DSCSD has agreed that no property tax will b transferred to the District as the result of this annexation. Absent: Abstain: Contact: Tory Enna (336-1094) Attested: illy2Q, I ggg cc: County Administrator Phil Battchelor, Clerk of Auditor-Controller the Board of Supervisors Public defender and County d 'nistrator Building inspection By: � _, DEPUTY 17 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA ADOPTED this order on J u i y 20_1- 1999 by the following vote: AYES: SUPERVISORS GIOIA, UILKEMA, GERBER and GA GIAMILLA NOES: NONE ABSENT: SUPERVISOR DeSAULNIER ABSTAIN: NONE RESOLUTION NO. 99/3 7 C SUBJECT: Determination of Property Tax ) Exchange for Proposed Subdivision 7595 ) Annexation to the Discovery Bay ) Coramnity Services district LLAFC 9-11) ) WHEREAS,Section 99.01 of the Revenue and Taxation Code provides that a jurisdictional change resulting €rom a special district providing one or more services to an area where such services have not been previously provided shall not become effective if one or more affected special districts involved in the property tax exchange negotiation fails to adopt a resolution agreeing to a transfer; and WHEREAS, with the exception of the annexing districts and any affected cities, the Board of Supervisors shall determine the property tax exchange for each affected district that fails to adopt a resolution agreeing to a property tax transfer; and WHEREAS, Proposed Subdivision 7595 involves annexation to the Discovery Bay Community Services District (DBCSD), which will affect the service responsibilities of the District; and WHEREAS, the Discovery Bay Community Services District has agreed that no property tax will be transferred to it as a result of the annexation; THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY HEREBY DETERMINES that no property tax will be transferred to the Discover Bay Community Services District as a result of annexing the territory described in Proposed Subdivision 7595 Annexation (LAFC 99-111e This resolution does not change the property tax revenue accruing to other agencies serving the subject territory or the affected districts` right to collect taxes for existing bonded indebtedness. The property tax exchange agreement discussed above shall apply to affected territory as submitted or revised by the Local Agency Formation Commisslone I hereby certify that the foregoing is a tate and correct copy of an action taker and entered on the minutes of the Board of Supervisors on the date shown.
