The following document was presented for Board approval this date for
DP 3027-81 , property located in the Orinda area.
A Road Improvement Agreement with Williams & Burrows, Inc. , developer,
whereby said developer agrees to complete all improvements as required in said
Road Improvement Agreement within one year from the date of said agreement;
Said document was accompanied by the following:
Security to guarantee the completion of road and drainage improvements
as required by Title 9 of the County Ordinance Code, as follows :
a. Cash deposit (Auditor 's Deposit Permit No. 71130, dated October 17,
1983) in the amount of $1 ,000 made by Williams & Burrows, Inc.
b. Additional security in the form of a .corporate surety bond dated
October 10, 1983, and issued by Federal Insurance Company (Bond
No. 8099-08-21 ) with Williams & Burrows, Inc, as principal , in
the amount of $82,700 for faithful performance and $41 ,350 for
labor and materials .
NOW THEREFORE BE IT RESOLVED that said Road Improvement Agreement is
APPROVED.
Said Road Improvement Agreement covers all the improvements covered in
the Subdivision Agreement with Orinda Community Church for Subdivision MS 72-81 .
BE IT FURTHER RESOLVED that said Subdivision Agreement with Orinda
Community Church, Inc. , as approved by the Board .on March 30, 1982, is TERMINATED,
and the Public Works Director is AUTHORIZED to .refund the $1 ,000 cash deposit
(Auditor's Deposit Permit No. 50602, dated March ,9, 1982 .to Orinda Community
Church, Inc.)
BE IT FURTHER RESOLVED that the Public Works Director is AUTHORIZED
to return the letter of credit issued by Wells Fargo Bank (No. 15777) to
Orinda Community Church, Inc.
