Count-y� Couaael B � DEPUTY Ce\C%p oc\f'a.rr.bo D Report on Farr Notal Fabrication Shop San Ramon/BoUlzger Canyon area C A=a4lz 4n t-�ky Wei The origins of: the dispute stem from a complaint which was registered with the County concerning a metal shop operation which had been established on a property owned by Charles and Lorraine Farr that is zoned Agricultural Preserve (A-4) . At that time, the County advised the Farrs that they needed to eliminate the operation, or could try to legalize it by obtaining an appropriate land use permit under the zoning. W=01 In 1986, the Farrs filed an application for a land use permit (File #2144-86) to try to legalize the use as a hone occupation. The totter was heard initially by the Zoning Administrator who denied the application. That decision was appealed by the Fairs to the San Ramon Valley Regional Planning Commission who reversed the zoning Administrator' s decision, granted the appeal, and conditionally ,approved the project , The neighbor appealed that decision to the Board of Supervisors . On November 3 , 1987, the Board granted the neighbor' s appeal and denied the land use permit application. At the same time, the Board directed the Community Development Director and County Counsel to determine whether changes should be made in zoning and land use permitting to allow agriculturally related land uses . The Board also ordered that staff delay enforcement of the land use permit denial pending the reults of the evaluation. �' - in response to a subsequent staff report on the matter, on December 19, 1989, the Board of Supervisors directed staff to defer review of the zoning changes or enforcement action pending review of the proposed general plan review then underway. JDQ!0-1�v In 1991, the Board of Supervisors adopted an update to the County General Plan. Among the policies adopted in the plan is Conservation Element Implementation Measure #8-aa pertaining to provision of agriculturally related businesses in areas designated for agricultural use. in 1996, the Farrs applied to the County to obtain a land use permit to allow the establishment of a second and third residence on the subject property (File KP962029) . After conducting na hearing on the application, the Zoning Administrator conditionally approved the application subject to conditions . No appeal was filed on the decision, so it became final . The project was conditioned to require the applicant to follow the appropriate procedures for trying to legalize the metal fabrication shop once agricultural zoning was modified to comply with the above described Conservation Element policies (CCA #5) , The land use permit was conditioned to allow for a period of five years (until October 17, 2001) in which to exercise the land use permit . To date, the applicant has made no effort to exercise this land use permit . -2- ADDENDUM ITEM Dai August 3, 1999 Agenda Ors July 20, 1999,the Board of Supervisors continued consideration of Inding that the use of a Metal :fabrication Shop at 18311 Bollinger Canyon Road it the San.Raman area precludes a finding that the use is agriculturally related; and consideration of directing the Building Inspection Department Director to in medialtely investigate and initiate code enforcement actions. Dennis Barry presented the staff report and reco-m endations. The Board discussed the metter. Victor Westrnan., County Counsel advised the Board that'the recommendation was not for enforcement of the cede,but to initiate ars investigation and potential cede enforcement actions, for a subsequent hearing. Supervisor Uilkema seconded the motion, and requested that it include a request that Mark Chewing, Regal Steel Supply, provide staff with his knowledge of projects fabricated at fac subject shop. Supervisor Gerber agreed. The Board took the following action: IT IS BY THE BOARD ORDERED that staff s Recommendation No. 1 is DELETED; and staff's Recommendation No, 2 is APPROVED, and the Building Inspection Department Director is DIRECTED to initiate appropriate action; and Mark Chewning, Regal Steel Supply, is REQUESTED to provide staff with his knowledge ofprojects fabricated at the subject shop. Speech to Contra Costa Board of Supervisors Tuesday, 03 August 1999 Good Morning. My nanne is Michael Warholic, and my wife and I live down wind, down slope, and Immediately adjacent to Mr. Farr's property. [Its approximately 120 feet from our living room window to both of his fabrication work yards) * It's difficult to summarize 18 years of facts into 3 minutes but I'll try my best. * With the packet you have ir+front of you, please follow along as I proceed, and I thinly we can quickly get to the heart of this matter. What is the Issue before us?A recent newspaper article in the Tri-Valley Herald, titled "Metal shop a safety threat, neighbor says" provides some background. In this article, Mr. Farr claims that his business has not changed since 1983, He would like you to believe that he has been supporting his family by repairing farm equip€nent, helping neighboring ranchers build bridges across creeks, and performing miscellaneous welding gobs such as gates, fences, and ornamental window guards. Well, ladies and gentlemen of the Board, the mass of evidence that I have accumulated proves otherwise. My wife and I did conditionally support Mr. Farr back in '86 when it WAS just a small