Determination of Property Tax }
Exchange for SPAS "G & H" )
Annexation To The City of )
Brentwood (LAFC 98-29) }
WHEREAS, on June 23, 1998 the Board of Supervisors adopted Resolution No. 98/348 providing for
property tax exchange for the annexation of territory to the City of Brentwood (City)and the Brentwood Recreation
and Parks District(BR&PD); and
WHEREAS, the proposed annexation has been amended to include the concurrent annexation to the East
Contra Costa Irrigation District (ECOID); and
WHEREAS, the annexation to ECCID would result in ECCID providing services in an area where such
services have not previously been provided and where Section 99.01 of the Revenue and Taxation Code provides
for the annexing agency to negotiate an agreement regarding the potential transfer of incremental property tax
in the affected territory; and
WHEREAS,for the property tax allocation to be made under this resolution,the Auditor-Controller of Contra
Costa County shall first apply the provisions of the master property tax exchange agreement between the City of
Brentwood and the County and then apply the tax increment allocation factors for property tax increment
apportionment to BR&PD and ECCID as shown on the attached schedule marked Attachment A;
THEREFORE, BE IT BY THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY RESOLVED
that the property tax increment allocation factors for the affected agencies in the area of the SFAs "G & H"
Annexation to the City of Brentwood (LAFC 98-29) shall be shown on the attached schedule (Attachment A) for
the fiscal year for which the State Board of Equalization makes the tax rate area changes for this jurisdictional
change. Said factors shall apply in subsequent years unless changed by the mutual agreement of affected
agencies or subsequent jurisdictional changes. Said increment tax allocation factors apply to affected territory
as submitted or revised by the Local Agency Formation Commission. This resolution does not change the affected
districts' right to collect taxes for existing bonded indebtedness.

Annexation to the Kensington )
Community Services District }
(LAFC98-37) )
WHEREAS, Section 99 of the Revenue and Taxation code provides that in the event of a jurisdictional
change that would affect the service area or service responsibility of one or more special districts, the Board of
Supervisors shall, on behalf of the district or districts, negotiate any exchange of property tax revenues; and
WHEREAS,the Sunset View Cemetery Annexation to the Kensington Community Services District involves
the annexation of territory to the Kensington Community Services District(KCSD)and the concurrent detachment
of said territory from County Service Area P-6 (CSA P-6)which will affect the service responsibilities of the District
and Service Area; and
NOW, THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF CONTRA COSTA
COUNTY DUES HEREBY DETERMINE that 100 percent of the property tax revenue accruing to CSA P-6 from
the affected territory of the Sunset View Cemetery Annexation to the Kensington Community Services District shall
be transferred to KCSD. The terms of this property tax exchange agreement shall be effective for the fiscal year
for which the State Board of Equalization makes the tax rate area changes for this jurisdictional change and shall
apply in subsequent years unless changed by the mutual agreement of affected 'agencies or subsequent
jurisdictional changes. This resolution does not change the property tax revenues accruing to other agencies
servicing the subject territory or the affected agencies right to collect taxes for existing bonded indebtedness. The
property tax exchange agreement discussed above shall apply to affected territory as submitted or revised by the
Local Agency Formation Commission.
