Adopted this Resolution on July 20, 1999,by the following vote:
AYES: SUPERVISORS GIOIA, UIIXEMA, GERBER, AND CANCIAMILIA

SUBJECT: Accept Completion of Improvements,Road Improvement Agreement for LUP 2018-
95 and Declaring a Certain Road widening as a County Road, El Sobrante area.
(APN 431-070-023 and 431-100-001)

The Public Works Director having notified this Board that the improvements for LUP 2018-
95, with the exception of minor deficiencies, have been completed as provided in the Road
Improvement Agreement with Hope Lutheran Church of West Contra Costa County heretofore
approved by this Board; and
The Public Works Director having also notified this Board that an additional$1,000.00 cash
bond(Auditor's Deposit Permit No. 333892,dated June 24, 1999)was deposited by Hope Lutheran
Church of West Contra Costa County. This cash bond and the original $1,000.00 cash bond
(Auditor's Deposit Permit No. 3018383, dated September 23, 1997) for a total of$2,000.00 shall
assure the correction of cracked sidewalk and driveway depression eontage improvement
deficiencies;
NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED
as of July 20, 1999,thereby establishing the six-month terminal period for the filing of hens in case
of action under said Road Improvement Agreement:

BE IT FURTHER RESOLVED the payment (labor and materials) surety for $14,850.00,
Bond No. 4304875 issued by Indemnity Company of California be RETAINED for the six month
lien guarantee period until January 20,2000, at which time the Clerk of the Board is AUTHORIZED
to release the surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that the widening of May Road is ACCEPTED and
DECLARED to be a County road; the right of way was conveyed by separate instrument,recorded
on October 20, 1997, in Series No. 97-0202668-00 of Official Records for Contra Costa County.
BE IT FURTHER RESOLVED that the beginning of the warranty period is hereby
established and the performance/maintenance surety for $28,700.00, Bond No. 430487 S, dated
September 23, 1997 issued by Indemnity Company of California be RETAINED pursuant to the
requirements of Section 94-4.406 of the Ordinance Code until released by this Board.
