This matter concerns two appeals of two proposed single family
residences on adjacent substandard sized lots in the East. Richmond.
Heights area which were approved by the County Planning Commission.
The appeals were filed by neighbors of the affected lots . The
Commission ion approvals allow for a two-story residence on each lot .
T ae background leading up to the Board searing is contained in the
staff report dated May 25, 1999 . The report to the Board
identifies two alternative actions which the Board could consider
relative to these projects .

the Compa-ibility of the proposed residences re.11_ative to the
ex-sting neighborhood, and suggested that the applicant reduce the
volume and mass of the proposed residences, and work wit-In the

On May 25, 1999, the Board of Supervisors continued to this date, the hearing on the appeals by
Helen and Ceciloppla, et al, from the decision of the Contra Costa County Planning
ommission can the application ofHeberth Barragan(applicant and Owner), for a small lot
review for byvo,two-story single family residences can adjoining bats (#DP 98-3004 and# p'
98-3005) Eastic'-=and Heights/Kensington area.
Dennis Barry, Community Development Department Director,presented the staff report and
indicated that a possible agredrnent had been reached for one of the appeals, #DP 98-3005, the
proiect at 1530 Laurel.Avenue, East Richmond Heightsfi ensington area.
Robert Drake of the Community Development Department,the appellant Cecil Coppla, and the
applicant's attorney Edward Shaffer of Norris &Norris,were also present for the hearing.
Supervisor Gioia advised.the Board that he attended a meeting with the subject parties to discuss
the issues. He then moved that the Board accept the modified Conditions of approval and deny
the appeal or,# p 98-3005,pursuant to the July 27, 1999, tetter frons Edward Shaffer(as
attached), andd to continue the hearing or.the appeal of#DP 98-3004, 6453 Kensington Avenue,
East chmond Heights/Kensington. area, to august 17, 1999, at 1:00 p.m.
Supervisor Uilkema seconded the motion.
The Board then took the following action:

1. The proposed front elevation shall be similar to that shown on submitted plans
received.April 1, 1998 by the Community Development Department. prion- to
the issuance of a building permit, elevations and architectural design of the
building shall be subject to the final review and approval by the County
Zoning Administrator. The architectural details of the front elevation for
DP983003, DP983004 and DP983005 shall vary in terms of size, shape,
placement of windows, doors, and trim. An effort shall be made to vary
textures, building Materials and colors to achieve a custom appearance sof the
front elevation..
2. The County Building Inspection Department requirements for a licensed land
survey and their building code regulations must be satisfied.
3. The roof gutter shall be collected in a closed conduit and conveyed to storm
drainage facilities Inthe Laurel Avenue right-of-way.
4. This application is subject to an initial., application fee of$306.00 which was
paid with the application submittal, plus time end material costs if the
application review expenses exceed 120% of the initial fee, Arty additional
fee due must be paid within 60 days of the permit effective date or prior to' use
of tire permit whichever occurs first. The fees include costs through perniit
