BACKGRD=IREASONS FOR RECOMMENDATIONS
Ernest Cheonis, a homeowner in a new subdivision in Alamo has
requested that the County quitclaim a scenic easement over a
portion of his residential property to him. The easement at this
site is one of several scenic easements which had been conveyed to
the County by the subdivision developer at the time that the
subdivision was established in order to protect several mature oak
trees within the subdivision including one on Mr Cheonis' lot.
Subsequent investigation of the tree by an arborist determined that
the tree at this site was dead. Earlier this year the applicant
filed an application for a tree permit (File ##HT980001) with the
County which was conditionally approved, and the tree later
removed.
Now that the tree has been removed, Mr. Cheonis is seeking a
quitclaim for the scenic easement affecting a major portion of his
rearyard. His request has been reviewed by the Alamo Improvement
Association who agrees that there is no need to retain the scenic
easement on the property.

The Board of Supervisors of Contra Costa County, RESOLVES THAT:
Contra Costa County accepted the Scenic Easement Regarding Development Rights
and Oak Tree Preservation by Board Order recorded December14, 1995, Series
Number 95 216306, of Contra Costa County Official Records. The portion of the
easement described in Exhibit°A" attached hereto is DETERMINED to be surplus and
no longer necessary for county or other public purposes and its estimated value does
not exceed $10,000.90
Pursuant to Government Code Section 25526.5, the Board hereby APPROVES the
quitclaim of said interest to Ernest Cheonis. The Board hereby AUTHORIZES the Chair
to execute a quitclaim deed on behalf of the County and DIRECTS'Current Planning
Division to deliver said deed to grantee.
The Board hereby FINDS that the proposed quitclaim will not have a significant effect
on the environment, that it was determined on August 3, 1998, to be categorically
exempt from the California Environmental Quality Act under State'CEQA guidelines
Section 15312 (Class 12) and DIRECTS the Director of Community Development to file
a Notice of Exemption with the County clerk and to arrange for payment of the $25.00
handling fee to the county Clerk for filing of the Notice of Exemption. The Zoning
Administrator FINDS pursuant to Government Code Section 65402 that this proposed
quitclaim is in conformance with the general plan.

Clear Mr. Lierly:
I am faxing to you at the suggestion of Bob Drake with whom I recently dealt in
obtaining a permit to remove a dead oak tree situated at the above premises (see
permit copy). Said dead oak tree is protected by a "Scenic Easement Regarding
Development Rights and Oak Tree Preservation" (copy attached) and is located in a
new subdivision, The Trails (Lot 7).
The easement was created to protect the tree which is being removed. Therefore, the
purpose for the easement has ceased to exist. Bob Drake has asked me to advise
you that his department is supportive of my motion to vacate the easement.
I herein request the County to vacate the above-referenced easement. Your
assistance in this matter is herein requested. Please advise what, if anything, I need
to do to have this easement vacated as soon as possible.

This request for comments made in your letter to AIA dated 6/22f48 was reviewed at the
Alamo Improvement Association's open Planning Committe t mooing on July 8, and at
our Board meeting on July 8, 1448.
We understand that the scenic easement was the area within the drip line of a large
Heritage Oak in the near portion of Lot 7,which was remov with a permit earlier in this
year. The easement covers most of the rear Yard of Lot 7, 1 nd is no longerjustified since
the tree was removed.
AIA recommends approval of the vacation of the easement d of the landscaping plan.
