I. RECOMMENDED ACTION
AUTHORIZE the Director, Office on Aging or his designee to EXECUTE
1997-99 California Department of Aging Standard Amendment Agreement#2
State Contract# SF 9798-07 (County#29-508-2) in the amount of$586,916.
The term of the Amendment Agreement is July 1, 1997 through June 30, 1999.
In addition, submit future Standard Agreement Amendments that only reflect
an adjustment of line items or increased revenues when amendments do not
result in a decrease in grant revenue or additional County cost beyond funds
already available in the approved budget for the Social Service Department.
II. FINAN TAI IMPA T
The FY 1997-99 Standard Amendment Agreement will provide$586,916 in
State funds to conduct programs and activities on behalf of county residents under
the Older Californians Act. There are no County funds required. Required match
is provided by subcontractor agencies if appropriate.

III. REASONS FOR RF OMMFNDATIONIBA K GROUND
State Standard Amendment Agreement#29-508-2 allows for the Office on Aging
to continue to provide the Health Insurance Counseling and Advocacy Program
(HICAP) and to retain administrative responsibility for the Alzheiers Day Care
and Brown Bag Programs. HICAP provides individual counseling to 1300
seniors and community education to 2000 people each year. Alzheimer's Day
Care provides day care for 65 persons who suffer from dementia. The Brown Bag
program provides 57,040 bags of groceries a year to 2400 low income people
age 60+. In addition Contra Costa County will receive funds to provide
additional programs i.e. Foster Grandparent, Senior Companion, Linkages,
Respite Registry and Respite Purchase of Services. The service delivery of
the new programs specified above are yet to be determined.

SUBJECT: APPROVE EXECUTION AND SUBMISSION OF FY 1998-99 TITLE V SENIOR
COMMUNITY SERVICES EMPLOYMENT PROGRAM GRANT APPLICATION

I. RECOMMENDED ACTION
APPROVE & AUTHORIZE Director, Office on Aging or his designee to EXECUTE and
submit the Title V Grant Application(County#29-002-111) (State#FF 9899-07)to the
California Department of Aging requesting $86,372 in federal funds to provide part-time
employment for thirteen(13) low income individuals age 55+for the County's FY 1998-99
Title V Senior Community Services Employment Program.
Upon receipt of the California Department of Aging's FY 98-99 Title V Standard Agreement,
AUTHORIZE the Director, Office on Aging or his designee, upon approval by County
Counsel or the Social Service Contracts Administrator, to EXECUTE the Standard
Agreement.
AUTHORIZE the Director, Office on Aging or his designee to EXECUTE and submit
future Standard Agreement amendments that only reflect an adjustment of line items or
increased revenues when the amendments do not result in a decrease in grant revenue or
additional County cost beyond funds already available in the approved budget for the Social
Service Department.
II. FINANCIAL IMPACT
There will be no financial impact on the County. Required match of$8,637 will be provided
through cash wage supplements and fringe benefits paid by public and private, non-profit
agencies which contract with County and who pay low-income elderly enrollees.

III. REASONS FOR RECOM IENDATION/BACKGROUND
Since 1997, the County, through its Office on Aging, has operated a Senior Community
Services Employment Program under Title V of the Older American Act.
Area Agency on Aging will be sub-contracting with the Private Industry Council (PIC) to
provide the Title V services. PIC currently operates JTPA I IA(five percent(5) set aside),
they will be able to bring these two programs together to provide comprehensive services to
the eligible older workers in Contra Costa County.

RECOMMENDATION:
1. APPROVE and AUTHORIZE the Social Service Director, or designee, to accept $360,000
of grant funding under the Kinship Support Service Program as authorized by AB 1193,
Chapter 794, Statutes of 1997.
2. APPROVE and AUTHORIZE the Social Service Director to EXECUTE Contract #21-
387-2 with FamiliesFirst, Inc, to include up to $345,600 of the grant funds received, and
raise the payment limit up to $674,584, for the period of July 1, 1998 through June 30,
1999.
F_NA_NCLA L IMPACT:
The $360,000 of Kinship Support Service Program funding is 100% State funding.
CHILDREN'S IMPACT STATEME
The work to be completed under this contract will expand the development of Kinship centers in
this county so that kinship care can be strengthened and the interests of children and their extended
families will be enhanced. In this respect, this contract is directly applicable';to all 5 community
outcomes because the basic protection of children is essential to ensuring: 1) Children Ready for
and Succeeding in School; 2) Children and Youth Healthy and Preparing for Productive
Adulthood; 3) Families that are Economically Self Sufficient; 4) Families that are Safe, Stable and
Nurturing; and 5) Communities that are Safe and provide a High Quality of Life for Children and
Families.

