D ORDINANCE NO. 9Sa15- 8 OFFICE OF THE COLTNTY ADMINISTRATOR CONTRA COS'T'A CLT ' TO: Scott Tandy, Chief Assistant County Administrator FROM: Jason Crapo, Management Analyst REP: Proposition 10 Update DATE: ARust 16, 1999 Based on our discussion today with Chad Griffin of the State Children and Families First Commission, here is a summary of key issues and critical next steps related to the implementation of Proposition 10 in Contra Costa County. Organizational Development Current Status: T he pending Board appointment of members to the County Children and Families First Commission would constitute the third and final step required to obtain; $156,579 in planning funds from the State Controller (the other two steps being the adoption of a County Ordinance establishing a County Commission and the creation of a local Children and Families First trust fund), These funds can be used to help create an organizational structure for the Commission. Next Steps * First Commission meeting (week of September 71h). * Create an advisory committee structure. * Address State advisory opinion on Commission staffing. Develop a process for citizen participation. Strategic Planning Current Issues; The State Children and Families First Co nmission is in the process of developing draft guidelines for the submission of County Strategic Plans to the State Commission. Final ,guidelines will be approved at the September i 6` State Commission meeting. Submission of a County Strategic Plan to the Stag Commission is required prior to use of Proposition 10 funds to provide program services. The appointment of the County Commission by the Beard will put Contra Costa County in a position to respond quickly to these guidelines. Next Steffi Develop a strategic planning process, including guidelines for public participation, o balance the need for planning with prompt use of available resources, consider submitting a one-year plan to gain access to program funds and then complete a long-term plan at a later date, Financing Current Status; This week, the State Commission is scheduled to approve a plan for releasing Proposition 10 funds to the counties. All funds accumulated to date from. the .50 cigarette tai will be released to counties, most likely in October, 1999. Over 300 mill on has been collected by the State sine January 1, 1999, The Stag Commission has yet to decide whether ongoing payments to counties will be made on a monthly or quarterly basis. Funds cannot be used by a county tis provide services until the county has submitted a strategic plan to the State Commission. DO California Children and Families ;ate Commission Date: Tuesday, .luly 27, 1999 JUL 2 9 1999 o: Victor J. Westman (AAM 4 Y COUNSEL Contra Costa County Counsel MARTINEZ,CALIF, From: Jane Henderson Executive Direct alifornia Children.and Families State Commission Re: County Commission Staffing Tbis memo is to advise you that our office is in receipt of your letter of inquiry dated.July 15, 1999,regarding county corn :fission staffing. In your letter, you present two scenarios and ask whether, under either of these two scenarios, the alifom-iia Children and Families Coranussion(°"State Commission") and/or the State Controller will fbm%ard and pay to the involved county commission its Health and Safety Code C H&S ') § 13€1140 find$in a timely manner. 1 will resi)ord to each scenario in turn. Scenano No. 1: A county board of supervisors adopts an ordinance establislaiing,a cownty comm.ission, appoints a majority of the members of the county commission, and establishes a local Children and Fwnilies Trust Fund(with its auditor's certification of these three actions having been submitted to the State Controller)and in addition, provides that its local commission s principa6 ad?n in istrative sta.Ting with be provided by its ccun,,staff or Gathers designated by the counity board. Under Scenario No. 1 as stated above, the answer to your inquiry is d4No." As reflected in Advisory Opinion 99-02, the California Children and Families Act("theAct')makes clear that each county con-mission is an autonornous entity, separate and apart from the county board of supervisors. TO require that the county corramission's principal administrative staffing be provided by the staffof the county board ofsupervisors or others designated by it would be to deny,in kart, the autonomy delegated to the county commission via the Act. Therefore, it is the state onunission's position that under Scenario No. 1,payment of H&SC § 1110140 finds would not be forthcoming as such wo=uld be inconsistent with the intent tuft the Act. Sccnaro No. 2: A county board ofsupervisors adopts an ordinance establishing a county comm ission, aW oirIs a rna or ity of the members of the county co=Iission, and establishes a local Children wid:an ihes Trust Fund(With its auditor's certification of these three actions having been, submitted to the State Controller),after which the county commission by its yawn express action indicates its approval an /car desig anion ofthe counter hoard of supervisors to Provide its principal administrative staffing. 335 N. Maple Drive Suite 350 Beverly His C gfl210 310-888x352. fax 310-2,05-2760 Under Scenario No. 2, as stated above, the answer to your inquiry is "Yes." Here, the county-commission does not surrender its autonomy regarding staffing decisions to the county board of supervisors. Instead, the county commission, by its own impress action, s ecliicaisy and voluntarily requests an6or designates the authority to Inane such staffing decisions to the county board oz supervisors. 'Wherefore, it is the State Commission's 'oosition that Scenario moo. 2 is in keeping with the intent and spirit of the Act, and that under that scenario, ayinent of H& C f 30 A funds to the county cornrnission would I e,made in a time frxne consistent with the Mate Controller's normal course of business.