family run:business. Since then,however,it has charged and changed drastically. The business has grown to where this large industrial operation n is now cutting, grinding, welding, descaling, and spray painting more tonnage of heavy structural steel beams than ever before. The noise is unbearable and penetrates even room of our house,every with the door's and windows closed. Pain fumes are terrible. Please look at Exhibit G, taken in September '97, it shows a large C.M. Farr steel beam structure at a commercial location in Danville. This is not a gate,fence, nor ornamental window guard! CCCO .N-3 Michael J.warholie Page 1 ® I have also personally observed C.M.Farr while they were building the Horde Depot in San Ramon and other large commercial structures. In fact, we had to endure the Home Depot project for the better part of a year. Please look at Exhibits H through N. They were taken on May 22 d by my bather, while standing on our deeded easement road to our property that passes between both of Mr. Farr's work yards. ® I, on the other hand, was lying in the emergency room at the Sara Ramon Malley Regional Medical Center trying to recover from inhaling the toxic part fames that drifted across my property. I'm still not satire about any long-term effects this may have caused, and just don't want anyone to experience that again. As you can plainly see in Exhibits G through N, these structural steel beam's are not gates, fences, nor ornamental ental winto guards. Besides, when was the bast time you save ornamental window guards in San.Ramon? * Notice all the paint residue on the gavel in Exhibits I &J. The Material Safety Data Sheet. (Exhibit S) for the Red Oxide paint medicates that these fees and residues are highly toxic. With the Board's efforts at keeping our streams safe, I'an same you da not want all these residues leaching into our ground water and flushing down to the strew Haat mans the length of Ballinger Canyon. I seise don't. * With the indisputable evidence in your Staffs possession, please enforce the current agricultural zoning laws and initiate code enforcement action. * We sincerely pray Haat your will vote in the affirmative with your Staff recommendations, as we just can not continue to Hve under these conditions.any lunger. Warholic Contra Costa County Board of Supervisors Meeting 03 August, 1999 Item # D.3 Michael J.Warholic Contra.Costa.Board of Supervisors Meeting,03 August, 1999 page I of 7 Peace and Tranquility of Country Living Shattered by Noise and Toxic Fumes * The peaceful agricultural lifestyle we thought we were getting when we moved into our Bollinger Canyon agricultural property 18 years ago has, over the years, been increasingly degraded by the C. M. Farr metal fabrication operation that Mr. Farr, our immediate neighbor, operates out of his hone. Typically the tranquility is shattered when Mr. Farr,s two regular outside employees arrive, between 6 AM or 7 AM and goes until 4 PM or 5 PM, b days a week. Many times, Mr. Farr then continues to work by himself, generating more noise and fumes, till dark and beyond sometimes, depending on the time line of a particular job. Sometimes he even works on Sundays and holidays. The level of activity has increased exponentially to the point where we can no longer tolerate the situation. * The C. M. Farr metal fabrication operation will often use his huge and very noisy big rig erection crane tick (I estimate it weighs over 12 tons) at this site. We can hear it from the moment it starts till it is shut off, even inside our house with the doors and windows closed. The huge crane and are-welding machine that is mounted on it are extremely noisy when in operation. Many times it runs continuously for hours and hours. again, we can not get away from the extreme noise even in the sanctity of our oven hone. * We can not sit out on our patio to enjoy the fresh air, read a book, enjoy some conversation, have a mal, listen to soft music, have a birthday party, or anything else without berg constantly subjected to extremely loud and irritating noises. Furthermore, we end up having to breathe the foul, toxic, and hazardous fumes and grinding residues that result from his metal fabrication operation. * We are concerned about the potentially damaging effect on our hearing and health with the long-tern exposure we have had to the incessant noises as well as all the exposure we have had to the toxic furnes and grinding dusts. e. Yes, there are some short breaks in the noise and fumes when Mr. Farr and all his employees are at the commercial or industrial site erecting the fabricated structural steel beams, when Mr. Farr is between jobs, away on vacation., or schedules some quiet time for has own family, but those breaks are fear and far between. Furthermore, they are always short-lived and we never know when the quiet will be shattered. We cannot make any type of advanced plans for any kind of outside activities for fear of being drowned out by all the loud noise and being subjected to toxic fumes. Farr Metal Fabrication Operation First of all, beep in mind that our property is down wind, dowry slope., and immediately adjJacent to Mr. Farr's property. The C.M. Farr metal fabrication main work yard is approximately 120 ft. from our living room window. For ethers who live outside earshot up and down the canyon we suggest that you