B C'KGROLfNTISLIMMARY:
As one of the 15 counties in the Mate with an average of 40 percent of their dependent children in
relative care placements, Contra Costa was eligible to submit a proposal for grants-in-aid funding.
The SSD applied for $230,400 of funding to support and expand the existing Kinship Care services
model. Both the grant application and the existing program were evaluated highly by the State
Department of Social Services. As a result the State Department of Social Services provided an
additional $129,600 beyond the amount requested, for a total award of$360,000. The additional
funding will be used to expand the existing service delivery model, add new service components,
and develop a program evaluation component.
Contract #21-387-1 is one of three which implements the State Family Preservation Permanent
Transfer Allocation as part of the County's Child Welfare System annual allocation. It established
the Kinship program in two locations in the county. The Kinship program uses a community-based
model to provide supportive services to relative caregivers and children in their homes to help
ensure permanent kinship placements for dependent children, and to eliminate the need for juvenile
court jurisdiction and continued SSD services from the county.

Kinship Support Services Program (KSSP)proposals submitted by Contra Costa county:

These funds are awarded in accordance with the provisions of Assembly Bill 1193
(Chapter 794, Statutes of 1997)and.the provisions of the Kinship Support Services Program

will be sent on July 28, 1998 if no appeals are filed. These funds are a one time only allocation
for fiscal year 1998-99 and will be awarded through the county allocation process.
Attached is information about the mandatory regional training for selected programs on
August 26 and 27, 1998 in San Francisco.

revised Scope of Work and Budget to be consistent with the funding award amount. If you have

1. RECOMMENDED ACTION:
Authorize the Sheriff on behalf of the County, to enter into an agreement with the California
State Department of Boating and Waterways for the purchase of a patrol boat and related
equipment. Authorize the Sheriff, on behalf of the County, to make and sign for any
amendments to the contract with the State which may come about in the grant.
II. FINANCIAL IMPACT:
The State would provide a financial grant totaling forty thousand dollars ($40,000.00) to the
County. The estimated cost of this patrol boat is forty thousand dollars ($40,000.00), therefore,
there should be no financial impact on the County.
Ili. REASONS FOR RECOMMENDATION:
The Marine Services Bureau has been authorized by the State to add two new full-time Deputy
positions beginning fiscal year 1998/99. This brings the current staffing level to one Sergeant,
six Deputies and two per-diem Deputies. With the added staffing level, an additional patrol boat
is needed.
IV. CONSEQUENCES OF NEGATIVE ACTION:
With the added staffing level it is necessary to purchase an additional patrol boat. This will
allow for enhancement of the County's Boating Safety and Enfon_>eme`Mt Programs.

The State currently has money to grant to the County. The State has agreed to provide the
County with a grant to purchase an additional patrol boat..,The.money may not be available at
a later date.

County. The estimated cast to replace a recently decommissioned patrol boat assigned to the
Sheriff's Marine Services Bureau is fifty-five thousand dollars ($55,000.00). Therefore, there
should be no financial impact on the County.
Ill. REASONS FOR RECOMMENDATION:
Currently, Marine Patrol has a state-owned boat that is scheduled for replacement, by the State,
due to its age and the related excessively high maintenance costs. The boat has been in
service for over twelve years. The State expects to replace patrol boats'after approximately ten
years of service.
IV. CONSEQUENCES_OF NEGATIVE ACTION:
The patrol boat, a 1987, 25 foot Farallon, Will no longer be maint� d- the State and will be
taken out of service. The State currently has money to grant to the County. The State has
agreed to provide the County with a grant to purchase a new patrol boat. "he money may not

RECOMMENDATION
Authorize the Chair of the Board of Supervisors to sign Contract
No. 98-0066. This contract in the amount of $10, 000 is effective
July 1, 1998 through June 30, 1999.
BACKGROUND
The County Department of Agriculture enforces regulations regarding
the use of pesticides . Growers are required to submit monthly
summaries of pesticides which have been used. In an effort to
expedite the processing of this information the State will
reimburse the County for all costs related to computer entry of
Monthly Summary Pesticide Use Reports generated by growers in
Contra Costa County.

