APPROVE the following three firms as highly qualified to provide architectural needs assessment program for the Sheriff Coroner's Crime Laboratory, with the first three listed in order of preference, as recommended by the County .Administrator: (1) SMP/SHG, Inc., San Francisco; (2) Fields Devereaux Harley Ellington, Los Angeles; and(3)Ehrlich Ro in er, Sacramento, 3. AUTHORIZE the Director of General Services or his designee to (1) negotiate an appropriate agreement with the firm listed first for architectural services at a pricewhich the Director of General Services determines to be fair and reasonable to the County, and (2) if staff is unable to negotiate a satisfactory agreement, to formally terminate negotiations with the first t"nm-. and undertake negotiations with the other firms, in the order of preference determined by the Selection Committee and as described in Government Code Section 4528,until an appropriate agreement is reached. 11. FMA ABI 391 sponsored by Assemblyman Hertzberg, would authorize the State to spend up to $500,000,000.00 to provide 90% matching fi .ds to local jurisdictions for crime lab construction. The bill passed the Assembly on June 21, 1999 with a vote of 56 to 9, The bill was approved by the Senate :public Safety Committee on July 13, 1999 with a vote of 14 to 0. As of the date of this board order's submission, the bill is being heard in the Senate.Appropriations' Committee. Authorizing negotiations with the top ranking architectural firms will have no significant financial impact. For many years, the County Administrator and Sheriff-Corner's Department have continued to explore options and means for replacing the Sheriffs Crime Laboratory that is thirty years old. Developing a needs assessment will -out Contra Costa County in a very good position if and when this legislation passes. A coalition including the Governor, State Sheriff's, Attorney General, L.A. Police Department, L.A. Sheriffs Office, Department of Justice, and Cal State University is pushing this bill and there is growing mo'-mentum in Sacramento for its passage. B. On July 9, 1999, a selection committee interviewed the three firms. Five firms were originally scheduled for interviews and two fin-ns declined interviews at the last minute. Each firm gave presentations designed to show why they are most able to provide the Services required, and the committee quizzed each firm on anticipated ,planning and design concepts and approaches to site problems. Following the interviews, the selection committee ranked the top three candidate firms in order of preference based on presentations during interviews, Statements of Qualifications, and responses from reference. C. The selection committee comprised of the Senior Deputy, Public Protection; Director, Capital Facilities and Debt Management; Director of General Services; and Sheriff Commander, Support Services Division participated in the interviews and post interview discussions. N- TCLA IMPACT, The Contra Costa County Regional Medical Center has 1,750 Sprinkler heads that would b reimbursed at a rate of 5 per Sprinkler lead for a total Cash payment of $8,750. In addition, the County will receive a distribution from a trust find established for the Cost of installation.. The Mount of distribution from the trust fund has not been established at this time. Preliminary estimates for replacement of the defective Sprinklers range from $50,000 to $75,000 depending on coordination necessary to maintain uninterrupted hospital operations. ATTESTED — PHIL S E'— PHIL BATCH P,CLE OF THE I�O�IUPERVISORS By 'DEPUTY 04' Contact: See pace 2 CC: PAGE: 2 DATE: JULY 27, 1999 SUBJECT AUTHORIZE A CLAIM FOR REPLACEMENT OF FIRE SPRINKLED LEADS AT THE CONTRA COSTA REGIONAL MEDICAL CENTER BACKGROUND, The U.S. Consumer product Safety Commission announced the nationwide recall of approximately .4 million Omega bred fire sprinklers manufactured since 1982 by Central Sprinkler Corp. This recall announcement follows the resolution of the lawsuit filed by the Commission against Central Sprinkler Corp. and its subsidiaries on March 3, '1998. The terms of the resolution established trust fund in order to reimburse consumers for costs associated with the recall. County Counsel has reviewed this information and has noted that the only other potential method for recovery of costs would require litigation with the contractor for breach of warranty. The costs associated with litigation as well as the uncertainty of judgement represents the risk for recovery of these costs. The submission of a proof of Claim and Waiver and Release fora guarantees recovery for the cost of the sprinkler heeds as well as e partial recovery of the installation costs. The Contra Costa Regional Medical Center fire sprinkler system was designed and installed prig to the recall notification date. Omega fire sprinklers have been installed in homes, schools, hospitals, dormitories, nursing norms, prisons, offices, hotel and Esther buildings, including the White House and Smithsonian Museum. As part of the settlement agreement, Central hes asked Underwriters Laboratories to withdraw its listing of approval for all Omega brand fire sprinklers.