consider: It's easy for anyone to support an operation that you can not lyse°. It's easy for anyone to support an operation that does not overwhelm him or her with toxic fumes. ® It's easy for anyone to support an operation that does not threaten their health and safety * It's easy for anyone to support an operation that occasionally provides him or her with some, ftee minor welding repairs, * Supporters would have a completely different opinion if the operation was located within 120 foot of their living rooms! cf;aex 1.Warholic Contra Costa Bid sof Supervisors meeting,A133 August, 1999 page 3 of 7 Additional Reasons to Enforce Removal of this Industrial Operation from Agriculturally Zoned Property o people have asked us why we have put up with this operation so long. We were trying to be good neighbors and kept thinking that they would move the operation to a suitably zoned industrial location log.g before they ever got this large. a We were on the verge of filing a for al complaint with the county when, quite frankly, the crowning blow came on May 22, 1999. It was then that Mr. parrs toxic paint femmes overcame me in my front yard and caused me to be rushed to the hospital. * Mr. Farr violates practically every criteria listed in theCounty's brochure for establishing a home occupation (See copy in package). * Not only are we subjected to excessively loud noises and noxious fins, but we are also faced with having to endure steel grinding dust drifting over everything. Furthermore, we have recorded voltage fluctuations on video with audio (time and date stamped) that cause the lights to flicker inside the house when C.M, Farr Metal Construction is performing certain kinds of operations. e `thousands of tons of iron on a regular basis are delivered to and slipped out of C.M. Farr Metal Construction located at 18311 Bollinger Canyon road on big rig trucks with flat bed trailers. These huge, very heavy, tractor-trailers are not only going up and down. Bollinger Canyon load with an ever-increasing frequency, but they are also going in and out of our shared driveway. * On two different occasions, I was personally nearly run over by a big rig loaded with steel coming down our driveway. • Once 1 was on foot and able to jump out of the way. • The other time I was in my car, and in my lane, and it was only that the driver was able to lock up the braes and get stopped that prevented a major tragedy. * What is this heavy tonnage doing to Bollinger Canyon Road? * What happens when one of the big rias has an "incident" with one of the residences or visitors of the canyon, with one of the many picnickers at Little Hills Ranch, or with one of the many hikers,joggers, or bicyclists that frequent the Canyon road. Michael T.Wsr ohe Contra.Costa Bid.of supervisors Meeting,03 August, 1999 page 4 of 7 * Their open-air arc welding operations cause us continuous concern about flash burns to our eyes as well as to the eyes of our friends and visitors. * His high-speed open air grinding operations within 10 or 15 feet of the shared driveway put us, as well as our friends and visitors, at risk from injury from potential flying debris. * By initiating code enforcement actions and causing the operation to cease and desist at the 18311 Bollinger Canyon location, the Board of Supervisors will show that the laws of Contra Costa County are applied equally to all and will put the operation on even terms with all the other industrial metal fabrication operations within Contra Costa County that have abided by the laws all these years. I assure you that after examining it all, you will be convinced,just as staff was convinced, that the C. M. Farr metal fabrication operation is purely an industrial operation that has that has no right to be operating out of its present agriculturally zoned location. Examine C. M. Farr Metal Construction employee payroll records to determine who exactly is doing most all the work, His claims of his whole extended family actively working in the business will be proved otherwise. xar ne C. M. Farr Metal Construction delivery records from one of his Iain structural steel suppliers. That supplier is PIMPS Steel Service Center, located at 3535 E. Myrtle, Stockton., CA. Their phone number is (800) 800-4736. e You will be astounded by the sheer tonnage of his deliveries, I estimate it will amount to millions of pounds of structural steel beams over the last few years. * Examine C. M. Farr Metal Construction delivery records from his main welding supply house. That supplier is Death Welding Supply, located at 5743 Dublin Boulevard, Dublin, CA. Their phone number is (925) 829-5510. Those records will show the large volume of welding rod and welding gasses being consumed by C. M. Parr Metal Construction, proving agar that it is a large-scale industrial operation. Note where the listing, Farr C M Metal Construction is placed. It is placed under the heading Steel Fabricators and there is no listing placed udder the heading of Welding. Now look at the Sunday, July 25, 1999 article from.the Tri-Valley Herald titled "Metal shop a safety threat, neighbor says' (copy included i this package). Mr. Farr is quoted as saying, "'When you need a welder, you need one now, not next week7. Well, when someone needs a welder, it would be logical to look in the Yellow Pages under the heading of Welding, not under Steel