HomeMy WebLinkAboutMINUTES - 09151998 - C104 IN THE BOARD OF SUPERVISORS f � ( OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA ADOPTED this order on September 15 . 1998 by the following vote: AYES: SUPERVISORS UILKEMA, GERBER, DeSAULNIER, CANCIAMILLA and ROGERS NOES: NONE ABSENT: NONE ABSTAIN: NONE RESOLUTION NO. 981474 SUBJECT: Determination of Property Tax } Exchange for County Fire } Protection Districts Boundary } eorgaoization (LAIC 98-48) WHEREAS, Section 99 of the Revenue and Taxation Code provides that in the event of a jurisdictional change that would affect the service area or service responsibility of one or more special districts, the Board of Supervisors shall, on behalf of the district or districts, negotiate any exchange of property tax revenues; and WHEREAS,the County Fire Protection Districts Boundary Reorganization proposes to detach the territory of the former Oakley Fire Protection District{currently the Oakley Reserve Division of the Contra Costa County Fire Protection District} from the Contra Costa County Fire Protection District, form the dependent Oakley;Fire Protection District consisting of the territory of the former Oakley Fire Protection District, detach the portion of the Hotchkiss Tract area that was formerly (prior to the 1994 consolidation) part of the Bethel Island Fire Protection District from the Contra Costa County Fire Protection District and annex the detached portion of the Hotchkiss Tract area to the Bethel Island Fire Protection District. NOW,THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY DOES HEREBY DETERMINE that 109 percent of the property tax revenue generated in the area of the former Oakley Fire Protection District and the portion of the Hotchkiss Tract area that was formerly part of the Bethel Island Fire Protection District as the areas existed prior to July 1, 1994 shall be transferred from the Contra Costa County Fire Protection District to the new Oakley Fire Protection District and the Bethel Island Fire Protection . District respectively. The terms of this property tax exchange agreement shall be effective for the fiscal year for which the State Board of Equalization makes the tax rate area changes for this jurisdictional change and shall apply in subsequent years unless changed by the mutual agreement of affected agencies or subsequent jurisdictional changes. This resolution does not change the property tax revenues accruing to other agencies servicing the subject territory or the affected agencies right to collect taxes for existing bonded indebtedness. The property tax exchange agreement discussed above shall apply to affected territory as submitted or revised by the Local Agency Formation Commission.
