Resolution No. 98/451 WHEREAS, on December 17, 1996,the Contra Costa County Board of Supervisors appointed three valuation assessment commissioners to prepare an assessment valuation roll for Reclamation District No.830; WHEREAS, on July 21, 1998 , there was filed with the clerk of the Board of Supervisors an assessment roll being known and designated as Operation and Maintenance Valuation Assessment Roll of Reclamation District No.830; NOW, THEREFORE, BE IT RESOLVED AND ORDERED that"Tuesday, theme day of September 1998, at the hour of 2 P.M. in the Chambers of the Board of Supervisors on the First Floor of the Contra Costa County Administration Building, in the City of Martinez, County of Contra Costa, State of California, be, and the same are hereby fixed as the time and place when a meeting of the said Board of Supervisors will be held for the purpose of hearing objections to said assessment roll and the assessment valuations therein described. Reasons for Recommendations and Background: 4n August 11, 1998, the Board of Supervisors passed a resolution forming the Tri Valley Transportation development (TVTD) Area of Benefit. In accordance] with government Code Section 65962, the fees adopted at that time will be effective on October 11, 1998 (60 days after the adoption of the fee). The Board also adopted an urgency measure as an interim authorization for fees to be collected immediately. This authorization to adopt road fees is required pursuant to Government Code Section +65962 so that potential revenues are not lost during the time remaining before the TVTD fee goes into effect. IV. Consequences of Negative Action: Failure to extend the interim authorization of road fees until permanent fees for the Tri-Valley Transportation Development Fee Area of Benefit become effective may result in a loss of potential revenues during the time remaining before the regular ordinance goes into effect. Recommended Action: FIX September 22, 1998 at 11:00 A.M. for a public hearing to revise the Say Point Area of Benefit and DIRECT the Public Works Director to give notice of the hearing and to file a copy of the Development Program Report for the Bay Point Area of Benefit with the Clerk of the Board in accordance with Government Code Sections 65091 and 66484. If. Financial Impact: The revision of the Bay Point Area of Benefit will have no financial impact on the General Fund. Reasons for Recommendations and Background: On September 24, 1985, the Board of Supervisors passed a resolution farming the West Pittsburg (now Bay Point) Area of Benefit. At the time, there were many vacantparcels in the area with potential for residential and commercial development, and the existing transportation system was inadequate to handle the additional traffic generated from the projected';development. The Area of Benefit program has since been revised to reflect the changing needs of the area. The Bay Point area has, in recent years, experienced changes in the area's traffic circulation needs and development potential. Most of the residential development potential has been fulfilled and many of the Area of Benefit projects have been constructed. These changes have prompted another revision to the area of benefit program, resulting in a new project list and fee schedule. IV. Consequences of Negative Action: Failure to implement the revisions to the Bay Point Area of Benefit may discourage development in the Bay Point area, and the funding of future projects may be delayed.
