. Adopt the Categorical Exemption, Section 15304 Class 4e and Section 15305,
Class 5 prepared for this project as being adequate.
2. Approve rezoning application RZ9 3071 as recommended by the County
Planning Commission.
. Adopt the County Planning Commission's findings as set forth in Resolution
No. 20-1999 as the determination for these actions.
. Introduce the ordinance giving effect to the aforesaid rezoning, waive reading
and set date for adoption of sane,

The applicant is requesting a rezoning from R-B to C-M to establish consistency with
the General Plan designation of Public, Semi public for the portion of the site to b
used for highway 4 widening and Light Industrial for the remaining portion of the site,
The Zoning will also allow for caretaker units at the site,

The Zoning districts within the surrounding area consist of R-13 and ¢M. The current
use of the site for mini-storage with caretakers, is more consistent with the adjoining
Light industrial uses and Controlled Manufacturing zoning than the current Retail
Business ( - ) zoning. The rezoning also makes the zoning and General Plan
designation of Light industrial more consistent with one another.
The applicant's request was heard by the County Planning Commission on June 8,
1999. The Planning Commission, after evaluating the proposal and evidence
submitted, voted to recommend approval of the proposed rezoning to the Board of
Supervisors,

Findings� -.
A. Land Use Ptgmit Findings:
1. The proposed conditional land use permit is not detrimental to the health, safety,
and general welfare of the County. There is no evidence to suggest the
establishment of two caretaker's units at the site would be detrimental to the
health, safety and general welfare of the County.
2. The proposed use will not adversely affect the orderly development of property
within.the County. The two caretaker's units in compliance with the requirements
of the County Code, will not negatively affect the orderly development of the area.
3, The proposed use will not adversely affect the preservation of property values and
protection of the tax base within the County. The two caretsker"s units are not
visible from the public roadway, are adjacent to the freeway, are temporary in
nature, and provide a necessary security function.
4. The proposed use will not adversely affect the policies and goals set by the general
Flan. The proposed caretaker units are consistent with the County General Plan.
5. The proposed use will not create a nuisance and/or enforcement problem within
the neighborhood. The existing caretaker units were established without land use
permit approval. Approval of the land use permit, subject to Conditions of
Approval, will bring the use into compliance with County Code.
6. The proposed use will not encourage marginal development within the
neighborhood. The uses on the property are existing and temporary.
Development of any residual property after Highway 4 widening would meet this
standard.
T Special conditions or unique characteristics of the subject property and its location
or surroundings are established. The site and use contains special conditions in
terms of the property's location next to Highway 4 and zoning which make it
appropriate for the proposed uses.
GeneralConditions:
Development is approved as show: on plans submitted with the application, received by
the Community Development Department on larch 15, 1999 subject to final review and
approval by the County Zoning Administrator prior to the issuance of a building permit
and suhject to the conditions listed below.
2. Land Use Permit 2073-88 shah be null and void and replaced with this Land 'lvsse Permit.
3. This Land Use Permit shall only be effective if the rezoning for the property is approved
by the Board of Supervisors.
4. Both the applicant and the property owner are fully responsible for county staff costs-
Invoices(s) for any additional costs beyond the initial application deposit will be mailed to
the applicant and are due and payable 30-days following the date of the invoice. The
unpaid balance shall be collected prior to issuance of a,building permit or initiation of the
use, whichever cones first. The applicant can obtain the current status of staff costs on
this application from the project planner.
Caretaker MobilehomQ Conditions per Section 84-68.18:
5. The permit is issued to the applicant/owner Thomas Barnes only and may
only be transferred after review and approval of the Zoning Administrator.
Approval is limited to two living units on the property.
6. The motorhomes shall be removed from the premises if the self-storage
business chases or vacates the site.
7. The motorhomes shall each contain not less than 220 square feet of flour
area as defined by the Health,and. Safety Code, but not more than. 500
square Feet of floor area.
8. The motorhomes shall be situated on the property as indicated on the plot
plan submitted v4th the application.
3. The motorhomes shall sit on a temporary foundation only. A concrete
perimeter foundation or slab is not permitted.
10. The permit is granted for a period of four(4)years and the applicant may
request an administrative extension for four(4) additional years. After that
time the motorhomes shall be removed from the property. (The applicant
has the option of seeping approval to continue the use by land use permit
application at that time.)
11. Landscape planting shall be maintained and weeded within the frontage of
the property. The applicant is encouraged to improve (but not required) to
improve this area with additional shrubs,
12. All signs shall be subject to the review and approval oft he Zoning
Administrator. No other outside displays are permitted. Existing non-
professionally prepared signs and U-Haul temporary banners shall be
removed.

APPROVAL BUT ARE NOT A PART OF THE CONDITIONS OF APPROVAL. ADVISORY
NOTES ARE PROVIDED FOR THE PURPOSE OF IIFORl6JIENG THE APPLICANT OF
ADDITIO'INTAL ORDINANCE AND OTHER LEGAL REQLMENIENTS THAT MUST BE
NIET INVORDER.TO PROCEED WITH DEVELOPMENT.
a. Additional requirements may be imposed by the Fire District, the Health Department and
the Building Inspection Department. It is advisable to check with these departments prior
to requesting a building permit or proceeding with the project.
2. The Building Inspection Department will require two sets of building plans for all neva
storage building brought to the site, which must be stamped by the Commurr ty
Development Department and by the Sanitary District or, if the site is not within a
Sanitary District, by the County Health Department.
Survey stake references are required for the Building permit.
3. Any plumbing, electrical or building permits which were not obtained for hook-ups for the
tvao motorhornes shall be obtained to assure life and safety standards are met.