1. The Contractor agrees to indemnify, defend and save harmless the State, its officers, agents
and employees from any and all claims and losses accruing or resulting to any and all contractors,
subcontractors, materialmen, laborers and any other person, firm or corporation furnishing or
supplying work services, materials or supplies in connection with the performance of this
contract, and from any and all claims and losses accruing or resulting to any person, firm or
corporation who may be injured or damaged by the Contractor in the performance of this
contract.
2. The Contractor, and the agents and employees of Contractor, in the performance of the
agreement, shall act in an independent capacity and not as officers or employees or agents of State
of California.
3, The State may terminate this agreement and be relieved of the payment of any consideration to
Contractor should Contractor fail to perform the covenants herein contained at the time and in the
manner herein provided. In the event of such termination the State may proceed with the work in
any manner deemed proper by the State. The cost to the State shall be deducted from any sum due
the Contractor under this agreement, and the balance, if any, shall be paid the Contractor upon
demand.
4. Without the written consent of the State, this agreement is not assignable by Contractor either in
whole or in part.
5. Time is of the essence in this agreement.
6. No alteration or variation of the terms of this contract shall be valid unless made in writing and
signed by_the parties hereto, and no oral understanding or agreement not incorporated herein, shall
be binding on any of the parties hereto.
7. The consideration to be paid Contractor, as provided herein, shall be in compensation for all of
Contractor's expense incurred in the performance hereof, including travel and per diem, unless
otherwise expressly so provided.

AMENDMENUCANCELLATION
This agreement may be amended upon written mutual consent. or cancelled by either party, upon thirty
(30) days written notice unless otherwise stated(State Administrative Manual Section 1247).
AMERICANS WITUDISABILITIES AC
By signing this contract, Contractor assures the state that it complies with the Americans with
Disabilities Act(ADA)of 1990. (42 U.S.C. 12101 et seq.), which prohibits discrimination on the basis
of disability, as well as all applicable regulations and guidelines issued pursuant to the ADA.
APPROVAL
This contract shall not be considered effective until signed by both parties and approved by the
Department of General Services if required(State Administrative Manual Sections 1215 and 1216).
AUDI
It is hereby mutually agreed that Contractor shall be subject to the examination and audit of the State
Auditor for a period of three years after final payment under this agreement(Government Code Section
8546.7). The examination and audit shall be confined to those matters connected with the performance
of this contract including but not limited to the cost of administering the contract.
BUDGET ACI
It is mutually agreed that if the Budget Act of the current year and/or any subsequent years covered
under this agreement does not appropriate sufficient funds for the program, this contract shall be of no
further force and effect. In this event, the State shall have no liability to pay any funds whatsoever to

be obligated to perform any provisions of this contract.
DISPUTES
Any dispute concerning a question of fact arising under the terms of this agreement which is not
disposed of within a reasonable period of time(ten days) by the Contractor and State employees
normally responsible for the administration of this contract shall be brought to the attention of the
Chief Executive Officer(or designated representative)of each organization for joint resolution(Public
Contract Code Section 22200 and California Code of Regulations, Title 1, Section 300 et seq.).
INVOICES AkM PAYMENIS
The Contractor shall render invoices for total monthly or quarterly charges in the month or quarter
following the month or quarter for which the charges accrue. Invoices will be submitted in triplicate.
Allow up to sixty (60)calendar days for payment of invoices.

By signing this contract. the contractor or grantee hereby certifies, under penalty of perjury under the

aws of the State of California, that the contractor or grantee will comply with the requirements of the
Drug-Free Workplace Act of 1990 (Government Code Section 8350 et seq.) and will provide a drug-
free workplace by taking the following actions:
l) Publish a statement notifying employees that unlawful manufacture, distribution, dispensation,
possession, or use of a controlled substance is prohibited and specifying actions to be taken against
employees for violations.
2) Establish a Drug-Free Awareness Program to inform employees about all of the following:
a) the dangers of drug abuse in the workplaces
b) the person's or organization's policy of maintaining a drug-free workplace;
C) any available counseling,rehabilitation and employee assistance',programs; and
d) penalties that may be imposed upon employees for drug abuse violations.
3) Provide that every employee who works on the proposed contract will:
a) receive a copy of the company's drug-free workplace policy statement; and,

