Michael Walford,Public Works Director SUBJECT: Report on Sidewalk Hazard Abatement 737 Coventry Road, lensington Area This repo-,is in reference to the August 10, 1999 Hearing or,the confirmation of the sidewalk.repair cost for the hazard abatement at 737 Coventry Road, in the Kensington area. In early 1996,. we became aware through citizen complaints and field surveys of sidewalk problems m the Kensington area. Since 1996, our. Department notified approximately 50 residents in the Kensington area that the aging sidewalks in front of their homes were in disrepair and required replacement. In many cases, the sidewalks were badly cracked and broken, were a hazard to the public and preset-ted the County with a liability problem if left unrepaired. Among the residents not if"ied were Mohammed Ali Gardizi and Magdalen. Allen-Gardizi owning the property at 737 Coventry Road. In accordance with the Streets and Highways Code ofthe State of California, it is the responsibility of the property owner to maintain the sidewalk fronting their property in a safe cot dition. Since our initial notifications in €996, all of the residents we contacted have complied with our request to replace their Hazardous sidewalks with the exception of the Mr. Gardizi and Ms. Allen- Gardizi and one other homeowner. Normally, we give the property owners ample opportunity to replace their sidewalks since it's usually less expensive for teem to arrange for the work, Since 996,we.have sent n.unerous notices to these property owners with the Dope of eventual compliance. Whet, Mr. Gardizi and Ms. Allen-Gardizi failed to replace their sidewalk,we again sent follow up letters in late 1996 and posted their property in accordance with the Streets and Highways Code, lifter it was apparent that the sidewalk was not going to be repaired, we requested bids from 10 licensed contractors to make the repairs. The contractor who submitted the loge bid of $2,719 completed the sidewalk repair in February of 1997. We have billed Mr. Gardizi and Ms. Allen-Gardizi for $2,850.14 which represents the total cost, including administrative costs,as allowed by the Streets and Highways Code. Since Mr. Gardizi and Ms. Allen-Gardizi have not paid their bill after many attempts of collection,we recommend that the cost of repair together with a property tax roll collection fee of$250.76 be assessed against their property as alien.
