SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action:
APPROVE and AUTHORIZE the Chief Engineer to execute on behalf of the Contra Costa Clean Water
Program a Consulting Services Agreement with Merritt Smith Consulting to perform services mandated
by the Joint Municipal National Pollutant Discharge Eliminate System (NPDES) Permit issued by the
San Francisco Bay and Central Valley Regional Water Quality Control Boards for Contra Costa
County, eighteen of its incorporated cities and the Contra Costa County Flood Control and Water
Conservation District.
II. Financial Impact:
The cost is estimated to be $310,000 and shall be funded by stormwater utility fee assessments
collected by the cities and county proportioned to their respective populations.

III. Reasons for Recommendations and Background:
The United States Environmental Protection Agency issued the National Pollutant Discharge
Elimination System (NPDES) Regulations for stormwater discharges on November 16, 1990 requiring
Contra Costa County, eighteen of its incorporated cities and the Contra Costa County Flood Control
and Water Conservation District to implement their Joint Municipal NPDES permit for stormwater
discharges issued by the San Francisco Bay and Central Valley Regional Water Quality Control
Boards. The Permits seek to significantly reduce or eliminate all pollutants from entering the waters
of the San Francisco Bay - Delta Region.
One requirement of the Joint Municipal NPDES permit is to implement an effective Public Education
and Industrial Outreach Program. The Contra Costa Clean Water Program went through an extensive
selection process culminating in the recommendation that Merritt Smith Consulting and its sub-
consultants be retained for the 1999/00 fiscal year to provide such services.
IV. Consequences of Negative Action:
If the consulting services agreement with Merritt Smith Consulting in not approved, then all
municipalities will be in non-compliance with the Joint Municipal NPDES permits issued by the San
Francisco Bay and Central Valley Regional Water Quality Control Boards. Potentially, fines totaling
$10,000 per day and $10 per gallon of stormwater discharge for all affected entities could be imposed.

APPROVE and AUTHORIZE the Chief Engineer to execute a consulting services agreement with Matthew
Bolender to perform services authorized by the 1999/00 California Integrated Waste Management Board's
Used Oil Recycling Block Grant- Fifth Cycle to the Contra Costa Clean Water Program.
II. Financial Impact:
A grant of$164,633.99 has been awarded by the California Integrated Waste Management Board to the
Contra Costa Clean Water Program through its Used Oil Recycling Block Grant Program. The consulting

Ill. Reasons for Recommendations and Background:
The Contra Costa Clean Water Program has been receiving funds from the California Integrated
Waste Management Board's Used Oil Recycling Block Grant Program for the past several years.
The purpose of the grant is to provide funds to the cities and County to implement used oil
collection programs that encourages recycling or appropriate disposal of used oil. The three
primary activities during the past several years has been the certification of used oil recycling
centers, a school education program targeted to elementary and high school students and a
public education program promoting used oil recycling activities to the general public. The
response to the Program has been positive and the activities will be expanded in the 1999/00
fiscal year.
The grant will total approximately $164,633.99 during the 12-month period commencing July 1,
1999 and ending June 30, 2000. The consultant will be primarily responsible for the
implementation of all grant program activities. The Management Committee of the Contra Costa
Clean Water Program has unanimously recommended the Board of Supervisors continue its
contract with Matthew Bolender due to his past exemplary performance.
IV. Consequences of Negative Action:
Should the Board of Supervisors fail to approve this consulting services agreement, funding for
public educational programs will be lost.

cities and the Contra Costa County Flood Control and Water Conservation District.

111. Reasons for Recommendations and Background:

regulations required Contra Costa County, its incorporated cities and the Contra Costa County Flood
Control and Water Conservation District to obtain NPDES Permits for municipal stormwater
discharges. The Permits seek to significantly reduce or eliminate all pollutants from entering the
waters of the San Francisco Bay - Delta Region.
The Joint Municipal NPDES Permits were granted on September 15, 1993 by the San Francisco Bay
Regional Water Quality Control Board and January 29, 1994 by the Central Valley Regional Water
Quality Control Board covering all of the incorporated and unincorporated areas of Contra Costa
County.
Woodward-Clyde International Americas has provided technical services to the Contra Costa Clean
Water Program since its inception. This contract allows Woodward-Clyde International Americas to
continue to provide the necessary technical services for the 1999/00 Fiscal Year. The technical
services provided by Woodward-Clyde International Americas are specialized and critical to the
success of the overall Program.
