BARRY, AICP QCounty COMMUNITY DEVELOPMENT DEPARTMENT DIRECTOR DATE: SEPTEMBER 1, 1998 SUBJECT: TRAFFIC RESOLUTION 3843 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Adopt revised traffic resolution and regulations concerning car pool parking at the County lot on Pine and Escobar Streets (Exhibit A). FISCAL IMPACT None. BACKGROUND/REASONS FOR RECOMMENDATIONS On December 17, 1991, the Board approved Traffic Resolution 3488 to designate portions of the parking lot as permit parking for car/van pool vehicles, Monday - Friday, 6:30 a.m. - 6:00 p.m. The revised Traffic Resolution 3843 will change the permit parking hours to 6:30 a.m. - 4:00 p.m. to allow all employees to park, based on availablevacancy, closer to the administrative office building near lighted areas while working evening hours. To further this policy, the Board desires to encourage County employees commuting to and from County work locations to form car pools. Consistent with this policy, the Board, through the adoption of ordinances and other actions, has supported measures to reduce peak-hour traffic congestion, energy consumption, and noise levels and emissions, Measure C (1988), Proposition 111 (1990), and the adoption of the Bay Area Clean Air Plan (1997) have underscored the necessity of effective Transportation Demand Management programs to reduce single-occupancy vehicle trips and increase transit Use. Specifically designating, as needed, portions of the parking lot for reserved car/van pool parking spaces during County business hours would encourage the formation of future car/van pools. Therefore, upon the recommendation of the Director of Community Development, the Board of Supervisors of Contra Costa County RESOLVES THAT: Pursuant to Sections 21113, 22519, 22651 and 22658 of the California Vehicle Code, the County-owned parking lot located on the northeast corner of Pine Street and Escobar Street (between Marina Vista and Escobar Streets), Martinez, is hereby declared to be a permit-only parking lot, in designated areas, for car/van pool vehicles registered with the Community Development Department. No vehicle, as defined in California Vehicle Code section 670, shall be parked or remain in the portions of said lot designated permit parking only for car/van pool vehicles without a valid car/van pool parking permit, issued by the Director of Community Development, visibly displayed on the vehicle's dashboard. Any vehicle parked in any portion of said lot designated for permit parking only for car/van pool vehicles, between 6:30 a.m. and 4:00 p.m., Monday- Friday without the required, visibly-displayed, valid permit, shall be in violation of this Resolution and the California Vehicle Code. The Director of Community Development is authorized and directed: 1. To designate, from time to time, areas of the subject lot',as car/van pool vehicle permit parking only; 2. To post and maintain in conspicuous places in said parking lot, RULES AND PROCEDURES ACCOMPANYING TRAFFIC RESOLUTION NO. 3843 � t 1, 1998 1. For the purpose of these rules, "car/van pool" means a group of two or more persons who regularly commute to work in the same vehicle. 2. A permit to park shall be issued by the Community Development designee or the Director of Community Development (DCD), only to caravan pool members who are registered with the Community Development Department. 3. One permit shall be issued to each valid car/van pool. 4. When a vehicle is parked in a designated permit-only parking area, a permit of the persons who have been registered by the DCD as members of the carlvan pool must be displayed on the dashboard. The permit must be displayed in a manner such that the permit member(s), names, and work phone numbers of the holders and the expiration date(s) are clearly visible and legible from the outside of the vehicle. 5. A vehicle may be parked in designated permit-only parking lot areas only if at least two members of the car/van pool have actually shared a ride during the commute trip in the vehicle and their permit is displayed on the dashboard of the vehicle in the manner described in rule 4. If any member of the car/van pool is absent from work for any reason (vacation, illness, etc.), the other members may use the permit-only parking lot area only if there are at least two members using the vehicle. 8. Each permit shall be valid for a one year period from the date of issuance. Permit holders are responsible for renewing their permits before the expiration date and for requesting new permits from DCD when permits become illegible, damaged, or lost . 7. Issuance of a parking permit by the DCD does not guarantee that a parking space in the permit-only parking lot area will be available to every permit holder. 8. Changes of participants in the car/van pool from those listed on the application shall be reported immediately in writing to the DCD or his designee. 9. Violation of any of these rules after one warning shall be just cause for the DCD to revoke the permit. The holder of the permit shall immediately surrender the permit to the DCD or his designee upon receipt of a "Notice of Revocation." The violator(s) shall not be eligible for issuance of a new permit for a period of at least six months. 10. Rules 4 and 5 shall be enforced between 8:30 a.m. and 4:00 p.m., Monday through Friday. Any empty spaces in a designated permit-only parking lot will not be available for general use; parking spaces designated for car/van pools will be available for public use after 4:00 p.m., and on Saturday and Sunday. 11. The provisions of rule 9 shall not limit other remedies available to the County. in particular, violators of rule 4 or 5 shall be subject to citation and removal of their vehicles in accordance with law. j:lgroupslcdadpool\audreytmarjorie\tules3843.doc appropriate sign notices of all special conditions or regulations (including notice of the portions of the lot designated permit parking only for car/van pool vehicles) imposed pursuant to this resolution; 3. To administer the issuance of permits in accordance with the rules and procedures accompanying this resolution; and 4. To file with the Clerk of the Board a written statement of all special conditions, resolutions, and regulations adopted pursuant to Section 21113 of the California Vehicle Code. The Clerk of the Board and the Director of Community Development, at their principal offices, are directed to maintain and keep available for inspection by all interested persons the written statement prepared by the Director of Community Development, of all special conditions, resolutions, and regulations adopted pursuant to Section 21113 of the California Vehicle Code. Traffic Resolution No. 3483, dated March 10, 1992, is SUPERSEDED by the adoption of this resolution. PASSED ON Ae2tember 1 .
