'a July 26, 999 TO: Board of Supervisors 'ROM- J. Michael Walford, Public Works Director SUBJECT: Report on Sidewalk Hazard Abatement a Ocean View Dr ve, Bay Point.Area. This report is in reference to the August 10, 1999 Hearing on tine confirmation of the sidewalk repair cost for the hazard abatement at 48 Ocean View Drive, in the Bay Point area. In late 1994, we became aware through citizen complaints of sidewalk problems in the.Bay Point area. Since JJanuary of 1995, our Department notified.approximately 7c6 residents in the Bay Paint area that the aging sidewalks it front of their horses were in disrepair and required.replacement. In many cases, the sidewalks were badly cracked and broker, were a hazard to the public and presented the County with a liability problem if left unrepaired. A- ong the resident notified was Kenneth :cson owning the property at 48 Ocean View Drive. in accordance with the Streets and Highways Code ofthe State of California, it is the responsibility of the property owner to maintain the sidewalk fronting their property in a safe condition. Since our initial notifications in 1995, all of the residents we contacted have corn lied with our request to replace their hazardous sidewalks with the exception of the Mir. Erkson and two other hone owners. Normally,we give the property owners ample opportunity to replace their sidewalks since it's usually less expensive for them Co arrange for the work. Since 1995, we have sent numerous notices to these property owners with the Dope of eventual co=npliance. When Mr. Erkson led to replace his sidewalk, we again sent follow up letters in 1996 and posted his property in accordance with the Streets and Highways Code. After it became apparent that the sidewalk was not going to be repaired,we requested bids L-om 10 licensed contractors to make the necessary repairs. The contractor who submitted the bid of$960 corn plet,ed the sidewalk repair in.October of 1996. e have billed.Mr. Erkson for$1,042.80 which represents the total cost, including administrative casts, as allowed by the Streets and Highways Code. Since Mr. Erkson has not paid the bill after many attempts of collection,we recommend that the cost of repair together with a property tax roll collection fee of$250.76 be assessed against his property as a lien.