NONDISCRIMINATION CLAUSE(QCP-1)
During the performance of this contract,contractor and its subcontractors shall not unlawfully
discriminate, harass or allow harassment, against any employee or applicant for employment, because
of sex, race, calor,ancestry,religious creed,national origin, physical disability (including HIV and
AIDS), mental disability, medical condition(cancer),age(over 40),marital status, and denial of family
care leave. Contractor and subcontractors shall insure that the evaluation and treatment of their
employees and applicants for employment are free from such discrimination and harassment.
Contractor and subcontractors shall comply with the provisions of the Fair Employment and Housing
Act(Government Code Section 12990(a-f)et seq.) and the applicable regulations promulgated

1998/99 PESTICIDE APPLICATION REPORTING
TERMS AND CONDITIONS
In the best interests of the State, and under authority of the Director, the Department of
Pesticide Regulation, Information Systems Branch and the County of Contra Costa agree
to the following.
All pesticide use records submitted to the County shall be reviewed for accuracy of the
information separate from the permit. After said review, the County shall submit to
CaIIEPA, all production agriculture and monthly summary pesticide use report
applications for the period July 1, 1998 through June 30, 1999 meeting the data
requirements as stated herein on a monthly basis. (CalTrans data should not be sent by
the County to avoid duplication.)
Data must be submitted on either 3-1/2" or 5-1/4" floppy disks, electronic mail or the
Internet. A summary of the number of records contained on each file mast be included.
Each file shall be clearly identified with the following information -- county name,
application month and year, file name, number of records, and if it is being sent on a disk
it must also include the disk number.
For both production agriculture and monthly summary data, the file name shall consist of
eight (8) characters: the first position will be a letter; the second two positions shall be the
county number; the third two positions shall be the batch number; the fourth two positions
shall be the process year; and the last position is the disk sequence number.
Each file shall include data for one year only. Data for overlapping years may be on a
single disk, but each year shall be in a separate file and labeled appropriately.
Data must be readable by NIS DOS version 2.11 or greater.
Data must be submitted in a flat or ASCII file.
Data must be in the format provided by Information Systems, as identified in the attached
Exhibit(s) B.
Commodity Cedes must be from the `Most Common Commodity Codes' list as provided
by Information Systems and identified in the attached Exhibit C. As necessary, changes
will be made to this list and copies will be forwarded to the County by Information
Systems.

All submissions will be verified by Information Systems. A summary of the accepted and
a listing of the rejected applications will be returned to the County. Rejected submissions
shall be corrected and resubmitted on hardcopy to Information Systems.'
Payments will be made quarterly based upon the number of submissions minus the
number of rejected records (error lists). Payment of rejected records will be made upon
receipt of the hardcopy(s)with verifications from the County. Verifications may include,
but are not limited to the following:
- any appropriate correction to the invalid record
- request to delete the record
- statement that a NOV was issued
- statement of compliance with the label (this will be verified by Information Systems)
It is understood by Information Systems that not all rejected submissions are correctable
due to product label language vs the label database, and this will be taken into
consideration upon receipt of the verified errors lists.
Funds will be distributed upon review of the data and approval of the invoice submitted to
the Department of Pesticide Regulation . The invoices shall be on official County
letterhead stating the total number of applications submitted during the last billing cycle
at a rate of 30 cents per application, and the total amount of money requested.
Information Systems reserves the right to decrease the amount of payment on the invoice
but will track the unpaid portion for future payment of returned error lists.
The County shall be reimbursed by submitting an invoice, quarterly in arrears, to:
Department of Pesticide Regulation, Information Systems Branch, 1020 N Street, Room
322, Sacramento, California 95814, Attention: Ria Spencer.
The County shall maintain and make available for audit by the state all records pertaining
to this contract for a period of three years after the payment of each apportionment
received as a result of this agreement.
This agreement shall be effective for the period beginning July 1, 1998 and terminating
June 30, 1999.
This agreement may be amended or cancelled upon written mutual consent, upon thirty
(30) days written notice.
The total amount of this agreement shall not exceed$10,000.
