BACKGROUND.
Uncles the County Ordinance creating the Children and Families First Commission
(proposition 10),the Board of Supervisors will appoint rine members and their alternates.
The appointments being considered today will form the new Commission which will thea
need to be called to its first organizational meeting. Among the initial items of business will
be formulating operating procedures, creating a committee structure;; discussing a public
engagement process: commission staffing needs; and structuring the process to develop
a strategic pians. Staff from the County Administrator's Office can assist the Commission
s needed until an Executive Director is hired under contract.

`-irstCora ission('proposition 10 Commission)of Contra Costa County, Doctor Z erdling is a well
respected pediatrician in West Contra Costa County. He has served in leadership positions in the
local corm;r.nity, having served.on the Executive Corr-Mee of the fast Bay Fedi.a ries Society
and as President of the Medical Staff of Brookside Hospital (nova Doctors Medical Center- San
Pablo). He has expertise in child health and development issues and has participated in research
in this area.
The purpose of Proposition 10 is to create programs to enhance the hea'th and welfare of
children. Given that purpose, the ACCMA believes that rnedical issues will play a key role in
th deliberations of the roposition 10 Commission. Having the expertise of a of the
Commission will enhance those deliberations and also give the Commission the benefit of a
broad range of physician input through the ACCMA, Proposition 10 author Rob Reiner
considered the involvement and support of medical associations to be an essential element in the
success of this initiative, and he included language in:Proposition 10 calling for such
participation at the state and local bevels. The California Medical Association, ofvahich our
Association is a coo-onent, was a signator on the ballot argurnert in support of: r�oposition 10,

I have spent y entire adult life working with and on behalf of young children and their families. This includes
working with yoking chi°dren and their parents in all aspects of the child care delivery system. I have been an
Infant/Toddler and Preschool teacher, child care cuter director, as well as fund mise:and advocate.

Commission (Proposition IC Commission) is beginning to plan for the most important group
of people, children birth to five years of age and families. I feel passionately about
the nee& for early childhood services for all and desire to serve where my input can have
the most impact. In light of the latest finding on infant brain development, infant-mother
bond, infant mental wealth, etc. I want to :see that a wide array of services for families
with children birth to five receive funding.
First of all, 1 have the experience of being a former welfare mom and single parent of three
children: a child with a disability, a gifted child and a typically developing child.
I also have background of working with hundreds of families of young children, birth to
five years of age, in Contra. Costa County providing information, referrals and emotional
support and can therefore be a voice for those hundreds of families. I also bring the
sensibility of having served as facilitator to the Interagency Council of infant Services

The Contra Cost.County Board of Supervisors ordains follows (omitting the parenthetical
footnotes from the official text from the enacted or amended provisions of the County Ordinance
Code).
SECIMN I. Chapter 26-14 of the County Ordinance Code(as added by Ordinance No. 98-46)
is repealed, amended and re-enacted to read:

establishment of Conti Costa County's Children and Flies First Commission to implement
the provisions of Proposition 10 adopted on November 3, 1998 and its Division 10
(commencing with Section 130100)added to the Health and Safety Code.
(b) It is intended that appointments to the commission and any advisory committees
established by it shed, as deemed appropriate and with the discretion of the appointing body,
be diverse and balanced according to race,geography,gender,and ethnicity.
c) In developing,amending or otherwise revising the strategic plan,the commission
should endeavor to ensure that the play addresses children's needs in all the areas of the county,
with special emphasis on areas where service gaps and needs are the greatest,

(l) Recipients of project services included in the county strategic plan;
(2) Educators specializing in early childhood de=velopment;
(3) Representatives of a local gild care resource or referral agency,or a local
child care coordinating group;
(4) Representatives of a local organization for prevention or early intervention
for families at risk;
(5) Representatives of community—based organizations that have the goal of
promoting nurturing and early childhood development;
(6) Representatives of local school districts;
() Representatives of local medical,pediatric, or obstetric associations or
societies;
(8) Representatives of local mental health and/or substance abuse
organizations; and
(9) Representatives of parent advocacy groups.
(d) Cor fission appointments pursuant to subsection(c)may be made by the board
in accordance with a procedure specified by board order or resolution.

(a) The board shaill appoint one alternate commission member for each of the
following membership categories as below provi

(2) For each member appointed pursuant to subsection(c)of section 26-
14.006,an alternate selected in the same manner as provided for direct
commiission appointment by board order or resolut on pursuant to
subsection (d) of 26-14.006.
In accordance with section 26-14.016,an alternate may attend commission
meetings, and may receive expense reimbursement and any allowed per diem but
may not participate in commission decisions or votes mess substituting for Its
absent regular comrtudssiora member.

