FISCAL IMPACT: This Contract is funded by Centra Costa Health Plan member premiums. Costs depend upon utilization. As appropriate, patients and/or third party payers will be billed for services. BACKGROUND/REASON(S) FOR RECOMMENDATION(S): The Health Plan has an obligation to provide certain specialized professional health care services for its members under the terms of their Xndividual and Group Health Plan membership contracts with the County. The Health Plan is also required under the termsof its Local Initiative contract with the State, to contract with community` physicians and other providers, called "Safety Net" and "Traditional"'', Providers, for the provision of medical care to Medi-tial recipients . This Contract is necessary to meet State mandates to expand the number of community providers for the Local- Initiative, alone with a recent Department of Corporations audit finding that requires formal contracts' with low volume providers. .Approval of this Contract will allow the Contractor to continue providing professional health care services to Health Plan members'' through. RECOMMENDED ACTI0N1: Approve and authorize the Sheriff-Coroner, or his designee, to execute on behalf of the County, a contract with John A. Montagh, for Rangemaster/Armorer/Instructor services for the period of September 1, 1998 to August 31, 1999. 11. FINANCIAL IMPACT. Continued County funding in an amount not to exceed $53,200 for this service is included in the Sheriff's Department budget. This is an ongoing function. Specific terms will be contained in the Contract to be hereafter executed. 111. RE.AW1 S FOR.RECOMMENDATIONIBACKGROUN The Sheriff's Office contracts with Los Medanos College, Martinez Adult School and other Police Agencies for use of the Sheriff's Range. These contracts depend on an on-site coordinator, for the realization of their goals. The safety of persons and property is the responsibility of the Rangemaster. The Sheriff's Office is currently transitioning from revolvers to semi-auto pistols. These firearms require regular annual maintenance.An expedient method to maintain these firearms would be to perform the maintenance at the range coordinating(t with the Annual Firearms Training. This method would require an armorer on the premises. The Sheriff's Range is currently undergoing a metamorphosis to make it more accessible, safer and enjoyable. John Montagh has been involved in these improvements for the past 15 months, and has been an integral part of the fruition of these goals. The Sheriffs Safety personnel must train and qualify with firearms on a semi-annual basis. During FY 97/98 Professional Standards and Resources scheduled over 150,000 man hours of firearms training, utilizing four ranges.When firearms are being used on more than one range simultaneously a rangemaster is necessary. John has been instructing firearms for the Sheriff for more than ten years and has acted as rangemaster for 15 months. IV. C AlSEQUENCES OF NEGATIVE AC1I0N., Negative action on this request would lessen the Sheriffs ability to meet mandated legal requirements for Peace Officers(in regards to Firearms Training)and would increase the county's liability for daily activities at the Sheriffs Range. Issue "loaner" firearms for Sheriff's Safety Personnel while their "Duty Firearm" is being repaired. (d) 1. Instruct firearms or supervise firearms instructors for Professional Standards and Resources as scheduled. 2. Participate in development of Sheriff's Firearms Courses for Safety Personnel and others as requested. 2. These Services will be provided during normal business hours,Monday through Friday,and shall not exceed 40 hour per week. Reasons for Recommendations and Background: Since 1994195, under annual or biannual contracts with the County, Bethel Island Municipal Improvement District (BIMID) has been performing stormwater pollution control services for Bethel Island. The same service was extended to Hotchkiss Tract in January 1996. If the Board of Supervisors authorizes execution of this contract, BIMID will continue to provide the following services: an annual cleanup collection weekend, drainage ditch cleaning, and public education on pollution prevention and proper disposal practices. Stormwater pollution control services are done to meet the requirements of the County's Municipal NPDES Stormwater Permit. The Permit is administered jointly by the cities, County, and Centra Costa Flood Control and Water Conservation District under the auspices of the Contra Costa Clean Water Program. In other parts of the unincorporated County, Public Works staff provides such services. The transfer of Clean Water Program functions and funding to BIMID on August 9, 1994 eliminated duplication of activities between County and BIMID staff. Stormwater utility assessments paid by property owners, fund the Contra Costa Clean Water Program. A portion, approximately 20%, of these monies is spent on countywide activities, rather than local jurisdiction activities. Therefore $31,160 of the approximate $37,200 of stormwater utility assessment revenue generated annually by Bethel Island ($30,000) and Hotchkiss Tract ($7,200) is available for contract funding to spend on projects specific to Bethel Island and Hotchkiss Tract. Approval of this agreement will promote Contra Costa Clean Water Program goals to eliminate, reduce and prevent stormwater pollution from entering the storm drain system and natural waterways of the County. In addition, a formal agreement with BIMID ensures that County staff will continue to receive records on the amounts and types of contaminants removed by BIMID. The Regional Water Quality Control Board requires the County Clean Water Program to submit this data annually as a condition of its State municipal stormwater permit. Finally, the closed drainage system and central pumping of runoff back to the river are unique characteristic of Bethel Island, which merits continued transfer of stormwater utility assessment fees and duties to BIMID. IV. Consag uenices Qf Negative Action: BIMID will not receive reimbursement for the costs of providing ongoing stormwater pollution control activities. These funds are typically provided to affordable housing developers in the form of a loan with favorable loan terms . The County's funds are secured against the property by a deed of trust and specific affordability and use restrictions are incorporated into a loan and regulatory agreement between the County and project developer. In addition to housing, approximately $500,000 in CDBG funds are allocated on an annual basis to economic development projects designed to create jobs for low-income persons . These funds are also typically secured against the project property through a deed and loan agreement. The law firm of Goldfarb and Lipman has previously provided the County with legal assistance in negotiating loan terms and drafting the required legal documents for CDBG and HOME projects .