Fabricators, as he is currently listed. This is clearly ars industrial operation. Tuesday, August 03, 1999 I just became aware of this article that came out in yesterdays San Damon Valley Times at 9:30 last night. I would like to make a couple short comments trying to clear up some of the many inaccuracies contained in it. The main point that I want to stress is that the easement issue refereed to in the article is a stand alone issue, that never has, nor does it now have, any relationship to the much more serious health and safety issue of needing to get the C. M. Farr industrial operation immediately removed from the agriculturally zoned property. Resides, we have a deeded easement to our property that came with it when we bought it, over 18 years ago. Access to our property is not in question and never has been. We could not care less, at this time, about the easement issue that the newspaper article is referring to. We must first secure our health and safety, and the health and safety of our friends and visitors by getting the C. M. Farr industrial operation immediately removed from the agriculturally zoned property, before we put any more efforts into trying resolve this very much secondary issue. We have tried to make it clear to everyone from the start,that the easement issue canoe up during the Farr subdivision talks with the County almost two years ago, and has nothing at all to do with anything else. We in fact supported the Farr subdivision, but requested that the Farrs grant us a legal easement to something we had been using for years and years. They agreed to that stipulation and others, they got their preliminary subdivision approval, and we were to get an easement from them.. But, as usual, almost two years since they made that promise, they still have not Dept to their end of the bargain. In fact, the Farrs are now demanding, as of Monday, August 2 , 1999,that we also grant them an easement. That was never part of the agreement that Supervisor Gerber helped put together between the Farrs and us! Supervisor Gerber also suggested some time back that I discuss all the issues we have with the Farrs in an effort to try and resolve them. I attempted to do that at my last face to face meeting with Mr. and Mrs. Tarr, held in the conference room at Supervisor Gerber's office with wren McPherson, Community Liaison, chairing. The Farrs stormed out of that meeting before any of the main issues could be discussed. "_Mike"Farr We are residents of Bollinger Canyon, and neighbors of Nike and Dori Farr, We have become aware that Mr. Warholic has made a series of allegations relating to Mr. Farr's welding business in an apparent(and we believe malicious) effort to force Mr. Farr to relocate his equipment. Flowers from Lori's verdant garden(which seems to have escaped the toxic dust and fumes which allegedly overcame Mr. Warholic) adorn our kitchen as this letter is typed. Mike showed up with a chain saw, his usual enthusiasm, his constant;work-ethic, and his(apparent)God-given ability to do anything, and the tree was cut, and the disaster averted in short order NNIhile we have called upon Mike to assist in the most mundane of agricultural and non- agricultural repair projects on out property (including the repair offences,the repair of our old illys farm trucks and the installation of a culvert pipe to Facilitate drainage around our house,we have also enlisted his assistance on more gargantuan projects which required someone who understands physics, structural engineering, and mechanical engineering, and who is committed to doing it right, doing it safely, and doing it legally. We drop in on bike while he is at work in his shop periodically, and have yet to see his work area in any tyke of disarray, We have no worry for our safety when we barge into like's place unannounced, and have yet to suffer any type of malady, or be€vercome by airborne toxins, on these frequent occasions. The fact ofthe matter is that Mike Farr does more than just run an orderly and safe welding business on his property. He is€a friend of the land,the streams, and the neighbors—with one exception, of course, Last year on a weekend Mike and one of his helpers trimmed tree branches which obscured portions of the two-lame canyon road, which, before cut, created potential blind spots for drivers,because Mike knows that the serenity ofour canyon is an attraction to both joggers and bicyclists (none of whom, I believe, have been hauled out of the canyon by ambulance after being poisoned by Mr. F'arr's business). We are one of many families in Bollinger Canyon who know and appreciate the beauty of this land, and who are committed to the continuing health and vitality of our ground water, air,and the ecological system which has evolved. Warholic, although on several occasions we have tried to do so. Dever the less, we feel very at home and welcome in Bollinger Canyon because of the support and friendship extended to us by like and Lori Farr. Mike and Lori have repeatedly helped us "city folk" adapt to country life. They have repaired our gate, helped shore-up our driveway and bridge (using a tool Mike fabricated in his shop), hauled material in their truck, and even removed rattlesnakes from our patio. The way we have been treated by mike and Lori is no different from the way they help and support everyone in the canyon.
