FIND and DECLARE that the work described below constitutes channel protection and maintenance work covered by Public Contract Code Section 21191. 2. FIND and DECLARE that the work described below is emergency work that is necessary to protect life and property from impending flood and erosion damage. 3. AUTHORIZE the Chief Engineer or his designee to proceed in the most expeditious manner to arrange for the work described below and to enter into a contract therefore. Project No: 7527-6D9P03-98 DATE: September 1, 1998 PAGE 2 H. Financial Impact: The total cost of the work, including contract administration and inspection, is estimated to be $74,000. This project is funded by Flood Control Zone 7 (100%). III. Reasons for Recommendations and Background: On August 27, 1998, the Flood Control and Water Conservation District Maintenance Division received informal bids for Desilting Wildcat Creek Basin. The bids are over the $50,000 informal bid limit preventing the Chief Engineer from executing a contract in accordance with Ordinance 93-59. This silt removal is urgently needed before the rainy season to protect the creek improvements, Verde Elementary School, and commercial and residential properties in the immediate vicinity. There is inadequate time to readvertise this project and complete this work before the rainy season and before the October 15, 1998 deadline imposed by the California Department of Fish and Came. It is essential that the Chief Engineer be given the authority granted by this declaration to expedite the silt removal without the delay of formally rebidding this project. IV. Consequences of Negative Action: Without this declaration, the silt removal cannot be performed this year. A portion of said property is DETERMINED to be surplus and no longer necessary for district or other public purposes and its estimated value does not exceed $10,000.00. This Board hereby APPROVES and AUTHORIZES the conveyance',of said property to the City of Brentwood, pursuant to government Code Section 25526.5 and the Board Chair is hereby AUTHORIZED to execute a Grant Geed on behalf of the District. The Real Property Division is DIRECTED to cause the Grant Deed to be delivered to the grantee. The Board hereby FINDS that effects of this conveyance have already been considered in the Environmental Impact Report prepared for Subdivision 7939, the Brentwood Country Club, and that no further determinaiton in this regard is necessary.
