AUTHORIZE the Public Works Director to arrange for payment of a $25 fee to Community
Development for processing, and a 25 fee to the County Clerk for filing the Notice of Exemption.
DIRECT the Clerk of the Board to publish the Notice to Contractors in accordance with Section
22037 of the Public Contract Code, and
ADVERTISE for bids to be received on Tuesday, September 21, 1999, at 2:00 p.m.

The estimated contract cost of the project is $122,600, funded by local funds `100%).
III. REASONS FOR 1 ECOMM EN DATIONIBACKGROUND:
The project is needed to modify an existing traffic signal to provide a higher level of protection for
left turn traffic. The access is to a local school and local support is high.
The project has been determined to be in compliance with the General Plan and is exempt from
CEQA because the project consists of a minor alteration of an existing facility.
The Public Works Director has filed with the Board of Supervisors the Pians and Specifications
for the project.
The general prevailing rate of wages, which shall be the minimum rate paid on this project, have
beer, filed with the Clerk of the Board and copies will be made available to any interested party
upon: request.
IV. CONSEQUENCES OF NEGATIVE ACTION-

county area, near the Town of Alamo (Figures 1-3).

The project will modlify an existing traffic signal by drilling foundations, trenching for conduit and
installing pullboxes, installing detector loops in the street, install vehicular and pedestrian traffic
signal facilities, and other related work. All work will be completed within the public right of way.
It is not anticipated that any utility relocation will be necessary. Excavation associated with the
signal project is for foundations, conduit runs and pullboxes only.

Refining Company to completely close Waterfront Road, -except for emergency traffic, on Saturday
July 31, 1999 for the period of 6:00 A.M. through 6:00 P.M., subject to the following conditions:
1. Traffic will be detoured via neighboring streets.
2. All signing to be in accordance with the State of California Manual of Traffic Controls.
S. Tosco Refining Company shall comply with the requirements of"'the Ordinance Code of
Contra Costa County.
4. Provide the County with a Certificate of Insurance in the am, cunt of $1,000,000.00 for
Corn-irehensive General Public Liability which names the County as an additional insured
prior to permit issuance.

The CCTA requires a variety of right of way services but has no right of way staff and has
contracted with the County to provide these services. On October 27, 1998, the Board approved
the original agreement. The above-referenced amendment expands the tasks to be performed
and increases the total agreement value by $90,000 to $272,000. All other terms and conditions
of the original agreement remain in effect.
IV. Consequences of Negative Action:
Less efficient government because the CCTA would have to hire additional private contractors at
greater expense.

("CONSULTANT')entered into Agreement No, 86 on August 1, 1998;and
VYWEREAS,the parties entered into Amendment I on June 16, 1999 to reflect the edge in salmi rates charged
by ONS ,,TA ';and
NN'EREAS,the parties now ash to further amend the Agreement to increase the maximum eompewation; now
therefore be it
MUTUALLY AGREED.
(l) that Acle 3 of the agreement is amended to expand"Services by County"to include tasks set forth in the
attached letter from.Contra Costa Public Works Department dated June 22, 1999; and
(2) increase the Total Agreement Value by$90,000 for an overall Total Agreement Value of$272,€300; and
(3) that all other items and conditions of the Agreement shall remain in effect.

III, nd and Reasons for Recommendations: The State Route 4 east GAP Closure
requires demolition of property improvements within the right of way required for the project and
desires to contract with Joe Heim, Inc. to provide demolition services.
IV/ Consequences of Negative Actions Negative action will result in delay of the project time
schedule and funding by the Contra Costa County Transportation Authority. This could result in
substantial financ`al risks because we weld have to bid again for demolition contractors at
greater expense.

In. the early 1970's, Contra Costa County, in participation with the State of C ffcrnia, constructed
tine D b10 Road Interchange at 1680. The County and Caltrans shared the casts involved in the
acquisition of the riga of way and construction of the improvements. By mutual agreement set
forth in Section 11, Article 5 of the Cooperative Agreement #7-227323, executed March 31, 1976,
betNeen Contra Costa County and the State of California, the County was to convey right of way
acquired for the 1-680/Diablo Read Interchange project to the State, The transfer was never
completed. Caltrans has requested that the County complete this transfer of property rights.
IV� Consequences of Negative Actions
The County will be in violation of the conditions of the Cooperative Agreement #4-0127-CT Doc.
#7-227323, executed Larch 31, 1970.
