AUTHORIZE the Public Works Director to sign any escrow agreernents prepared for this project to permit
thesubstitution of securities for moneys withheld by the County to ensure perform ance under the contract,
pursuant to Section 22300 of the Public Contract Code.
DIRECT that, in accordance with the project specifications and/or upon the -execution of the contract by
the Public Works Director, any bid bonds posted by the bidders be exonerated and any checks or cash
submitted for bid security be returned.
Pursuant to Public Contract Code Section 41114, the Board DELEGATES its functions under Public
Contract Code Sections 4107 and 4110 to the Public Works Director or his designee.
Pursuant to Section 6705 of the Labor Code, the Board also DELEGATES to the Public Works Director
or to any registered civil or structural engineer designated by him the authority to accept detailed plans
showing the design of shoring,bracing, sloping or other provisions to be made for worker protection during
t1rcIrIch excavating covered by that section.
DECLARE that, should the award of the contract to be invalidated for any reason, the Board would not
-o the second listed bidder or any other bidder, but instead would
in any event have awarded the -contract t
have exercised its discretion to-reject all of the bids received. Nothing herein shall prevent the Board from
reawardilng the contract to another bidder in cases where the successful bidder establishes a mistake, -refuses

11 FINANCIAL IMPACT:
The protect,including engineering and appropriate overhead charges, is funded by Hazardous Elimination

and Safety(83%) and Local Road Funds (17%).

The plans and speciftations were approved and the project advertised for bids by the Board of Supervisors
on june 22, 1999. The bids were received and opened at 255 Glacier Drive, Martinez, California, on July
27, 1999. The construction bids received were as follows:

The Board of Supervisors on June 15, 1999 authorized the Public Works Director to execute a
Consulting Services Agreement with Nolte Associates, Inc. to provide construction management
support for the Camino Tassajara Road Realignment Project.
The current agreement provides Resident Engineering services for 45 working days or 360 working
hours, whichever occurred first. Due to the contractors current schedule, and delays caused by
the utility companies, the 360 working hours have been exceeded.
IV.
If the Consultant Services Agreement with Nolte Associates, Inc. is not approved, it may result in
the consultant not being paid for sem4ces rendered.

The estimated contract cost is $18,750.00 funded by FEMA (75%); $6,250 funded by Road
Funds (25%).

The damage to Christie Road occurred in the winter of 1998, This project consists of two
separated slip outs. The road will be relocated away from the most easterly of the two slip outs,
therefor avoiding any or in the creek area. The second slip out will be stabilized using the
recommendation of the geotechnical engineer.
IV, Consequences of Native Action:
If the Consulting Services Agreement with Terrasearch Inc. is not approved, the project can not
be completed and may result in road closure.
