairs. The lowest quali=red bidder was selected to complete the repairs afer proper notification and posting of the property- We have billed the Delgatos for $1,151.7 3, which represents the total cost of the repairs, including administrative costs, as allowed by the Streets and Highways Code. Since Mr. and ?'yrs. Delgado have not paid their bill after many attempts of collection, we recommend that the cost of repair together with a property tax roll collection fee of$250.76 be assessed against their property as a lien.