(a) Commis orner members shall serve at the pleasure of the board and are subject to
removal dig their terms or other tenure of commission office by the board at its
pleasure. If a ember's term has expired,the member shall continue to serve

serve at the discretion of the chair for a period not to exceed one year.
(o) The wee commission members appointed pu-rsuant to subsection. )of section
26-14.006 shall serve without term limit but only as long as they bold their
specified county offices.
(d) The initial appointments of the five oommmss€oners specified in subsection(o)of
section 26-14.006 shall be of two for four year terms and three for three year
terms: Thereafter,all subsequent appointments shall be for three year terms
except to fill terga va=cies,

(a) A vacancy on tie commission shall occur automatically if any of the following
events occur before the expiration of s members term or other tenure of
commission office:
1. Removal of the incumbent by the board of supervisors for any reason;

3. Ceasing to be a representative from the vac=s categories specified in
section 26-14.006.
(b) The executive director of the commission shall certify the occurrence of any event
creating a vacancy on the commission and shall notify the board.
(c) Any vacancies shall be filled by the board for the unexpired terms,or other tenure
of commission pursuant to section 26-14.006 and this chapter.

(a) The commission shall meet at least every quarter and more often as necessary to
performer and complete its duties as required by this chapter and law. The
commission shall select its chair and vice-chair.
A majority of the members of the commission shall constitute a quorum. All
actions and decisions of the commission shall be by a majority of five votes.
(c) Procedures for the conduct of business by the commission not specified in this
chapter may be contained in bylaws adopted by tine commission.
(d) The commission may establish standing or ad hoe committees of its mem hers.
(e) Thecommission shall establish one or more advisory committees to provide
technic and professional expertise and support for any purposes that will be
beneficial in accomplishing the purposes of this chapter. As deemed necessary or
appropriate by the commission., each advisory committee shall meet and shall
make recommendations and reports to the commission.

L6-14.020 Financial Intere5t Rep-o-ting. Members of the concession and its
executive director shall be subject to the financial reporting requirements of the political Reform
Act and shall make the same level of reporting as required of members of the board. In a timely
mariner,the commission shall prepare a corAlict of interest code for approval by the board as
specified by state lam,. (Ord. 99-15 § 1.)
(a) Executive Director and. staff. Cora°.,rission staff shall consist of an executive
director employed by the board,to serve at its pleasure, and such other staff or
consultants as deemed necessary or appropriate by the beard.,with input from the
commission. All employed professior:al staff of the commission shall be exempt
and excluded Lrom the county's merit system. Commission staff may be
employed as county employees or contract consultants. The executive director
may utilize ether county employees as permitted by their appointing authorities to
assist in carrying out the purposes of this chapter.
(b) County Support Services. Support services usually provided to county
departments will be available as necessary to the commission including fi ancial
services by the auditor-controller and the treasurer and any legal services required
shall be available from the county counsel's office.
(c) A. 1 county costs to provide the staff services authorized by subsections(a)and Cb)
to implement this chapter shall be reimbursed and paid by the auditor-controller
f`om funds in the local Children and Families First Trust Fund. The executive
director shall, at least montF ly,direct the auditor-controller to reimburse the
county for any and.all staffing costs. Such reimbursement shall be accomplished

Based on our discussion today with Chad Griffin of the State Children and
Families First Commission, here is a summary of key issues and critical next
steps related to the implementation of Proposition 10 in Contra Costa
County.
Organizational Development
Current Status:
T he pending Board appointment of members to the County Children and
Families First Commission would constitute the third and final step required
to obtain; $156,579 in planning funds from the State Controller (the other
two steps being the adoption of a County Ordinance establishing a County
Commission and the creation of a local Children and Families First trust
fund), These funds can be used to help create an organizational structure for
the Commission.
Next Steps
* First Commission meeting (week of September 71h).
* Create an advisory committee structure.
* Address State advisory opinion on Commission staffing.
Develop a process for citizen participation.
Strategic Planning
Current Issues;
The State Children and Families First Co nmission is in the process of
developing draft guidelines for the submission of County Strategic Plans to
the State Commission. Final ,guidelines will be approved at the September
i 6`� State Commission meeting. Submission of a County Strategic Plan to
the Stag Commission is required prior to use of Proposition 10 funds to
provide program services. The appointment of the County Commission by
the Beard will put Contra Costa County in a position to respond quickly to
these guidelines.
Next Steffi
Develop a strategic planning process, including guidelines for public
participation,
o balance the need for planning with prompt use of available resources,
consider submitting a one-year plan to gain access to program funds and
then complete a long-term plan at a later date,
Financing
Current Status;
This week, the State Commission is scheduled to approve a plan for
releasing Proposition 10 funds to the counties. All funds accumulated to
date from. the .50 cigarette tai will be released to counties, most likely in
October, 1999. Over 300 mill on has been collected by the State sine
January 1, 1999, The Stag Commission has yet to decide whether ongoing
payments to counties will be made on a monthly or quarterly basis. Funds
cannot be used by a county tis provide services until the county has
submitted a strategic plan to the State Commission.

these three actions having been submitted to the State Controller)and in addition,
provides that its local commission s principa6 ad?n in istrative sta.Ting with be provided by

Under Scenario No. 1 as stated above,the answer to your inquiry is d4No." As reflected in
Advisory Opinion 99-02, the California Children and Families Act("theAct')makes
clear that each county con-mission is an autonornous entity, separate and apart from the
county board of supervisors. TO require that the county corramission's principal
administrative staffing be provided by the staffof the county board ofsupervisors or
others designated by it would be to deny,in kart, the autonomy delegated to the county
commission via the Act. Therefore, it is the state onunission's position that under
